The parents of -- missing Utah mom Susan Powell are now speaking out asking some very significant questions about whether the police had enough evidence.

To arrest her husband Josh.

Even if her body had not yet been found.

Josh Powell was from the beginning V primary person of interest the only person of interest in this case.

Really almost from the moment that his -- went missing back in 2009.

Last month Josh killed his two sons and himself.

But the -- top police chief is still defending the way that they ran that investigation lesson.

Hindsight which you have which would you have arrested him you know.

No it won't get a -- well what would we have to -- on the probable cause.

And then we go to court and lose it or plead to a lesser offense he's been out -- you'll probably -- people.

Susan Powell's parents join me now chuck -- Charles and Judy Cox welcome to both of you.

-- I know all of this must still be very fresh for you especially in the loss of -- grandsons so our heart goes out to you.

I and that loss but I know that you're fighting for Susan and for your family still in so many ways so.

Eat when you hear that -- say that that there wasn't enough evidence talk to me about the newly found evidence that you now know about in this case -- And that was -- and then new evidence that wasn't only found they've had that all along.

And I believe that was enough evidence to arrest him on.

-- there's only two big problems -- -- the same that they should have arrested him as this if if they get arrest him and he was convicted then -- grandchildren won't be alive.

But.

That's a big yes -- has.

Arrest impersonate and convict -- -- two separate things especially with nobody so.

They were they're professionals and we depend on the professional look there are professional does and an opinion.

-- used here thank you -- by the decision that they made.

It's it's.

We don't know old all the evidence they have it appeared to us that he should have been arrested long time ago I mean that it.

Judy that talk -- about the note that your daughter laughed if you write a note.

And you -- you put it in a safe deposit box you are sending a very big signal to those who love you.

About what's going on what that -- say.

And basically if there was an accident.

It doesn't that appears to be an accident it was it most likely wasn't.

And that he was involved with -- and -- and she dead make.

A notes that are basically saying that.

She didn't trust him so right there.

That bothers us a lot -- that we knew they were having difficulties in their marriage.

But you see you -- that she and I know this must be so heartbreaking for you as parents taught that you wish that she'd come -- she talked her sisters I guess.

An -- often people want to protect their parents from.

You know I -- anything bad that might be going -- at home.

You know that there -- there also in the other evidence there was blood that was found -- blood found in the in their home.

This notes as well and also a cell -- that he he had messed -- that he he had taken right.

Hey he he haven't Susan's cell phone with him.

And with that with a cell -- in his possession he called -- on the leave a message to basically establish an alibi for himself and I would think that would have been enough it right there to arrest.

And at least detained for.

Interrogation not simple you know we have -- question for you but.

You we want you if you hear some real answers here.

How do you think what when -- and Josh Powell.

Set fire to that home with their grandsons and and it's so difficult think about talk about and I can't imagine what it's like for you.

Why do you think he decided that that that was his only move at that point what was he so afraid of he was feeling cornered.

We saw that in that court.

Just a few days before.

And we were worried.

Because he had that luck to us and there was.

Issues even before he came into the courtroom there was a lot of noise if you asked the -- it -- believe that children with you to not allow him to be with found.

I just wanted the judge to basically.

Say no.

You know visits patients.

For the custody issue but we were very concerned about it.

Team and we -- -- -- time but do you believe that Steve Powell his father may be the only person left who might give you some closure who might know what happened because a lot of the suggestion that that he spoke to his son about what happened in the.

David the police gave two the judge to.

Show probable cause to get the want to -- he -- house.

They specifically -- Listen their cell phone call -- numbers -- from Josh and his dad the day this is -- missing in the day he showed up afterwards anyway I'm.

Convinced that his dad knew everything that was going on if not helping with the case.

-- have a hope that that that will lead to some kind of finality Frist who I'm sure he knows where she is or what or where he has some quarter.

Mary very difficult thing thank you for speaking with us I think a lot to you as you search for some kind of -- -- To this day chuck and Judy Cox thank you very much for being with us and thank you missed you.
