A Fox News alert Carol chambers is the district attorney in Arapahoe County Colorado we are now hearing from her in the prosecution team -- as in the case against James Holmes -- -- it.
Provide information to we have hundreds of victims that you -- guess in this case.
And one of the ways we want to provide them information -- the media as much as we can.
Some of them.
Went back to Ohio or going back to Ohio today or other parts of the country and other parts of the world.
So we want to make sure that we can provide them.
Information in a variety of ways including through through the press that's acceptable.
He saw what happened today in court there was what's called -- rule five advisement.
Where the judge basically told the defendant what constitutional rights you can expect to have in this case.
You heard the judge say that there was a probable cause determination.
In Colorado we do an initial probable cause determination to make sure that there's kind of an overview of the of the evidence so that.
The court knows that there's enough evidence to continue to hold the defendant.
The defendant is being held without bond at this point in time eventually there will be a preliminary hearing and -- proof evidence presumption great hearing.
-- and we will ask the court to continue holding him without bond.
So are there any questions do you do you.
-- -- -- -- -- -- Did not follow what was going.
The auto.
We would have no information about that that is not something that wouldn't share I was district attorney.
-- time prosecutor.
Up from the outset of the same as though it.
Ice slam dunk case and the evidence national -- I would say there's no such thing as a slam dunk case and it is a case where we will we're still looking at the enormous amount of evidence and we would never presume that it would be slam -- we work very.
Hard on this case you -- prosecuted just like you would any other case.
I don't think that that's a case that can be made in the abstract.
They're so much that victims have to take into account and and victims will be impacted by that decision and an enormous sway for years if if the death penalty is sought that.
That's a very long process that impacts their lives.
-- years and so they will want to have and we -- want to get their input before we make any kind of decision.
That stated.
-- Was he was not arraigned today to put simply there -- the first appearance and that -- and Ramon come as much further down the line.
And -- charges on which the court found probable cause including first degree murder.
The federal all the clients in federal all of applied to.
This case what they're ultimately also -- -- federal.
Theoretically.
That down there are ways that that could happen but that's irrespective -- your.
Opponent at we're anticipating anything right now I think we have tape.
Really look more at what information -- being given and sort it all out and then make some decisions.
That's my understanding that he is being held -- -- -- -- It was my first time seeing him and it is important that we treat him as we would treat any other.
Bennett coming from the from the it.
It comes this definitely decision have to be made up within sixty days of the right.
So it is monster on the lines stale but we will over the course of those -- often with all of the victims.
Developing relationships with -- that they know who we are and they can talk you and and that we'll take some time in this case.
-- we are we are managing this all these victims with as many.
Victim advocates -- we think that we are using victim advocates from other offices.
Were using.
CIOs from different offices just so each family has somebody else that they can rely on it that you do.
But we also have a place on our website our web site is DA eighteen dot org and people can go to that website and let us know what there.
There email address is and we can send out mass email alerts to this group of victims if they want to do that.
-- I don't know if we -- cases -- young they are all important to us and we wanna give each.
And every victim the attention and each and every case the attention -- resources that it needs -- card.
-- I think that's unknown at this point in time there's the potential for many that we haven't made those decisions that.
-- We don't know that yet.
That is so unpredictable I I have would have no idea what it's -- terrorism charges.
That would not be.
Something that we would normally considered state house.
It will ultimately the decision -- the -- -- It.
But.
That's nothing we don't have a lot of information on that nothing -- -- it does anybody else on the team have anything they wanted it.
-- That is also very unpredictable if -- depend on the number of -- the availability of the court that we it will.
Nothing in the court system that is all that quickly and so.
We -- but.
At least a year I was.
Final thought.
-- -- -- -- -- -- It won't we still it's still very active ongoing investigation we're still doing subpoenas -- search warrants and so I I don't.
We're still looking at -- this -- from every angle.
Following up on information that the media has -- that that would be of interest pretty often so.
We're still very much partners with it -- department is on finding information.
Well.
Certainly know that that will be a an issue that will be brought up to support -- -- Hopes that we -- -- today set the standard color that aides suspect apparently -- players in the county jail here I would refer that to the sheriff's department.
I don't know coming rest.
And it's.
Yes it.
There are different ways that -- -- met him -- first degree murder.
One of those ways for example is after deliberations.
But it another way is extreme indifference.
And they just are two different ways and so somebody can based on the conduct involved.
Can't commit both of those offenses.
I have no information about.
-- deadline when it.
There's no it.
Specific deadline in the rules that when we can file charges in this.
Jurisdiction is traditionally after 72 hours the deputy special circumstances when we asked for longer and this is clearly one of those -- felt that the filing of charges is set for next Monday.
Next Monday morning and when -- -- -- -- That would have to be directed at the defense and that's.
Scary here now -- -- next hearing is filing of charges and that's where we give.
The defendant and read the defense attorneys the actual charges.
That he defense and it will be because there will be so many charges.
I don't think there's -- the victims' rights certainly I'm sure it's their preference to have it close to their moment where it's most convenient for them.
But all considerations will be.
-- by the court because there'll be so many charges how long do you think you'll be amending them adding removing that sort of thing what we're trying to.
You're right the first time but as we will be continuing to get more information.
It's a case like this investigation doesn't stop it it will continue up to trial.
And so as we find more information we want to make sure we've got the right.
Charges -- right I couldn't predict that but it's certainly something we're willing to do it necessary.
So that maybe one more question.
I know that.
-- -- -- -- our team is.
It's just a typical type of case to be involved in.
And I think everybody is.
Just has been working just like the police they've been working all weekend to get on what needs to get done I'm not sure they've stopped.
Consider how it's impacting them yet at this point I think.
We want to get everything we can as quickly as we can if there's anybody out there who knows anything about this who hasn't talked to police yet -- -- Contact.
At York police department or contact us will be -- touch with the right people think it.
