This is a tax increase on the middle my house.
127 billion dollars over the next ten years you know what this is -- business is a law that says if you can afford insurance.
And you choose not to buy it.
And you choose to have your health costs be a burden to -- you pay a penalty so -- he'll pay your fair share.
That's what this law says.
The bad.
That was a -- exchange -- back and forth between Chris Wallace.
On FOX News Sunday.
-- Jack lose the White House chief of staff debating the question.
That old health care mandate is that attacks or is that not attacks that's a question that's dominating the political discussion here I -- sweltering.
Lacking electricity kind of of Monday at this power play and I and -- -- -- And that's kind of the -- today that's the discussion.
About is this a tax Chief Justice John Roberts says its attacks.
What then in the majority of opinion for the court.
So you got that but you know who else that it was attacks.
-- first -- who is one of the chief strategist for Mitt Romney he said it's not attacks either he said no tax here so we're gonna talk about that how that plays out.
We're gonna talk about whether repeal is actually possible bogus talk a lot about repeal what would take -- really possible and also.
We're gonna talk about this new phase of the campaign for Mitt Romney this -- this time that he's going to be under the microscope in these long summer weeks.
As the press corps and Democrats intensify -- it's -- and it's going to be good it was gonna help us do those things.
Thank goodness.
Is Marjorie Clinton she's a former consultant to the Obama campaign and she's -- principal at -- consoles and which sounds very -- And she's of course of the blue team and gentry T Collins is friend of yours -- he is the former.
National political director for the Republican National Committee welcome back thanks for OK guys.
Let's talk to Shannon -- is -- Smart and has been covering the story.
Since she was knee high to his Supreme Court decision ms.
-- and how we don't today.
Very good -- it's always a pleasure to start my day on power play.
The Internet is just crazy -- -- you know that so and so bring us up to speed we've had a lot of back and forth and people who don't know anything about the law.
-- drifting out into some dangers waters so what's the hat.
-- We know of course in the majority opinion what you have is that you didn't get this made -- upheld by the commerce clause and necessary and proper we thought it might be done.
-- but through this taxing power and sold there is a lot of reasoning that some people find very tenuous and that's the word I'm hearing from a lot of folks -- in the majority opinion saying.
Let's end this thing is attacks until congress can do this through its taxing power it's paid through the -- arrests you know they're all these things that make it look like attacks and feel like attacks we're gonna call -- attacks.
Then the dissenters the -- conservative justices who dissented.
Had a very full throated and a lot of people very convincing.
Argument that this is not attacks but you have to think about the politics of it.
You played some and a sound -- out there we've heard from -- we've heard from Jack Lew saying.
It's not -- tax and now even from the Ronnie can't sell Republicans in they wanted to be called -- -- they think he -- and different ways legislatively to tackle if it's truly attacks.
And also the fact the president -- now have to own it and go up there and salad as dad -- Health Care Reform but it's billions hundreds of billions of dollars in taxes.
But American people -- and frankly if you don't pay and this is something the Chief Justice noted in his opinion.
If you don't file a federal income tax -- You're not -- -- subjected to this penalty slash tax.
And so there are a lot of folks out there who don't file federal income taxes so what about -- -- they skate -- Senator Graham she's Smart she is perceptive she knows -- -- stuff we thank you -- him.
I've learned everything from -- Thank you sit and have a great day it it.
Okay so here's the question let's talk about this so I was writing my power play today before.
Hear first from went on MS NB -- before I'd heard about it and don't -- that in the morning.
Bad and if they're shocked its shock -- it is it is shocking news.
About I was listening to music but I did not hear that it says that but I wrote today about -- -- Romney the details on the health law.
-- to be tricky because Romney has done this year sort of what Obama did in 2008.
Which is.
Most people back on the details yes we stipulated 59 point economic -- during the primaries the mostly mostly he's trying to be an acceptable alternative to the incumbent is his goal.
And we heard today -- from come out and he was on that have he agreed with the dissent that the governor agreed with -- -- in the case but didn't hold firm on this line.
That it's not attacks and the Republicans have been talking about it nonstop that its attacks so there's a question for both of you.
Was this trial -- from the Romney campaign it was this -- from the Romney campaign gentry it's the red teams gophers well.
I have to say it and and I will say this happily here on.
Fox program that I don't watch MSNBC in the morning even though is that I did wrong with that not that there would be anything wrong with that yeah do -- I don't see the whole thing.
I've heard I've I've read it but I have not seen it in in its entirety during its contacts.
And so I'm a little leery due to answer this question directly but I tell you this the American people -- -- -- its attacks is being collected.
By the IRS is being -- Based on the salary to -- making.
And I think all of this arguing in DC about whether it's attacks are not -- -- it was upheld as a tax people are gonna feel like this -- I think.
For political purposes we don't treat -- like one.
What say you.
Well I'm with him I actually wasn't watching it because I was here on fox this morning so confident again.
Anything wrong but those that do but I but I agree with gentry and the fact that this conversation about -- -- penalty for the tax it's sort of a waste of time no way it's the same thing one where the other eight we're going to be paying for it.
But I think we have to pay for it I mean this -- that was laid out is exactly the same.
As Mitt Romney's repeal and replace -- he -- prior to the ruling had come out with his plan.
His entire health care bill and what it would look like all of the elements -- there except the mandate which is -- -- pay for and I think Republicans and.
I'll I'll absolutely and -- that I have -- -- And Democrats alike can agree that the tenants of health care that we want is we want to make sure that the pre existing condition -- great that we want to be able to be covered no matter what.
That we value having health care period and we going to emergency room but it hasn't been good but nothing -- talked about includes an entitlement.
Well no it does actually include coverage I -- look at what happened in Massachusetts not -- -- -- okay where this exact.
Health care plan by the way it is operational.
Less than 2% of the population there is uninsured.
And he's been successful on all fronts and so it's ending and he is and he of course argues that the reason gentry that he.
That it's okay -- Massachusetts but not nationally is because it's -- -- -- and -- state you're listed as they can do to stay wants to do but I suspect that the reason that they are in a quandary on this tax question is this that if they -- the federal mandate he attacks than the mandate in Massachusetts is taxed too and they get to add some millions or maybe add -- zero.
To Mitt Romney raised taxes and they're ready have an ad campaign on that so that's why right.
I'll look I think the politics of this are easier than probably they appear on their face the fact of the matter is that this present this this president is going to be judged is going to be judged very harshly as.
Approval is inverted his below that historical mark below which no president has been reelected with about the president is not about -- run -- I think Mitt Romney.
Tries to Parse this thing out to finally to delicately -- reinforce the negatives that people are worried about.
And it and it risks bringing attention back -- the Romney campaign rather than keeping -- -- President Obama.
-- for -- the same time what we're what we're we'd be electing potentially new president for.
It's for an alternative right right so if he's not willing to lay out what the alternative would be and a workable solution that goes outside it is the type that not a tax.
But we know that Americans don't want the same thing and essentially it is health care coverage and I don't have yet to get -- And I think yeah.
Americans want their cost containment that's would have monitored -- must do what what -- -- -- 1001 point one trillion dollars in additional cost most of them focused 75% of it according to studio.
Focused on middle class middle income of families and -- murders that's.
Not at all in Oklahoma there's an Internet have a say.
Great -- says.
It's not attacks that is a constitutional.
You can't have it both ways.
And before -- -- said what he said.
And you heard what Jack -- said.
JetBlue.
That was not the finest hour for Jack -- and you saw they increasingly irritated Chris Wallace like.
We need to this question damage to golf at the same stumbles.
When he talked about what he replaces who you know well we'll get to that but.
The four at the White House is it true though that from.
-- And I know were just pointing out that it doesn't really matter but from a coherence.
Argument from that.
It can't be both constitutional and not attacks right.
Well according to what Supreme Court ruled there -- pretty big deal right exactly and so but again I think this is all.
And calling its -- calling it a penalty it's all playing politics ending this is all you know -- -- -- you can't have it both ways right you can't have.
Coverage for preexisting conditions you can't have access to health care and not pay for it and I think economists on both sides of the aisle.
Understand economics of the mandate they understand why you have to pay for health care.
And I think that's what the whole -- about it and you know a -- it and taxpayers -- you've got to pay for and I and the and so again I mean I think.
I understand it ended the debate but I had the same time I also understand as Americans we have to.
You know understand where responsibilities lie if we if we want what we want.
Martyred you know what we like you on the show -- for a lot of -- but also that you cut right to the cynical politics which is exactly what we're supposed to do -- I know that's good I get -- -- -- -- and interdependent.
-- media we don't like people who come on and talk about -- philosophy of life but how do you win elections -- what we're talking into the insiders.
So.
The question gentry is.
If your Mitt Romney.
On this issue do you pull back the balloon -- brother funds from floated today and just eat it and say.
Call it attacks Massachusetts -- zero to the total on the -- that you're running.
Or do you say -- we're gonna we're gonna stick and say it's look I think I think for -- Did you call -- -- one I think it's the best politics that's what people believe because what it is it's what it was upheld that is what.
It's how people feel when they're paying this.
-- and secondly I think Thursday there's a legislative environment is important regardless of the politics and that is.
That if it is attacks that it is not subject to filibuster after Republicans take 51 seats in the senate -- them.
