Friday's with a rolled a segment tonight in central Texas a 23 year old father came upon his four year old daughter.
Being molested by a 47 year old man the father beat the man -- death says he didn't mean to kill -- but obviously emotions were high and it's perfectly understandable.
Authorities are withholding names of everyone involved but the father.
Could be charged.
-- in need.
Course of him trying to rescue his daughter.
He struck the individual.
Several times.
And the individual -- -- Nine he had to remorse.
That the individual and -- I mean it.
Who was in his intent.
He was just protecting and going and doing what he thought he had to do to protect his daughter.
Here now attorney and Fox News -- world over there.
So this is not a nice story gusher in the Father's Day weekend and we can't give you the details as we don't know who these people we don't know whether this 47 year old to repeat offender that are he had done before or or you know what an -- -- we do know is.
That 99%.
Of people watching us men fathers -- done exactly the same no question I would've done it you would adopt.
He's because when you see somebody not horrific.
It costs not I mean you know you just don't say all -- stops are what you don't want us that's not what happens in real life.
So what question you as an attorney here and it starts is that a number one I don't think is going to be indicted do you agree with us.
I don't -- -- the facts are as they have been reported I do not -- somehow sympathetic Chris Perry who I do not believe but Texas grand jury will wonder okay.
And even in Illinois -- California I don't think it would indicted in Texas is this this is it actually sure.
But you know you have a line -- they call -- -- anger righteous anger.
But that's not legal concept as.
It's not a legal concept but jurors are reasonable ordinary prudent people who identify.
With someone whose story they believe -- whose account.
They can identify with in the same way that you just said that 99% of all dads would have done the same thing.
They'll be dead on that jury you know put themselves in that place and they'll say okay.
My eleven year old comes and tells me my four year old is being molested by the the 47 -- ranch and I've hired now -- -- groom these sources.
You hear your child screaming you come -- on the person you don't have a weapon in your hand.
Ironically -- he had a weapon and -- he had to stop that sexual assault shot that guy dead.
They would be no question he would not be indicted because under Texas law the concept of self defense is such that the jury is told to presume.
That you if you reasonably believed that you were stopping and aggravated sexual assault.
That is can you can't you -- -- but the difference is he didn't have a weapon ironically the fact he had no weapon.
Leaves him more legally vulnerable that he might otherwise they watch.
Because if you -- -- are now you grant that -- that some of them all this child who's screaming your child you -- mafia pull them off.
Now you've stopped the sex assault.
Now what are you doing now and -- at what point -- does does prevention of the sex assault.
Become really -- become.
The the implementation of vigilante justice.
Now the reason I believe it will not be indicted is because -- -- no one -- there's no witness there to suggest that he didn't still feel threatened that this person would turn around and get him -- bullet gun on -- are not bottom so I think that -- he'll be okay but it is ironic that -- he had a gun and he had just killed him there'd be no question today it didn't work -- work of the law.
But -- I think there's one other thing in play here and that's a motion.
And that I think that the system.
The justice system we called the justice system and a lot of times it -- the justice system.
Our right -- to take into account the emotion of what's happening.
-- it is that if you're you know your daughter.
Is being assaulted and that way.
In that way or your wife is being raped -- something horrendous.
You can't be held accountable use American citizen.
-- right for you -- reaction.
-- right if it goes over the line you can't.
It's cold extenuating.
Circumstance there's no.
No doubt that people identify with this person you have not heard one commentator as far as I know six -- -- -- 43 reporting -- -- you mentioned that we don't know.
About the 47 year old molest or the alleged molested -- let's -- she hit 23 year old we know has never been arrested he has the death simply never been cracked although his record is going.
As is the grandfather who -- the ranch.
So we know that this is a person and we also know that he has express remorse we also know that he didn't know the fellow.
That he had pummeled.
Was dead when the authorities arrived that's why the -- so sympathetic.
But I'm telling you when you suggest that 99%.
Of the -- -- in this country would do exactly that I submit that 99.9 percent of all jurors in this country.
Will agree he will not be indicted and it will be -- my -- and waste taxpayer money.
