He can't get around that it's a fact on the day and the Democrats say well that's not true and they -- refer back to the Ryan budget in the house.

Eliminate those cuts although Ryan says it actually he let his budget would have spent -- gone back in the Medicare trust fund that -- that doesn't make any difference.

Romney the Romney plan which is -- the one for the campaign now would.

Get rid of obamacare entirely including.

The money from Medicare it would go back to Medicare so.

That's what the fights over and it's odd thing I've ever -- -- long time I have never seen Republicans on offense on Medicare before.

So what do you make of that because obviously the minute that that -- picked Paul Ryan folks that it's gonna change the conversation you -- -- -- know they're gonna talk about that budget -- -- passed in the house.

Do you think it's a plus or minus for them because it seems like this point so much of the campaign has been about personalities and personal attacks and negative attack -- this is really an issue oriented discussion now it is.

It is an -- and I do think it's a plus for Republicans because the natural.

-- of voters is that they could you ask when you see this poll after poll.

Shannon and that is he -- people who's better for protecting.

The Medicare.

And Democrats always come out ahead well this tries to reverse that.

And it and put Republicans in the lead in protecting.

None Medicare and Republicans will be satisfied if they can just have a draw on this issue they just like not I'm not to be enough room.

The Medicare to be a loser for them again.

What do you make of the conventional wisdom that you shouldn't talk about Medicare you're trying to win an elected office that.

Americans are ready for the conversation inning but the latest estimates show in twelve years it's bankrupt anyway so -- do you think Americans are getting net and they are willing to have this talk about.

-- prices and not for people who currently on -- you know nobody over fifty that would be affected by the current plans.

That -- as proposed in his budget.

What do you make I think it's gonna.

That those supporting the Democrats seem to suggest that if -- let the Republicans they're going to take things away from you you know whether it's Medicaid or.

But the benefits contraception whatever it is that's going to be the party that takes away from you how many Republicans.

Well it's certainly one that helps Republicans in the Hudson Wisconsin Tommy Thompson the former governor.

And there's a lot of polling in this race in the primaries it was three strong Republican candidates and and -- -- the best against the Democrat Tammy Baldwin a congresswoman from Madison.

Nine and Republicans and most -- that I talk to hope Tommy Thompson would when he didn't win by much he only got about a third of the vote little more.

But he's the strongest candidate.

And so this gives Republicans a golden opportunity they can win them I think they have.

A better than 5050 chance of winning that Wisconsin -- And that will help offset things like a Maine where they will probably lose a seat and maybe in Massachusetts to where Scott Brown's.

Running for reelection in that's a very democratic state and in Florida you know -- is going to be tough because.

Connie -- A good candidate that.

You know I'm not I'm not sure yeah really confident about low -- again.

And Connecticut is just to democratic -- -- Linda McMahon.

Did very well 13 to one in the in the primaries got a lot of money but.

She had a lot of money in 2010.

-- were wounded when it was an open seat it's an open seat again.

She didn't win then that was a better Republican year hard to imagine that she's gonna win in -- less.

Strong Republican year.

It down ticket impact can it be of the -- -- we have the White House this time around.

I think it's gonna be a victim didn't impact because you can think of state after state where the -- if Romney wins and and wins.

But more than just a tiny moon no margin for Dennis senate generally -- -- will win and I live in Virginia.

And and there are -- George challenger Republican running.

A for an open seating is -- very strong Democrat Tim -- he needs Romney to win.

And it's probably also true in Florida that that Connie Mac can't win unless Romney wins that state so I think we're gonna see some coattails.

Massachusetts you mentioned that -- -- -- it's been very ugly it's been very close and -- heated do you think there's a chance Scott Brown holds onto that seat.

Do you think that voters are going to be.

Is swayed away from Elisabeth born in some way because of some of the -- -- you know -- and you know getting to this point.

Well I think that's already -- her from opening -- the lead against Scott Brown has a problem for Scott Brown.

They're going to be 600000.

More voters.

The voting this in November in Massachusetts and voted in January.

Of 2010 when he was first elected in the special election remember Teddy -- season.

And almost all of those -- going to be Democrats and so he's gonna have to get a good chunk of those and and so far the polling shows he's holding together -- -- -- coalition he had back in 2010 of Republicans not many in Massachusetts but independents and some Democrats.

It's going to be hard to get with those 600000 more Democrats coming -- to get there might say he has been less than 5050 chance but maybe only a little less.

Yeah we've been playing very interesting story there to about this state treasury officials sending out.

Notices to welfare recipients of about voting rights and those kinds of cities and whether it was that weren't starters involved -- that so.

Well I started back zero child in east Texas what we're gonna factor was fortunate to follow my father and most among locals are cousins and to a tire factory in east Texas and it was there that I joined the union was -- -- workers union and nine years later became the youngest and the only Latino political director for major union in North America.

Did that -- fourteen years and read a lot of campaigns in the meantime comment now -- solidarity strategies here in DC a minority owned union and political consultant for.

All right excellent where we -- glad to have you both and I want to have you weigh in check if you would start.

Your reaction to -- accusations from both campaigns -- for folks outside the campaigns that.

We've reached a new level in 2012 of some nasty.

Political back and forth.

Well that's kind of I hate to say this but that is the way the game is played I've been doing campaigns for 23 years and negative ads do work but I will say this that.

This may be.

Some of the nasty is ads on both sides earlier than other person.

Nothing gets a culmination of having unlimited money and having lots of resources from outside groups and the campaigns trying to highlight the differences.

Between the candidates -- issues but if you're on your couch at home watching it seems pretty -- on both sides.

It does seem ugly but I've just been reading a book about the 1948 campaign and the things that Harry Truman said very successfully great campaign for reelection and his -- and and you know but we've seen this before I think there's one of the one concern you have about.

-- negative ads and I couldn't agree more -- there's a reason why there's somebody on the generally work and and another bit and is serving -- -- needs to respond to them.

But accuracy is something you can require you can challenge accuracy -- own.

You know this is the place later this is the way campaigns are now but if somebody -- the matter ended in an accusation -- -- -- and challenge it on those grounds and and you know the one thing well while he's been complaining and and and the other side complains as well at least they aren't asking for apologies I mean that's ridiculous I think.

-- you really got to that looked I would guess that that stuff is will be.

-- -- we check in now with our very own Catherine here she is gonna bring us up to date on something that is going to put it into -- today it's very important.

Will it become part of the cut conversation about the campaign and that Latino voters in this country let's have to -- about this new program Katherine.

My shin and good morning we'll today's the first -- -- about one point eight million.

-- document immigrants in this country are able to go to Homeland Security.

Fill -- -- caught a break here this six page form it's -- some very basic questions.

Provide some very basic documentation.

About how long they've been in the country and whether -- I've gone to high school or they're in school at this time.

And if they're able to meet these very basic requirements they're able to deferred deportation.

For at least two years but the expectation.

Is that they will be able to remain in this country.

-- definitely an earlier today I spoke with a former Justice Department official who said to me.

That one of the big issues here is going to be.

The policing of the documents and the possibility.

Of real fraud because as you know there is snow.

Uniform standard for educational records rate Salt Lake if there's any standard for driver's licenses -- there's no standard for educational records.

And that the potential for abuse of this is extremely high and especially given how high the stakes are the these individuals would be allowed to stay at least for two more years.

And potentially for even longer she and it.

Our let's talk about our guests now -- The president took a lot of heat earlier this year from groups that says bankruptcy didn't get accomplished what we had hoped she would I mean there's so many things that didn't get done.

This change this new policy here is it -- -- election year politics or something the president was gonna do along.

-- the president acted because the congress did not act and the keys -- -- pure political terms none of this one point eight million people.

That you were talking about.

Can vote right but it is politically important right so these are immigrants who came here's children have to be under thirty years old most of -- -- -- -- very young children.

All of them pledge allegiance to one -- their entire lives.

Most of them can't speak the language from their home countries because they were brought here and no fault of their own they've been our public schools have been educated and our universities and they wanna be a part of the fabric of America paying taxes and being apart the the president acted because of congress wouldn't and I think it's a really good day.

We're a nation of immigrants who all came here at some point in our history are -- and I think these young people who play by the rules.

They have no criminal background and they want to do what's right it's a good day I think for all over.

Different how does the administration sell -- you Americans in 23 million of them are out of work and to say we're not I'll allow another class cent to join.

The pool of workers available here in the United States how does the administration -- backside -- this come.

That's really -- -- -- that I haven't heard anybody complain about about these.

Immigrants.

On him -- being able to work.

But maybe we'll hear more about that I think Republicans would be to be on tonight's -- they started complaining about what I would add two things to what chuck said.

One.

And I think this was done purely for political reasons might happen anyway and the fact is that there was a vague compromise that Clinton didn't reach.

You know with Marco Rubio the senator from Florida on Capitol Hill and Democrats didn't want to do it.

And there's a second question of whether the president has the constitutional power to really authority to rewrite a piece of legislation.

I don't think he does he's -- hadn't done it anyway and in that it's happening today whether Republicans and it constitutional is like it or not.

And the thing to remember and Republicans often don't remember is.

Almost all the immigrants come here because they wannabe Americans they wanted to do that that they want freedom they wanna decide to own destiny in life they want jobs and so on.

And it and I think some conservatives and Republicans forget that.

Tech T think that congress will come together and -- appetite in the near future sue me you know tackle overhaul you know immigration reform.

I hope so I'll take you back two years ago when it passed the house and it went to the senate where it about a lonely debt that had 50000 to support but it was filibustered -- we did not have -- I think the outcome of this election -- determine a lot of -- and thinking about it just political -- let's think about the Latino voters.

Thing about my family I was born here in America in east Texas my father born in Texas my grandfather came here's an immigrant is immigration my number one issue driving to vote no jobs and economy is as it is -- most Latinos but the immigration what I tell voters not Filipinos is that it's a matter of the heart with.

What are with us not a matter of our -- our minds as we -- those jobs but we know we've heard stories about somebody in our -- emigrating here for a better -- because they wanna be Americans so I think that's how it does -- very political.

It makes a big difference whether Romney gets 30% of the Latino vote of forty -- and -- 40% as bush did in 2004 up.

I think a high water mark for Republicans and this -- Planet is being implemented today will not help Romney to get 40%.

Who gets to vote whether you need an idea vote we'll update you -- -- there are some breaking news and one of the key lawsuits this morning some -- around with that power play.

Who can vote when he can vote -- -- need an ID.

Let's check in now deceased it's funny because he's got an update about what -- the biggest most prominent lawsuits in Ohio involving extra voting days for the military what's going on Steve.

Well that's right -- it was for everybody but the military got an exclusion under the new rules in Ohio and the Obama administration is challenging that in a lawsuit filed.

In the federal courts in Ohio and went to court today for the first time in Columbus and it is the first lawsuit of its kind for this election cycle.

So here's the background on this just -- it all out.

The Ohio legislator -- legislature voted last year to limit the last minute voting in person that is the last three days leading up to Election Day.

That Saturday Sunday and Monday before Election Day to cut that off to everybody except to veterans.

-- the Obama administration once that period open to everybody 93000.

Ohio voters cast their ballots during that three day timeframe in 2008.

And the Obama team believes this new law unfairly restricts voting.

The lawsuit in -- as thousands of people may not be able to exercise their right to vote unless the court takes action.

Of course Ohio as a key battleground state -- where Obama won last time around were Mitt Romney hopes to turn the tide this time.

So far Obama leads by a six point margin.

Now of course the Obama team also thinks -- last minute voters are more likely to be Democrats and that allowing veterans only to vote.

In that last three day time period benefits Mitt Romney since veterans tend to be Republicans.

Romney has cast this is an anti veteran move by Obama but the president's campaign vehemently denying that.

Saying they don't wanna cut out veterans -- -- the opposite they want everybody to be able to vote during that.

Last minute a window of three days before the election so.

It went to the court today that judges considering.

-- emotions and they're just getting organized we look keep you updated on exactly.

How that progresses through courts.

I -- as a lawyer I think that there's a very legitimate legal argument going on here.

Com but James how the optics of this for the Obama campaign at least sit in today's Sony doesn't read the lawsuit it really knows -- and -- -- that -- it to sound like you're going after military voters.

-- what are the optics.

The optics -- -- -- image because if you don't understand me.

You know which direction this is moving that -- there beer excluding other people rather than including veterans and it looks bad and looks like -- the administration is against veterans it is an opposition take.

And obviously the reason -- -- against veterans.

Would be.

You because they're you know there are disproportionately Republican voting -- let me fantasy novels happenings in this matter whether they get their message out.

And of course spread -- Ohio is a very important state I mean adding is this a little bit of a risky strategy for the campaign to go laughter.

You know what is probably appear.

You know equal protection issue.

But it at least you know from piercing of yeah well again I -- yet again -- together choice.

I mean -- they would do this and in other states in the other issues it would only affect you know the tens of thousands of voters rather than hundreds of thousands or millions and if I were they about a campaign ideas didn't exactly the same thing I don't think they'll be much about -- PR stayed on this and then -- and they -- win.

Okay also today this morning we saw that a judge in Pennsylvania has basically ruled that.

These states -- right below which version to show certain -- idea when he comes to vote.

That's going to be upheld of course I do expect that to be appealed but for now injunctions not gonna be granted so you're gonna -- -- your Pennsylvania -- with ID.

And we -- this on the heels to bring you -- from the Washington Post.

Where folks were asked -- you know in your view should voters in the US be required to show official government based photo identification like a driver's license -- -- cast ballots on Election Day.

73%.

Of Americans said yes and yet the DOJ in a number of groups are suing over these voter ID laws James.

Do you think it back -- -- again is -- the same kind of strategy just knowing that they need to do the best -- -- this.

Any sort of strategy -- the problem is is the sort of people who don't have ID harder to do it again Missouri people who tend to vote democratic -- There are older they're less educated their poor.

-- him frankly most of us have ID cards right and millions I don't know how you conduct as were normal.

For middle class lifestyle -- that -- -- ID card.

But there is a -- -- has decided that that managed to do just that end the offensive -- vote which is not that strong frankly but they're they've -- more likely to vote democratic so let's.

From a justice Shearer who knows -- others -- -- -- -- do that.

Not in -- -- know that there are numerous days that they're worried about some of those arguments have yields and will get you to the place to register will pay for the ID.

I U does that negate some of the arguments -- the DOJ.

Well I think it does and it of course the Supreme Court has upheld at least in theory.

We've got the requirement that you show some real ID some government ID.

So that puts.

Democrats who are challenging these laws that in the Justice Department under President Obama at a disadvantage.

And I would say one other thing you know there is a fundamental difference between the parties on this Republicans -- -- can -- many many examples of voter fraud.

It Democrats think well the -- is a tiny bit but does.

No I'm not much had to do this extreme thing -- requiring ID.

Is way too much and we'll actually disenfranchise voters but there is a strong.

-- strong disagreement here.

Yes indeed some of the Democrats in and officials have to call this essentially -- poll tax writing you're gonna be able to convince though the American public we see 74% of them say I don't care what the deal is you need an ID to vote.

No I don't think it's a winning political issue because it just seems that the number again just common sense standpoint well you have to have an ID card to do just anything to encourage you have to show ID card to get into an.

Larry but.

Yeah I mean.

-- -- -- -- -- there isn't a whole lot of low voter fraud almost no voter fraud of the sort that you -- prevent an ID most of the voter fraud is frankly absentee ballot ballot issues that sides registration fraud that sort of thing.

And I think are really doesn't do anything about that but the but from images from political argument standpoint it's really powerful improved from Republicans on.

That kind of work I -- -- I agree in the -- it is going to be some voter fraud in the arguments over how much indeed and most of it comes in.

Absentee ballots.
