Well Scott Peterson sentenced to death for killing his wife and their unborn son.

Now appealing his conviction eight years later Peterson's attorney filing a 400 page document with California Supreme Court.

Peterson maintains his innocence and claims he never had a fair trial because of all the media hype surrounding it.

One of the biggest issues concerns of those search at the Berkeley Marina where the body of lacy Peterson was eventually found.

When a police dog picked up -- sent four days after she went missing it became some of the prosecution's strongest evidence in the case.

But the defense wanted it kept out arguing that particular dog had a dismal track record.

Both sides argued vehemently.

Prosecution saying they felt that there was scientific evidence that it should be admissible defense argued otherwise ultimately judge a lot of to go to the jury saying.

That the jury can make the determination as to the relevance in the credibility of that evidence.

Now 39 years old you can -- from his most recent mug shot that Scott Peterson is clean shaven and better than it used to be.

He leads a solitary life -- standpoint -- death row.

Prison officials say he doesn't take any classes has never held a job.

And aside from the five -- today he gets to spend outdoors he's confined to his cell where he also -- his meals.

The inmate who attracted scores of female admirers and earned the nickname -- Scotty to -- still gets some fan mail but not as much as he used -- We're told that he's well behaved gets along well with other inmates and prison staff and that he's had visits with his family and lawyers.

Shannon Peterson's appeal is expected to take months if not years to be resolved.
