It's Monday night we got our first look at the suspects in the Colorado movie theater -- here today and it was quite a site.

That's apparently the Joker here do we heard about last week except the -- is green so who knows.

24 year old James Holmes looked dazed and disturbed like he might doze off at any minute.

Somebody in the -- reportedly told him you know tough guy now.

Holmes is accused of killing twelve people and wounding almost sixty in the theater in Aurora Colorado after today's colorful court appearance prosecutors said.

They don't know whether Holmes is taking medication.

Today -- family spoke out through a lawyer.

And the family wants to -- reiterate what their hearts flat to the victims and their families.

The home Stanley would like to maintain her privacy.

I'm so at this time we will not be discussing it James.

Or his relationship to the family.

And we would respect.

Courtesy and that.

A reporter asked whether the family stands by Holmes the lawyers said yes they do -- their son.

We have team fox coverage.

How we live at the theater with new details about the shooting in the investigation.

First let's get to Mike Tobin -- live at the courthouse tonight Centennial, Colorado -- Mike Holmes didn't say one word in court -- -- You know it is easy to talk to anyone not even his lawyers and you can't escape his appearance the way he would stretch his eyes wide open -- seem like he was drifting off to sleep and that prompted a lot of questions about whether he had -- -- dated in jail we got no answer with all of the answer unanswered questions.

The district attorney Carol chambers says we are just at the beginning of all this.

I would say there's no such thing.

As a slam dunk case -- it is a case where we will we're still looking at the enormous amount of evidence and we would never presume that it would be slam -- we will work very.

Hard on this case to.

-- prosecuted just like we would any other case.

Now the death penalty is an option that chambers is leaving on the table but first she says.

She wants to speak to the victims' families and explain to them that the death penalty is not necessarily -- easiest option for them.

Then she'll make a decision she's got sixty days after the arraignment to make a decision that hasn't happened yet yet so where's the suspect tonight -- He is in the pink and white building you see over my shoulder that's the arapahoe county jail he's being held without bond.

He is not formally charged yet he's being held on probable cause for first degree murder and he's all alone.

That's my understanding that he is being held in isolation.

It was my first time seeing him it is important that we treat him as we would treat any other defendant coming for the privilege -- that's.

The players in this case are clamping down on the information the government started sealing documents last Friday the defense today was granted a pretrial publicity.

Motion.

Essentially that amounts -- a gag order jab Mike Tobin at the courthouse Centennial, Colorado this -- and we'll police say.
