Kelly scored his back in session on the docket today the special prosecutor in the trade on Martin's shooting case Angela Corey who you see here is not happy.
With certain critics who have blasted her handling of George -- -- prosecution.
One of those critics appeared right here in America live twice.
Alan Dershowitz the famed criminal defense lawyer and Harvard law professor.
Says that miss Corey called up Harvard Law School.
And threatened to single.
The university end mr.
Dershowitz during what he described as a forty minute rants.
Over comments Dershowitz has made about this case comments.
Like this.
You are now saying that anybody should be criminally charged in this case it is the prosecutors.
Why well.
First of all anybody who is involved in -- shooting should be investigated and perhaps there should be charges against -- so let's put that aside for second.
But this affidavit submitted by the prosecutor in the Florida case.
It is is a crime is a crime if she in fact knew about ABC news's pictures of the bloody head Zimmerman.
And fail to include that in the affidavit this affidavit is not the truth the whole truth and nothing but the truth.
So can the Florida special prosecutor really still Alan Dershowitz and Harvard Law School.
For libel and slander that's what he says she is threatening.
Or is this a case of sour grapes -- me now.
Defense attorneys onetime prosecutors.
Arthur -- dollar and mark I Clark's gentlemen welcome to use so this that this is -- to make.
The ball with all the respect and is Corey Arthur a little thin skin.
I mean it's not ridiculous and and just -- -- just so.
Everyone's -- -- up and up here.
I know missed the professor Dershowitz I worked on cases with them I would love -- to -- him -- just so hey can -- -- up.
Field day with it I mean and that is bad enough for her to criticize him criticizing -- but they're going called the teachers so to speak to call the dean's office.
And -- complaining about impact it's absolutely ridiculous and what he says and the way -- seven on your show the truth.
The whole truth and nothing but the truth is we did strike to the heart of the matter he's very upset.
That she never put in that affidavit that there was evidence of injuries that could be equated to self defense type of injury.
Right because -- to get the charges brought the -- she filed an affidavit of probable cause it was signed by her investigator.
But it is a product of the district attorney's office ultimately.
And he believes it was it.
It was full of half truths now it definitely didn't tell the whole story mark.
And it didn't include exculpatory.
Evidence for mr.
Zimmerman evidence that would helped mr.
Zimmerman.
But I had a little disclaimer at the bottom of it saying you know war's gonna.
Is that good enough.
I think it is -- to say this I have I don't know Dershowitz personally like Allen does.
I absolutely -- -- commonality that -- absolutely think it does it.
He he's wonderful he's a wonderful professor and an -- as well.
However and many things he says by the way this case are accurate I greeted probably second degree is not the appropriate charge some of the other things that were seeking justice for trade on basic justice for everyone it's not just about one person.
However.
I do think he stepped over the line I don't think there's a lawsuit here but I do think he stepped over the line when he says that it's a crime what they did -- affidavit.
They do have to provide all the exculpatory evidence of the -- to the discovery process.
But this affidavit the sole purpose is to lay out those elements of the crime that establish probable cause.
That's six.
I don't understand where it's coming from when he claims it's a crime and they should be prosecuted he really -- -- -- he really does believe it will listen to a little bit more Alan Dershowitz and then -- pick -- -- Right from the beginning the prosecution knew that does -- had bruises in the back of his head.
They knew we had a broken nose they had access to the full face photograph.
They knew the forensics.
They just submitted false affidavits.
And generated the media frenzy the finger of responsibility points clearly at the prosecutor.
She raised expectations.
By politically.
Indicting Zimmerman for second degree murder when there was never any basis.
And he says it was -- -- -- ship.
Arthur for hurt not to reveal some of that information to the court until after it found there was probable cause to arrest this -- and -- guy a -- -- -- I'm ahead.
Then it's to save the Dershowitz is right provided me -- that's right -- -- -- And I think he's right up basically conduit out.
I'm doing the same thing -- and she would -- which is a which is criticizing.
It really technically criticizing the way she went -- -- How much are we get there is a little -- opinion is no libel is no slander at Harvard is backing him up.
He's able to -- is an absolute defense.
-- it's only adhesive on the that was factually wrong right leg and he said she just guessed about this budget.
Then he then -- Opinion is protected he is allowed to give his opinion.
That she committed a crime and in his view IN and that is could also be a colloquial expression like it's a crime.
What she has done according to him is to -- Harvard and threaten to -- Harvard Law School try to get Alan Dershowitz disciplined by the bar association and -- to file charges against Dershowitz as well for libel and slander.
I I I agree she shouldn't do that but I can understand her frustration that explain for short more -- should have been -- that probable cause -- so we can get a more fair view of this case however it's not is out -- the obligation of the prosecutors to include everything in there and what he's saying is.
She committed perjury his explanation for perjury is that she only gave a portion of the evidence that's -- half truth -- -- truth is not a full truth so it's a lie and if you live it's perjury but if that's a stretch in an -- leading this.
Later version liberated none -- -- he he he is confident that you speak out illustrate our third argues McDowell there's Reggie gives you the case -- at this site where -- -- a partial truth is a lie he did not like he's that would love the back of the all of.
The ally and next thing you know I -- religion anyway.
Hold on 12 here so it his it's his testimony this law that says that law enforcement officers and prosecutors must include every favorable detail.
In the arrest affidavit so now what I know what to three -- -- I let it happen notes are now locked I think that we couldn't.
Erica and I doubt that the reasonable -- heart rate cut some something like that that that -- some defense of evidence that accident that the judge that they had at the end there.
Good good today.
