On the Drew Peterson saga moving into the courtroom today the murder case against the ex cop -- See -- keep losing his wives.

Finally going to trial Peterson charged with the murder of his third wife Kathleen savvy investigators first ruled her death -- accidental drowning.

In an empty bathtub where their hair soaked in blood Peterson's attorney claims that he's innocent.

How can you accuse somebody and hold them in jail for three years pretrial.

On anybody not just mr.

Peterson and anybody in jail when you can't -- what hit what the evidence is actually necessary.

And there was an act or perpetrate or in a victim in the same place at the same time.

I just boggles my mind.

Judge Janine -- former district attorney and now hosted justice with judge dean joins us now from the scene with some more -- how you doing this morning.

Bob Brady Heather I'm standing right in front of the courthouse and I just came out of the courtroom.

Where -- the defense had asked the judge to make certain rulings before the jury was brought in.

And what we know for sure now is that no statement from Kathleen savvy -- the victim in this murder case.

Will be brought before the jury if it's only relating her fears.

It's only if she says -- said X wires see that's going to be allowed in.

The prosecution will be allowed to refer to the crime scene -- crime scene at that stage crime scene.

And so now advice -- the jury is coming in the judge will instruct them on the instructions.

And the prosecution will begin opening statements.

The real issue in this case of course is the physical evidence or lack of physical evidence if you believe the defense it is a circumstantial case.

The issue of course Kathleen is dead what she what she a victim of an accident or the victim of -- homicide.

That is the issue for this jury to determine -- and you mentioned the jurors coming in what do we know about the jurors judge.

Well what we do know is that several.

Of them watch.

Crime some type movies they read crime novels.

And of course in this CSI generation that we have people are more in tune with a lot of these kinds of shows.

One of them is as youngest want -- you we have seven men five women.

And of course this is a case that will be decided based on common sense.

Since there is no confession there is no eyewitness this jury will have to bring together.

All of the information that they hear it they will have to believe beyond a reasonable doubt that she was a victim.

Of a homicide.

An accident staged as an accident or murder staged and that as an accident.

In order for them to return a verdict of guilty but here we are eight years after Kathleen savvy -- -- And we are finally getting to the point where a jury will decide and Kathleen savvy -- and her family.

We'll have their day in court so lack of evidence when -- deals specifically with Kathleen savvy and it also.

A lack of a fourth wife two discs disappeared how they gonna do with that Stacy Peterson.

Well you know it's a great question -- Heather it's like the 800 pound gorilla in the room everybody knows.

That Stacy Peterson is gone and apparently the reference it's going to be -- that she is on available.

But there was a hearing where it was decided that certain statements that she made.

Regarding what drew told her.

Might be admissible depending upon what the judge judge for -- in this case decide.

So there was a lot of back and forth this morning between the lawyers as to what the prosecution didn't say because a lot of the evidence admissibility.

Has yet to be decided.

But make no mistake there's going to be a real battle in that courtroom.

I you've got a very energize the fans you've got a very experienced prosecution and the judge.

Is someone who spend a prosecutor a defense attorney and a judge a very experienced judge so which should be a very interesting trial.
