In the back of the book segment tonight George Zimmerman and race.
After seventeen year old prima on -- was shot and killed by George -- many immediately jump to conclusions.
And -- -- Zimmerman.
Of being a racist.
He was.
Executed.
Put WWP.
In and made GC.
Walking while -- In a gated community.
-- and was.
-- like a rabbit doll.
He bush.
In this pretty.
He was ready should read pro.
But a new FBR report paints -- different picture the report which was based on interviews with nearly three dozen people.
Says there was no evidence Zimmerman was motivated by race when he shot -- on Martin.
So will this new information help the defense.
Joining us now from Orlando Florida criminal defense attorney Diana tennis.
And here -- studio former prosecutor.
Joey Jackson.
Miss tennis let's begin with you how relevant is the fact that.
George governments France -- he's not a racist.
Well it's extremely relevant first of all it's not just a report -- -- FBI report FBI agents are seen as professional.
More objective and are more credible to juries.
A number to be second degree murder charge past to have an element.
A strong feelings hatred -- ill will -- anger that is the basis of second degree murder and if you don't have this guy.
Profiling stalking and going after this young man because he's black.
You don't have second degree murder so I think this is a huge.
Upset for the state and I think it's going to be a real big thing for the defense.
-- Jackson now what you just heard from his tennis is second degree required is that notion of malice yes so what if that's -- case that.
You start this young -- again being black wearing a hoodie.
What's suspicious.
Could that.
Also -- them absolutely look one let's be clear this is not a federal civil rights prosecution that's predicated upon race it's a prosecution based on second degree murder.
It's not about what he's a racist it's about whether his actions that night were appropriate and if he acted with -- so I would suggest to you that although the FBI reports may -- would have helped the prosecution had they come back instead that there was some racism and his background right.
I don't think that this is -- -- now -- all and I don't think it's entirely relevant to moving forward into that establishing his case.
What he did that night that's what we're focusing on.
Was -- appropriate did he act with that type of reasonable that's what the law required the prosecution will say -- making this report I'm not back all right.
This tennis but a jury.
A jury is gonna say is this guy a racist is that what I'm really dealing with.
And I wonder now if in fact the defense and -- defense attorney if the defense is gonna say you know what there's no evidence look at the FBI report.
Well right and and and I disagree with Joey this isn't about reasonable that a second degree murder is not about acting unreasonably.
Maybe maybe you get manslaughter for reckless indifference and unreasonable -- you do not get second degree murder.
For acting unreasonably and I think the jury.
At this point it's not going to be able to hear those words that the state want somebody here profiling.
That word I think it's gonna be excised from this trial because it's no longer going to be.
Jordan Zimmerman went after this kid because he's black and I don't think the State's gonna be able to spin it that way.
As incidentally where they've got.
-- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- This tennis you know when I come back to this I come back again to the idea that you saw on those video clips you had members of congress you have this civil rights community yelling -- -- them.
And there's no -- apparently according to an impartial investigation by the FBI.
How would that affected immunity here how does that affect public perception going into the trial and jury select.
A well I think -- effects -- a lot you've got to have passion in order to have second degree murder.
And those actions are that we're talking about the racial stuff was all -- itself that led up to.
Jordan -- being on the ground on the back and having the stuffing beaten out of him if you don't have -- I'm having a reason.
To have gotten X calls the situation.
Then all you have -- sending -- I.
I'm shooting somebody who just broke his nose counselors we gotta go over thank you so much because this has got to be an ongoing conversations across the.
