Good morning this is brought by Steve King Republican from Iowa what he's threatening this lawsuit now what are his concerns.

All right what the president has basically says if you came here before age sixteen and -- being here a few years you're not gonna get deported and you can get work authorization if you're an adult.

What king is saying is essentially is that this is unconstitutional.

Because it's a violation of law we have these laws on the books and the president is essentially saying look we have lots of laws to enforce and we're gonna prioritize and anyone who falls into this category.

And there may be up to two million people in this category so these two million illegal immigrants we're gonna give a pastor we're gonna give them work authorization.

And king is saying look.

You're basically not doing what you're supposed to do in terms of the -- what -- what -- -- -- the kings making.

Legitimate.

Yeah I mean it.

It really is it is if -- president were to say.

Well look there are a lot of tax -- out there so starting tomorrow I'm gonna tell the IRS not to enforce the capital gains tax but got a lot of priorities and I really think is a bad tax anyway so it's it's consistent with my public policy position.

And we're going to do -- in the name of prioritizing.

But I think everybody recognizes that's incredibly problematic.

-- -- the president could just pick and choose the -- he wants to enforce than that and you get a kind of a breakdown in the constitutional order but he's charged with enforcing the law king king -- this case.

Very tough.

The courts have generally viewed this is kind of a political thing not as a constitutional -- what they have said is.

If you could show.

That the -- that the will -- if a law congress is effectively being entirely nullified or -- act of congress is being nullified by the president.

They -- might have what's called standing which is they then you have the right.

To -- And he can sort of argue that.

Congress has voted down the DREAM Act twice in the last two years which is essentially what the president is doing now but you're just arguing that a president cannot make a category of -- for a certain category of people.

If riot if a judge -- -- that case then why would he not when it.

He might win but it's -- standing question what the courts have generally said the remedy is not in the courts it's in congress.

To try to make the issue clear that it's not really an immigration issue it's fundamentally.
