Now arguments over Arizona's controversial immigration -- set to get underway at the Supreme Court this morning.

This is democratic lawmakers already holding hearings.

On another way that they could go through to block the law if things don't go their way in the Supreme Court.

Republicans are calling that move political theater here's Arizona senator John key -- The timing of the hearing on the eve of the Supreme Court argument.

And the fact that the chairman of the committee did not consult with any of us did not consult with -- Senator McCain army for example.

About this Arizona law about what witnesses he would ask from Arizona for example suggested to us this.

Was either an attempt to influence the court decision which would be improper.

Or simply to create a political side show.

He's saying so we're joined now by Arizona Republican David -- -- he's outside the Supreme Court right now on this really important morning in this case.

He's on the house financial services committee.

Good morning Carson good to have you here good morning.

What what's your reaction -- Jon Kyl had to say what you think about this proposal by Charles Schumer of New York.

To sort of come up with a backup plan just in case things don't go their way the supreme.

Well I think actually you just heard it and defender nailed it.

A lot of this and a lot of the discussion about SB 1070 from our home state Arizona had been absolutely political theater.

Has almost nothing to do with the facts of the law the protections that were built into the law it is.

Political groups particularly on the left who used it as a wedge issue to try to excite their base.

When you look at the composition of the court and Elena Kagan has recused herself from this because of the work that she did when she was a solicitor at the White House.

So this the decision could potentially go for four.

Which would default to the lower court decisions and go against.

Your position.

I think it looks more for your sat.

-- -- -- -- I've given up guessing what the Supreme Court it's going to do but if you give a fair reading to the law itself.

To the constitution.

They have to uphold Arizona's law the State's ability to defend itself and actually.

Just execute what the federal law says they're supposed to be doing.

And this is for anyone it's viewing this.

Go on the web and take a look at those simple language -- and seventy and you're gonna find out much of the rhetoric.

Has nothing to do but the bill actually does.

-- just didn't what you think of Marco Rubio has come up with a plan.

That would allow some illegals up half to -- -- And this is something that there's been a lot of folks supporting -- -- to get behind as well is that a plan that that you can get behind.

-- a little larger issues of immigration in a country.

Yeah I've only heard bits and pieces to what the senator has had and discussions.

I mean ultimately.

First the Supreme Court ruling today are are when we finally hear what their final decision it because they held up our employer sanctions law in Arizona.

Defending states' rights.

Then we might be able to take a step backwards say do we have to figure out what policies of the country of how we protect our border protect our citizens.

And deal with these massive cost.

From -- in that -- here in Washington that -- pushed back on the states.

You know we are gonna see once again mr.

climate.

-- mr.

-- he's.

Who represented the White House we know that things -- not have a great day when he.

Oversaw the health care.

Supreme Court question that was up a couple of weeks ago you know -- -- -- expected the dynamic of this to be in there today.

It's a great way to phrase it looked.

I hope -- gonna have another.

Bad day because when you're on the wrong side of history when -- on the wrong side of law when you're on the wrong side of the constitution I think he's gonna have another bad day.

What happens if it doesn't go your way -- I mean -- at this event of a lot pretty much.

-- it is but.

There's always another opportunity and maybe it's time for those those here in congress.

The step up and finally start doing the job Washington has failed to do which is protecting the American citizens protecting the border and and doing -- rational.

Are used to be the county treasurer miracle -- county.

I saw the incredible cost shifting.

That hit the voters -- the citizens -- my community because of the inept miss them Washington DC.

We will see it's amazing really when you look at this.

Backed up immigration and health care huge issues that the Supreme Court is deciding.

In this election year it'll be fascinating to watch her and it's like it could better than us this morning you'll see -- does thank -- --
