A giant step forward we are finally getting closer to finding out if pres Obama's health care law is constitutional or not and the supreme court of course decides that.

But some elements of the health care law are already in place what are today and what happens -- with the law struck down.

CQ roll call health care reporter Emily etheridge joins us IC LA thanks to see you -- OK tell me what has been implemented so far.

The things that are in place are commonly known as the patient's bill of rights and that things that can be more popular such as letting children stay on their parents' insurance up in the age of 26.

Children also can no longer be denied insurance because of a preexisting condition.

There's also some -- for insurers insurance company -- have to spend at least 80% of their premiums on things related to health care.

Not marketing not administrative services just straight to health care Condit also a whole host of preventive services that people can get now without cost sharing.

So not paying an out of pocket co pay or not paying your deductible.

Different monsters.

Adults and women and children.

There's also a whole host of benefits for seniors that are already in place one of those -- things it is changing the prescription drug but the called doughnut hole in Medicare.

We does that coverage -- for -- Medicare pays her prescription drugs.

-- -- -- narrow that.

Hold down and provide more coverage for seniors -- gave seniors a one time rebate check for 250 dollars just to cover -- prescription drugs.

Another problem we often see in Medicare is they've tried -- we can't find enough primary care physicians to see Medicare patients because.

Mean they don't get reimbursed amounts the settings started a financial incentive to get those positions primary care doctors more money to see more Medicare.

-- site said that the session number of things are a fact but then the big ticket items are yet to come which has select them any any expansion in the rolls right is that the -- -- -- the thirty million people who don't haven't health insurance before this we don't have those thirty million on that -- with health insurance right.

Exactly right that's Abbas still uninsured -- now.

And dead -- in order to pay for those people.

We're really dependent on this this mandate right that's right and reiterate that until 2014.

Assuming the Supreme Court -- -- stay in place.

So and that as other state insurance exchanges that -- so much about those are set to run in 2014.

That's in the mandate comes in a place that all Americans have health insurance or pay a penalty.

But if this mandate is is unconstitutional.

And it's district and let's say that the -- the laws allowed to stand and there's even some question medium maybe it was unconstitutional and may get rid of the entire -- -- -- entire lot of fall but that decision the Supreme Court would decide or not.

But is there any other plan for financing the -- -- there's no mandate is any other.

Plan B to finance this the expansion of people and Kevin health insurance thirty ninth I'm sure that people right now are trying to work on that plan B we just haven't heard a lot about those alternatives yet Republicans as you heard congressman Bachmann to say.

Want to get rid of it all and start a whole new.

Planet -- or get us people ensure that has its.

Number of different change as.

But really right now supporters of the -- hanging their hopes on that mandate taking place is there any heads AME bill to determine whether or not premiums have gone up in price for not because that was on those one of the promises and very important many Americans the previous stock up -- to premiums even gone up so far.

Students how to Ghana the -- there's sort of a delay obviously and seeing when those things happen you have up to date numbers on you know -- the last six months of premiums went up and like -- -- that a lot of these reforms are in place yet on the did you say -- -- just let's find out Medicare Advantage premiums have gone down a release are growing more slowly.

And private insurance transcending growing more slowly as well so they say at least -- the trend is starting.

To save us more money -- but so flat but at least threaten that right now they're going up just not going up as as quickly as.

As one would expect that somehow that this -- a new law has slowed the -- the increase in -- exactly.

Had there at -- things -- have been a huge disappointment so far to the Obama administration on this law.

One of the things as -- had -- -- pre existing insurance plans they set up in the states and that was a sort of provide a temporary situation people who have preexisting conditions can't get insurance they -- kind of temporarily insure them.

Through these -- Until the states got their exchange -- set up.

They're estimating a few million people -- down that's it's really been about 50000 people.

And that's just not at all what they expected to -- -- -- that -- people mean does that make it cheaper -- mark -- for the lesser people.

Well kind of depends on how sick those people are and how much money and services they need and the administration was it.

Counting on those people who.

Paying into these schools and getting my money out of that's and I am political pain for their insurance.

So it's kind of hard to say hello washes out but they're messed destinations were definitely off on that one particularly if you keep doing when the whole -- understands this -- thank you want thanks so much that we --
