As well as seeing some of the victims and family members who -- in there as well and there were additional.
Counts charged against him can we go over those first.
Yet they charged him with.
One additional count a sentence enhancement for inciting violence and -- one -- counts of possession of explosive devices.
And explosive devices that would be for would be the second seen his apartment which was as we know is police say.
Was -- loaded head to sealing steal ceiling to floor with explosives ready to go ready to blow as soon as someone opened the door there.

At the beginning of the hearing -- -- some of them some of -- crying a little bit most of them -- staring straight ahead very solemn looking.
Some -- sunglasses on as some have their hands in their you know their heads in their hands.
We couldn't see a lot of interaction as far as them looking at him some of them are looking at him during the hearing.
But they they did in general look very -- most of them stared straight ahead and and some of them were crying.
Was there any discussion -- by judge William Sylvester over what happens next what's the next step.
They they set a whole bunch of dates that are gonna come out for a lot of different things a week from now August ninth.
In the afternoon they're going to talk about the unsealing of the of the records.
Are the unsealing of the documents I should say -- -- -- gonna get a status hearing on the privilege argument relating to the notebook and then that.
On August 16 will be at a hearing on the privilege of -- -- the prosecution also agreed to get all the information to the defense.
Regarding some of these surveillance tapes and that sort of thing that they wanted to see regarding the package and and document sent.
Okay and -- we can kind of sort some of that out there were two other motions that judge Sylvester was actually hearing today.
One motion that was Aggies sent by -- sent by the defense on Friday and of their request was to have all of the information specifically this packet that so many of us have heard about the James homes according to court documents was sent.
To his psychiatrist doctor linked fence in before the shooting now according to the court documents doctor Fenton.

I'm homes doctor his psychiatrist and so they considered this to be privileged information and some of the reporting the Fox News is done was that this package contained in notebook.

And there was a lot of complaint by the defense.
That this was leaked to the media they charge that there were people and it is part of the governor me meaning the FBI the cops that -- specifically -- this to the media.
They wanted that stopped and they wanted that.
I'm given to them so that's something that did the judge is going to address additionally the media had requested on behalf of the public that there were some.
Documents that they were to be unsealed on behalf of the public that is something we still don't know if it's gonna have a specifically but it sounds like we will know in the coming weeks.
Jenna back to at least they're really quick here the defense -- -- have to enter a plea at this time so that they don't have to say what you know they're pleading not guilty or.

Right this was not a day for James -- to enter a plea and let me get one thing -- -- -- here from Jennifer.
Did James Holmes say anything did he have to answer any questions or anything like that.
He did not they they did wave they have a right to preliminary hearing in 35 days.
They had to ask him if he was OK with waiting that's and his attorneys briefly spoke to him he nodded -- send and then indicated to them that he was OK with that.
And so than they -- back but that he didn't actually speak he didn't say any.
