Now a published report that suggests a conspiracy theory between the DOJ joining a lawsuit in an angry tweet from the president's top campaign advisor.

Back in April cheap Obama campaign advisor David Axelrod tweeted that a Gallup poll showing governor Romney had a the president was flawed in the way it -- being conducted.

Gallup executives suggested and a series of internal emails that axle rod was quote trying to work the -- and the charge was politically motivated.

Passport a couple of months in the deal.

And now some are suggesting the two are somehow connected is that there.

Here now attorney -- label and GOP pollster and former executive director of the Texas Republican Party Chris will -- thank you both for joining us.

Question -- -- I wanna start with you I mean how often is it that people who don't like poll numbers I -- me you know from somewhere as important as a presidential campaign.

-- reach out and you know publicly denigrate a poll in its methodology in -- way that it was conducted.

Well I don't think the public and aggression the -- is what's all that surprising that does happen regularly anytime -- -- like polling numbers are trying to there's something all of the methodology.

The problem here is the way they went about doing it -- and it really contacted -- past and change your methodology when they didn't in the DOJ -- joins -- lawsuit.

And I think what it shows us how quickly but the bombing is willing to jump to the Chicago style politics -- -- -- most fundamental and treasure freedoms.

And go after an organization like Gallup which made a mistake albums -- the oldest most respected most trusted -- and organizations in America.

And they really are part of the media and so what -- -- campaign is trying to do here is influence the media by using department of justice and it's a very frightening thing for all of.

Us -- -- -- -- flesh this out a little bit more because this comes to us from the daily caller and it in there the want to say that they have email showing that the Gallup people a lot at least thought that there was some kind of political motivation.

At one point they say that David Axelrod -- suggested that one of their pollsters go over and discuss with the White House how they're methodology had worked to go and basically defended.

I -- this DOJ lawsuit they've joined a lawsuit that started a couple of years ago from somebody who used to work at Gallup.

But it turns out that person was also an organizer for the Obama campaign in Iowa.

-- it trying too much of a link to say that these two things go together is it just a coincidence.

-- not at all and I think the -- -- the -- -- right now as a legal consultant to work some magic to get them out of this mess.

Because clearly on the surface of this it looks like mr.

-- he worked for mr.

Obama in 2008.

In this campaign.

Obama is -- elected he goes to Gallup works for Gallup for a year or so.

And it mysteriously either quits or is fired I don't know which one.

And then shortly after that he fired -- in finals these allegations against the Gallup poll under seal and sues them right.

Fast forward now almost three years later the DOG investigated it.

DOJ investigator for a year and a half didn't do anything about it and now two months before the election.

The DOJ is gonna jump on board with this lawsuit.

Clearly it gives the perception.

That the DOJ is using this lawsuit as a pretext to bully.

And intimidate -- to come up with more favorable numbers.

For -- -- Obama it's really terrible.

Chris so Robert -- by the way he says that he doesn't know anything about any communication between the campaign and gala.

And so we have to take that work from him that he didn't know that there would be anything -- any discussions going on between -- the two of them.

And wouldn't make sense if this one is politically motivated the DOJ getting involved in this lawsuit wouldn't make sense to do that two months before.

-- a couple of months say if we count back a little bit on this lawsuit is not actually been filed yet.

That they are the -- involvement and it but wouldn't make sense for them now to go after -- when they need those poll numbers to be accurate and if they're good for the president to look led.

Going into an election sixty days out.

What it does there's a winner mentality -- created a -- Gallup shows that Obama is losing they can be discouraging the Democrats together situation exists like existence when he can we had on Democrats didn't turn out to vote.

Because they didn't believe that -- candidates had a chance of winning and -- makes perfect sense I think the timing is exactly suspect.

In the fact that it was two months after that -- that axle -- went after Gallup made these comments one of them called the White House discussed methodology.

And think for a second if you replace the word gallop with New York Times the Washington Post in the end is it replaced Paul.

With newspaper -- news report imagine the outcry every journalist in America and I think it's a shame that no one else jumped on top of the ship because it is such an amazing story.

About how quickly our fundamental freedoms that -- -- of the -- press.

Can be threatened just because the game long -- and doesn't like -- coming out which in this case just simply poll numbers well.

Chris since you've been a pollster I want to ask you have you had a chance to look at any of these numbers the methodology what what we know about gallop in its track record.

Oh absolutely a Gallup organization's -- as the oldest pollster -- America.

They are there track -- impeccable they are they are good meticulous in the way that they sample.

Likely voters they moved from -- registered voters will likely voter sample that you really cannot argue with the work they've done over the years because they haven't you updated it over time.

They have AS suffered at the seven or nine steps for your process to make sure they are talking to a voter.

It really to question their numbers I think is actually ridiculous here and they're sort of the gold standard in our industry.

And the involved mistress and just like the fact that their numbers are the ones showing that Romney has the lead.

Where a lot of the democratic numbers that are being released actually show Obama with a lead I'd say they want to question anyone -- -- the numbers coming -- -- -- Obama.

Ahead Brian we've reached out to both the White House and DOJ have not had comment from down yet but again as a note Robert Gibbs says he doesn't know about any discussion between.

The campaign and and -- up.

The where do we leave this at this point -- this was an existing lawsuit the DOJ it's on related they got involved.

Where we leave it.

-- personal isn't horrible timing for President Obama to do this last night on it and on his speech he talked about.

Every American having a fair playing field having a fair opportunity to have success in -- have a good job and to provide for their families here now to monster board election.

You have what appears to be on the service an unfair playing field being created in favor of President Obama and it's just it's it's just a terrible.

PR strategy the DOJ Shannon.

Investigated this back in 2009.

Year and a half went by the Gallup poll came in and ask for -- nothing happened now all of a sudden.

You're gonna join in a lawsuit I think it's bogus it's a bully tactic they need to withdraw from this lawsuit and let the process play out.

Our -- Chris we thank you both for your time if we do hear from the campaign from the -- for the White House.

We certainly want to hear their side of the story ensure that Megan will bring that -- you love folks out there.

What America live everyday if we get -- it.
