The Tucson shooting suspect is expected to enter -- guilty plea in court later today Jared Loughner.

Accused of killing six people last year and then injuring thirteen others including congresswoman Gabby Giffords prosecutors -- make the case.

That lautner is now mentally competent to stand trial.

Criminal defense attorney and former prosecutor -- Jackson joins us with more hi Joey it doesn't happen that often that somebody takes guilty plea Wyatt why's this happening.

Well you know what happens in federal cases it does believe it or not over 90% of the time people pleading guilty in federal offenses are they taking some kind of guilty plea because -- -- message is so steep.

You know for both sides and when you talk about it a guilty plea of guilty of plea discussions.

They are risks to both point what are those risks well from a prosecution's perspective the prosecution ultimately can go to trial.

And what can happen.

This person could actually be found not guilty by reason of insanity it can happen we sort happened back in the Ronald Reagan years how can they don't want that to occur.

There is a big question here because Trent Lott.

Is he competent to make this side guilty -- you know have a today's.

Court appearance will make that determination that'll be what's at issue here but I think we'll find that he is going to be competent and here's why.

Both sides now that the prosecution and the defense are saying that he's competent at this point why the attorneys don't know but they rely upon the professionals the psychiatrist and remember the last year and a half he's been getting this medication you indicated previously has been forced to get medication.

And as a result of that they're saying he's improving to the point where he understands the nature of the proceedings and what he's facing and ten assists to his defense so I think we'll see after hearing a psychiatrist testified to this effect.

And it'll be up to a judge to make that the well that's the big question that the judges don't always agree with the prosecution and the defense the judge may not agree here it's true but there's reason to believe had -- that the judge -- why because you have both parties on the same page and more importantly you have the professional who's been treating and it's not only did -- -- -- -- a number of psychiatrists -- been a valuation him but one -- anticipated at least want to testify.

Asked his confidence after the fact he's been taken recycled truck tropic pills he's been getting better and understand what's so all this goes smoothly he copped a guilty -- what happens that life in prison I yes indeed and that's what you know we talked earlier about what the Red Sox from a defense perspective what they wanna do -- is -- his life and so from a defense perspective you can mitigate and save a person's like it's huge -- get life in -- And that of course is you know a significant punishment and lastly the Colorado shootings they will be closely watching that's what -- they -- what can they take away from what's happened you better believe it I think -- so many parallels -- because if you look at the nature of the person who actually engage in this -- -- a person who would have claimed insanity -- the -- move forward a person who had to be competent deemed competent in order to even take -- play so I think if you look at the parallels certainly they will be watching yes Joey Jackson thank you so much snow on opening comments --
