Here's a story we told you about earlier JoAnne -- -- is fighting to get her house back after her homeowners association evicted the tenant she was renting to.

Change the locks and moved in their own -- because JoAnne had failed to pay a -- She spoke to FOX & Friends earlier this morning.

I still on the home and you know my problem with this whole thing is that we tried to pay this money.

My husband and I went to the court we asked for an emergency hearing.

We were getting no response back from -- H -- or an HUA attorney we were saying we even happened in that documents we will pay.

This lean Donovan start -- -- like and a mother of five.

So what you need to know before you buy or rent a home where there is a homeowner's association Fox News it.

Guru Bob Massi joins me this morning good morning to you crazy stories are -- Danish just -- -- clear on that story.

Her first story the homeowner's story -- she was never notified.

That she owed -- 2500.

Dollars so is it that the homeowners association responsibility to make sure that she.

Knew that before they could do this eviction of her ten.

Yeah there's two things number one they have a responsibility under the statutes that looked statutes in Florida and I spoke with this lady's lawyer yesterday.

And essentially course any of us who part of association by the way.

Those of us who are part of always say that no disrespect the board members -- -- listening or viewing.

And that is their very frustrated Barney fights it way too much time on their hands and they do excess of things that abuse homeowners every day.

Saying that they should -- -- -- notice number one.

And number two -- she's the owner of the home Gretchen.

How is it.

That I understand they evicted the tenant which by the way at least if from what I understand the timeline they did it -- correctly.

The next question is how do you put somebody else in the home when you're still the title owner of the property.

That's -- doesn't make any sense.

So also it's my understanding that now the rent of the new tenant is that going back to the home or is it going to the -- reaction.

Yet there's a specific law in Florida that says if -- owner of the home.

Does it paid the dues and the assessments.

Then the association.

Goes to the -- it gives them -- and says.

We want the rent payment to go to us will take out our fees and our assessments and then we will send the rent on.

To the homeowner and that's basically a -- that's in the state of Florida if certain protocols are not met -- right so this is gonna go back to court on Wednesday.

Do you see -- -- a precedent kind of setting case depending on how the judge would rule announced.

Well first of all.

I'd be the judge should be given these people were tired of talking to the lawyer yesterday apparently they got stuck and one of those metal detectors going through they were three minutes late for the hearing.

And the judge or issue what's called -- read every possession meaning both H a way can take possession of the home.

So the general when I talked yesterday George the attorney said he filed a motion to dismiss which I read and if you have a reasonable judge.

Yet they should -- what he should do is reconsider and hear the evidence and give these people due process of law.

That's what should happen and hopefully we'll have the problem is these people when and it's -- repairs that I asked for God's sake.

And -- credit and up to somebody else.

And yet there's all these legal issues that are pending just a really excessive example of how screwed up this real estate prices America.

All right and you say make sure you're -- enter -- a homeowner's association that you know the state laws so that you can protect yourself Bob I got to wrap it up there tight on time I just picked.

See you next week.

Could see it take care.

An -- -- Nancy Pelosi.
