The alleged violations outlined in the complaint -- the product of a culture of disregard for basic rights.

Within MCS so that starts at the top and -- pervades the entire organization.

I'm not going to give it up I'm going to continue to enforce.

State laws and federal laws.

And I look forward to going the court because then we can put our case -- and they're gonna have to put up.

And stop these press conferences.

To embarrass me especially -- -- election here.

The Obama administration -- sheriff Joseph Arpaio today in federal court alleging discrimination there you see before the break our question of the day asked.

-- sheriff Joseph Arpaio a crusader or -- self promoter.

97%.

And our online poll said crusader 3% said self promoter.

We're back with the panel senator Reid commented on this federal case today saying best quote for many years.

Share for -- has been operating outside of our nation's laws no one should face discrimination based on the color of their scanned their accent.

Or any other similar characteristics the administration is working hard to stop the scapegoating of immigrant and Latino communities.

By officials like sheriff Arpaio but the definitive way to end this is for congress to fix our nation's broken immigration system back again with the panel.

Charles is mentioning that statement from senate majority leader they have not moved an immigration legislation Ouattara for the administration hasn't proposed a -- -- -- chip.

Well -- -- -- at the risk of opposing.

The people who have spoken in the -- reading -- history of Jerusalem.

And there are a lot of crusaders who have very good as self promotion so you can be -- between Fiat and there's either -- but there's also both.

Look I I I don't know the merits of the case because I haven't heard.

That Arpaio side of the argument is he said let's go to court and you'll hear of the two sides but clearly what is happening here.

Is the administration jamming up an issue.

On the eve of an election that it -- it knows is gonna help it -- thinks is gonna help it.

But the one particular constituency this is exactly what does the Justice Department has been doing for about for months now.

For example of the law in Texas and it's challenging the voter ID law in Texas.

He knows it's not gonna win but he's bringing it to the court as a way to highlight initially cause.

Voter suppression.

Which I think is a phony -- -- -- to gin up support against in in minorities.

That it says are being somehow -- or -- the ability to -- -- -- gonna lose that that case Indiana similar cases of the voter ID case.

Was upheld -- -- three the Supreme Court I think is another case which is just for a show.

And it's -- to have an effect injecting itself into an election so I can't.

Judge on the merits -- but I know it's political intent and its political effect.

Well I can't judge the merits of either but anything that happens this close to an election and involves a -- hot button issue like immigration and like racial profiling which is being accused of is going to be seen through political lens now it might have some merit we'll find out when that's when they're in court and they wanted to.

-- -- total specifics that's just the Justice Department said today.

In that they allege that Arpaio is deputies punished Hispanic inmates for speaking Spanish.

And stopped.

Hispanic drivers nine times more often than whites.

That's part of there.

The press conference today but -- -- -- and those things are if they're true our offensive to many people mostly Hispanics.

And -- but sheriff Arpaio has become a kind of hero.

To.

People who think the immigration law should be enforced more vigorously and I can only assume that this will be one of those trials -- becomes a complete.

Circuits and judge on the on the other -- there are folks who say that he's investigation into the president's birth certificate and whether it was -- Forgery or not has sparked this action.

Politics inside Washington suggest it's more about the election but.

Your thoughts.

Well I read the complaint I mean in this well crafted -- makes very serious allegations and if they -- true.

Or if they can be proven they're not only offense and -- offensive to the constitution.

And the federal law look the sheriff's lawyers who moved to dismiss the complaint and that will probably lose that motion because on its face it makes a claim.

Then they'll get into discovery and all kinds of witnesses will testify current prisoners of former prisoners.

And current sheriff's officers and former sheriff's office of love them and who hate him.

And then they'll be back in court again.

The good news is this will not be resolved before Election Day the bad news this.

I I I think that might be a Jewish couple in this case I don't see there being a settlement he's and that whatever you think of them he has a very tough strong willed guy who won't give him.

I don't think you're gonna see him the Green to the court imposing a -- a terror.

In his sheriff's department -- have to approval major decisions which is the relief the Justice Department asks for.

In a -- -- Arizona that's dealing with these issues the border issues specifically the Arizona law which as we know is being challenged in the Supreme Court.

And you have people who look at the sheriff saying hey listen he's enforcing what we can enforce because the federal government is not.

One about the federal issue vs the state issue well -- -- this fact that is a fascinating issue that will be resolved by the Supreme Court.

And in a month and a half we'll know the answer to that by the end of June.

I don't think it will affect the outcome of this litigation legally.

Politically if the Arizona statute is upheld.

It's a boost to the sheriff politically if the Arizona statute -- struck down.

It's a political blow to the -- but the allegations against him are that even in enforcing federal law.

He has violated federal law.

There -- do you give the court challenge on the Arizona law.

Is further evidence of that idea -- I think its approval idea.

That this administration particularly that the Justice Department.

Is conducting its supposed litigation and challengers again for reasons of politics.

If you heard the oral arguments in that case they solicitor general in defending the administration's position got hammered he was wiped out.

In fact that judges Sotomayor.

Who's a liberal on the court chipset and he has this thing isn't selling trees a liberal I mean it is clear.

That -- court is going to uphold the law.

But the point of the whole litigation is to make it a case -- -- surface the issue.

To to to get all the congress -- Supreme Court hearing will garner and us to appeal to Hispanics.

Whom I would add -- the Obama administration has disappointed.

Because it promised to introduce immigration legislation instead it did health care so it's a way to cover its tracks on this issue.

Is there a potential backlash here and in the politics of this.

I think that it's so politicized especially on this issue that there's a backlash on both sides I mean.

Well people see the with a what the administration is being political sure -- people see this guy is being completely out of line yes I mean I just think that.

That this one is perfectly polarized.

Okay judge thanks for being here pleasure thanks for having -- -- -- back that's it for the panel would stay.
