-- Miguel what a big week -- court expected to give their ruling on.
Obamacare as early as Monday but the and certainly around position as tensions rising so what can we expect if the law is upheld.
Or ruled unconstitutional.
You know a lot of questions we don't have answers for yapping here to give us an inside at a doctor's perspective sister Donna -- -- he's the former president American Medical Association doc thanks to see you this morning welcome back the show.
Thank you very much Mike.
And -- don't think -- him he's the he's he's this guy.
-- I ask you when you look at.
The wave at the medical field is already planning on handling the Affordable Care Act in the way that they're planning on what would happen if this -- gets overturned can you pull out.
The individual mandate and still have health -- working for individuals.
What's the medical take on all of this.
Well I I don't believe that this law will work if even if it's held upheld as constitutional.
It's a flawed law who has put together -- hastily.
-- 2400 pages.
And it really is anti liberty it's a it's a law of coercion.
And so if they've ruled the individual mandate on constitutional that'll make it very difficult.
-- -- work.
In the format that they had designed so I think the whole thing will fail and I think the Supreme Court you know -- as it's one that justice -- just said.
Those who say they -- don't know and those who know don't say.
But my personal prediction is that it'll be -- 54 decision getting rid of the individual mandate and is great -- 50% chance the whole single fall down I think I Justice Kennedy if you read his previous opinions he's a strong advocate of liberty.
And I think he's gonna say the individual mandate violates liberty.
So that's your prediction 54 so -- the individual mandate.
Israelis think considering -- -- now there -- -- so individual mandate is there is ruled unconstitutional.
Isn't the individual mandate the foundation of the whole thing.
Well I think get it it it's the funding mechanism for it and I don't think -- of it it it's true it's really gonna work I mean.
People will still.
I'm not buy insurance.
Because.
They'll -- -- pay the penalty if they catch -- -- did show up.
When there Leo at the last minute and get the insurance it's a flawed mechanism.
And it it's.
You know it's there's so many easy ways to fix the problem we need to make sure that people who need medical care can get it won't -- really happy away.
Well -- what first of all we need to allow people who -- across state lines.
We need to fix a broken medical liability system that -- billions of dollars of cost we need people to own their own insurance we -- tax credits.
We need people to be able to go and voluntary purchasing cooperatives where they can choose whether they -- -- sunroof on a -- the equivalent for the health.
Program out -- health insurance as opposed to these devices that the government mandates everything I mean we're not.
That's not -- out all right document which is black.
-- -- -- that's the issue now though right is -- if you have this health care law in place -- taken away what what do you put in its standard of health care in this country.
You know is a problem this is why -- we have this in the first well.
-- -- example that millions of people with this new law being put on Medicaid Medicare is a sham.
First of all you have buck up -- -- and to -- people on Medicaid to people that need help.
They can't find specialist the majority atop let's put them on something like the federal employees health benefit program and if you wanna fix Medicaid take the people in congress and put them on Medicaid -- be fixed in a week.
But I get what they realize what's out there and they're actually on a different plan they might actually do now they're up whether it's part of that I do like and that -- you know I can keep my.
Twenty year old daughter's brought my health plan.
Yeah out well that that's that's good -- -- pre existing condition and so keep in mind that bell increased the cost in other words if you say that all cause will have -- that's not gonna come free and -- have to pay for that result there are ways to fix that so that we can.
Do whatever we want to do -- we ought to do it on a voluntary basis not coercion.
Because and I've testified on this by the way back in 1976 before the health subcommittee on ways and means to have missed the Rostenkowski was a chair of the health subcommittee and we're saying the -- government involved in Madison the -- -- and -- doctor thanks so much.
Thank you very much.
