We want to get that GL preview of this week's big decision on Obama care joining us now from his home state of Kentucky.

Is senate Republican leader Mitch McConnell and senator welcome back.

Good morning you just heard -- -- has -- Jack -- say the court has spoken it's time to move on.

-- -- -- -- -- he's doing investigate elderly tough situation.

The president said it was not -- -- the Supreme Court which has the final say it does is -- The taxes are gonna be levied 77%.

Of it.

On Americans making less than a hundred -- thousand dollars the personal with the middle class tax cut.

Attacks in -- beyond that grows and the core of the bill it's worth reminding people.

-- I happen trillion dollars in cuts to Medicare that's hospitals.

Nursing homes home health care.

And the like.

A 500.

Billion dollar tax inquiries.

The Congressional Budget Office says it is also a job killer that'll cost -- -- economy between 800000 and a million jobs.

This is the single worst piece of legislation's been -- certainly in modern times.

And it will be an issue.

A big issue in the fall election I think.

The Chief Justice basically said this is up to the American people to decide we've got one last chance here -- to defeat Obama care.

We can do that in the November election.

Now since.

That Supreme Court justice chief Justice Roberts came out with his ruling declaring that the mandate is actually -- tax.

You have been hammering the president for imposing -- -- new tax.

On the middle class but.

Mitt Romney -- a mandate in his Massachusetts Health Care Reform plan.

And the people in Massachusetts paid.

More than twenty million dollars last year in that.

Mandate penalty tax whatever you want to call it so isn't that a Romney.

Tax on the middle plot.

-- to thought -- number one that was a Massachusetts decision.

Not a national decision and number two.

Every single senate democratic.

Every democratic senator voted for Obama care.

If passed would not a vote to spare every single democratic incumbent on the ballot this November was to be deciding vote to pass this bill.

This law is deeply unpopular with the American people these generations across America will indeed be a referendum on mr.

job killing.

Health care tax increasing measure but but if it if I may sir I mean you didn't answer my direct question if the Obama mandate is eight tax on the middle class.

Isn't the Romney mandate a tax on the middle class.

Why governor Romney -- to speak for himself about what was done in Massachusetts I can tell you have that every single democratic senator.

Voted for there's tax inquiries.

And his 500.

Billion dollar cuts.

In Medicare and it will be a huge issue and point twelve mister chief justices has an effect said.

-- be decided by the American people that's why we have elections.

And we'll have won the first Tuesday in November.

-- let's move on -- if voters elect a Republican president and a Republican.

The sun and the you're top priority will be used say to repeal and replace obamacare and I want to.

To drill down in into that -- do you one of the keys to obamacare is that it will extend.

Insurance access to thirty million people who are now uninsured.

In you are replacement.

How would you provide universal call.

Well first let me -- -- single best thing we could do for the American health care system is to get rid of obamacare get rid of that.

Have a trillion dollars in Medicare cuts.

Get rid of that two trillion dollars.

In taxes in other words the single biggest step we could take in the direction of improving American healthcare is to get rid.

Of this but -- address or -- talk about repeal of the players are taught how would you provide universal coverage.

I'll get to implement.

The first -- the first step we -- tigers to get rid of what's there.

This job killing a proposal.

That has all of these cuts to existing health care providers.

Secondly.

We needed to go step botched up.

To replace it with more modest reforms that will not be -- 2700.

Page.

Republican alternative we will not take a meat -- to the American health care system we will pull out of scalpel.

And go step by step up and make the -- -- a more modest changes that would deal with the principal issue.

Which is cost things like interstate.

-- sales of health insurance right now you don't have.

Competition around the country and the selling of health insurance that's a mistake.

Things like lawsuit reform.

Billions and billions of dollars -- lost every year -- -- hospitals and doctors.

In defensive but -- respectfully so that we are -- on it but we're gonna run out of time I just when asked what specific young are you gonna do.

To provide universal coverage to the thirty million people who are uninsured.

That that is not the issue the question is how can you go step by step to improve the American health care system.

It is -- the finest health care system in the world sucks but you don't think that would thirty million what our friends on the you know when it started -- in America -- are uninsured is an issue.

Let me tell you what we're not candidate we're not gonna turn the American health care system -- to a Western European -- -- That's exactly what is that the heart of obamacare.

They want to take have the federal government take over all of American health care look the federal government can't handle health care authority got.

-- in trouble already Medicaid is in trouble already.

We need to clean up the health care the federal government already responsible for before we start.

It modestly trying to take over all of American healthcare and and -- the big step in the wrong direction -- let me ask you another question Obama care guarantee is that people.

Who have preexisting conditions and who don't currently have health insurance cannot be denied coverage because of that pre existing condition.

If you repeal.

Obamacare how will you protect those people with preexisting conditions.

They're over half the states that already have these high risk -- the deal with that issue -- kind of state innovation ought to be encouraged by the federal government.

I don't think anybody thanks to the federal government can take over this whole area all of -- health care for 300 million Americans that make it better.

We can even handle -- health care we boarding got.

That's the kind of thing that ought to be dealt with of the state level we ought to be encouraging that that but insurance companies say that they can't afford.

Two to make this deal that they're gonna take anybody and if they have a preexisting.

Condition unless they get all of those customers that millions of customers from Amanda.

That's what they use a -- managed at high risk pools or -- gross.

That's exactly what I'm -- And you're saying that that would take care of people who don't have insurance wanna get insurance but are being denied it because of a preexisting condition.

I'm saying that -- ought to be dealt with that the state level bodies state based high risk pools that over half the states believable -- to develop.

Even if you win a majority.

It in the -- chances are that that Democrats -- still gonna have enough votes to be able to conduct a filibuster and some of your Republican colleagues are adjusting.

That the way even with the Republican majority but not a filibuster proof majority that you can undo.

Obama care is through a budget.

Process called reconciliation we only need 51 votes now that is what.

The Democrats he is the 51 vote our reconciliation.

To pass obamacare would you consider using reconciliation.

To -- The -- the Chief Justice said its attacks taxes are clearly what we call irreconcilable.

That's the kind of measure that can be kind of pursued with 51 votes in the senate and -- -- the leader of the majority.

-- next year I commit to the American people that the repeal of obamacare will be job -- by the way.

I think we will also be insisting that we have a vote on obamacare again before the election.

But in terms of achieving it they would take a different senate with a different.

Majority leader and a different a president.

But yes -- to be done with a sample 51 votes and the reason I ask is because when they were passing Obama care.

Through reconciliation.

You who were very upset with that you called and secretive anti -- -- hyper partisan.

And.

Then why the difference.

Well the first time it passed the senate they didn't pass your reconciliation it got sixty votes there were sixty.

The Democrats and forty Republicans.

They were able to pass permanent.

Law.

Look reconciliation.

Is available because -- Supreme Court has now declared and attacks they have.

On -- did did the massive deception that was practiced by the president of Democrats.

Constantly denying it was attacked you heard.

The president chief of staff -- to try to deny it was attacks just this morning as the Supreme Court it that the chief justice and made it clear its attacks.

And as -- it is eligible for reconciliation -- out.

I want to ask you finally about -- chief Justice Roberts -- some conservatives are calling him a traitor for saving obamacare but some other conserve leaders are noting that.

He sharply curtailed congress' ability to use the commerce clause to regulate everything.

He sharply curtailed the federal government's ability to tell states what they have to do or punish them if they don't.

How do you read the the Roberts ruling.

Well it was deeply disappointing I think Justice Kennedy got -- right he found both individual mandate and the Medicaid mandate.

Unconstitutional.

And said clearly congress would not have passed the rest solve it without those two pillars which he found unconstitutional.

He -- Three others for problem.

Justices agreed that the whole things should be replaced.

I'm sorry that didn't happen this from the huge mistake for the country.

The Chief Justice has declared it attacks and therefore -- upheld it.

Now the American people have the final decision and I'm competent they're gonna give us the votes to repeal it and do you not see anything for conservatives and what.

Justice -- -- about the commerce clause and about the federal ability to dictate to states what they must and must not do.

Well I agree to that and of course the other four justices should -- felt that way as well.

We're gonna have to leave it there -- senator McConnell thank you so much for coming and always a pleasure to talk with -- -- we'll stay on top of -- today straight through to November.

Okay thank you.
