On September 21 2009 Diane ward was found shot to death in the master bedroom of the mansion she shared with her millionaire husband.

Bob Ward.

Her death rocks the exclusive Orlando neighborhood which golf -- Tiger Woods and Arnold Palmer once called home.

Police say -- suffered a gunshot wound to the face and died at the scene.

In -- 911 call Bob made moments after the shooting but police say statements like these incriminate Bob Ward quote.

She's dead she's done I'm sorry and it was an accident.

The gun just went off.

Quarter was arrested that night and taken to the police station where He called family -- friends and told them about Diana's death.

Including this call He made to Diana's brother.

Diana's death.

-- It and don't own.

Is not a role pretty -- you know it and nobody knows about it but you and well that's another story.

But right now they're Mother's Day probably can't tell you will be playing right now those things that she's.

And it was -- Pan and it'll tell you more about it later you know do woes.

Very tragic accident.

-- and that all I wish I could do was a few months old and.

-- despite the 911 call police say ward changed his story once they started interrogating him.

Telling investigators He was actually trying to stop Diane from committing suicide when the gun went off.

During the interrogation -- say ward was smiling and seem to be in a good mood but was clearly also aware He was under suspicion.

What -- -- but we probably need to go ahead and supporter here.

Toxicology tests would later show Diane had alcohol and powerful anti depressants in her system before her death.

The sensational trial has made big headlines in Orlando not just because of the twist in the case.

But also because of -- bizarre behavior during a jailhouse meeting with his sister in law and daughter.

War can be singing dancing and laughing even pretending to take off his shirt at one point and then there are exchanges like this one.

There's money -- the accountant for you to get there's there's all sorts of goodies -- you can thanks -- so I think in the united enjoy that.

And extreme.

-- -- First I -- -- we said before we went -- that -- she wasn't shot five times.

She told that that He told a dispatcher five times.

That He had shot his -- okay so she was only shop -- joining me now is judge -- -- -- of justice with judge Janine -- your oxygen.

Are right judge so.

-- They claim He essentially confessed when He made that 911 call.

To shooting her and they -- statements like she's dead she's done I'm sorry.

You think this -- might actually get credit you know it's very interesting because these statements on first blush appear to be very incriminating night.

I just shot my wife she's dead she's done and then oldest son He backs off of that when an attorney comes on the scene and -- -- Well -- was suicide we were struggling for the gun.

But I think that ultimately if the jury is listening in Orlando.

They will see that the trajectory of the bullet is straight.

And so that even if there were -- struggle for the got an even if He were trying to stop her.

From committing suicide the trajectory wouldn't -- so the story -- out of there were a struggle she was trying to shoot herself but he's wrestling -- Carolina very unusual would be that direct meanwhile He doesn't have gunshot residue on his hand.

Which could be an indication that He washed his hands or maybe -- gonna reject you get gunshot residue off with soap and water you can you can wash it off there's no question about it.

But it's his behavior is the fact that He was -- -- to be deposed by the US bankruptcy court trustee.

In -- tremendous financial investigation.

That involved his wife and she was going to be deposed as well as she was gonna testify against him or not we do right -- be favorable to him -- not sure whether it was against him obviously there's a husband wife privilege but there's ways of getting around it and the bankruptcy trusting wanted her to testify.

So then you've got him as saying -- wanna shoot myself because of what I.

Just what just happened and the bad blood there -- the fact that there's a history of physical violence -- -- first wife.

Problems with an ex girlfriend I mean this is bizarre and for his daughters to be dancing around that's going on and that jailhouse to see what is -- -- let's.

I mean you've assembled a big time DA in Westchester county and the judge.

We need it if you see this tape okay so that you get his daughter this is college age daughter there -- -- -- get you -- rock yeah whatever I don't know it's at some sort of jailhouse joke I gather.

And -- can have dancing around while his wife is dead admittedly it is on hand what it was an accident or not.

What does this tell you when would this be admissible.

Oh I think yeah I think it would be admissible the question is how the jury would interpret it I mean the prosecution can make one argument the defense another.

They're not stress but it also depends on how long after they the the -- that this occurred.

The prosecution feels very strongly that they have everything they need for a second degree murder can conviction.

The defense is every bit as as confident as well and by the way if your wife just commit suicide -- -- struggling with her over -- You take the gonna put it back in the night -- it's almost like you say to yourself Megan.

Okay I'm done with that let me put it away to -- -- all -- -- that that that that's I mean like to the national she's that she's done.

She's -- she's got.

Let's get it yet but He could just be a bizarre person and not a person guilty of murder you know that's what that points and caviar while we hear every day that you know the behavior doesn't mean mean mean -- -- Merkel.

-- thought you could you talk about that they can they figure out where the gun shot came from because I know the prosecution is arguing that she was shot from over a foot away.

And that would undermine.

His claim that it was all an accident that she would basically shooting herself to try to shoot herself -- saying it was a good distance between big guns.

And -- the decedent which means.

There may have been a shooter pulling the trigger well what.

I have here is actually I was just looking at that make and I do have to report the supplement to the autopsy report.

Which says.

It's let's see I think it's six to twelve inches or 126 inches less than thirty inches.

And if that were the case if he's pulling her arm and -- this arm is is almost thirty inches.

So I don't know if it's so indicative but we know that she -- -- going on her face and therefore there was it was close.

But with that had her hand for him.

The jury will tell us -- earlier judge Jane thank you man.

Coming up --
