All right we're just minutes away from a deadline showdown in DC -- Easter dot.

That is on Republican congress and our allies is threatening to subpoena the administration -- it does not hand over documents on its eight billion dollar Medicare bonus program.

Congressman says -- the program is being used to cover the real cost of the health care law and perhaps by the election.

Did the department need to deadline let's ask the chairman of the house oversight and Government Reform Committee who joins us right now any reaction any any answer.

Well -- I flew back here to be here for the discovery that we expected to -- just a few moments ago.

I got reams of paper that looks like this if you can see it.

Basically somebody hit a button and said print -- a bunch of -- -- in an illegible format.

And delivered it so sadly.

Clearly they could -- give it to his digitally and they're not promising to give us anything more until the end of October so we will be issuing the subpoena.

In order to have to make it clear that the compliance according to the rules that have long been set up for discovery need to happen.

Well what -- -- -- tell us what you fear or what you're you want proof is is is not happening.

Well first of all let me explain that these funds are not funds that congress appropriated.

In other words this special project is going to backfill.

Hundreds of billions of dollars a year worth of what the Obama care took out of Medicare.

Is in fact they had a little ploy to get around appropriations and get around admitting that obamacare is.

So as a result this is not something congress actually appropriated this is something that was envisioned for small projects where they couldn't come to congress but they wanted to do these test.

This is larger than every test they've ever done it -- -- just combined.

It is clearly a nine billion dollar eight billion dollar.

Back way door way of spending money but more importantly what we ask them for five months ago back in May.

Was how did you make this decision what was the procedure what justifies basically having a national test in order to test something.

And only today only on the threat of subpoena did they deliver us a lot of paper hundreds and actually thousands of pages.

Of simply sort of like how how well it is.

Hide the real costs.

Of health care not how does it what what does it do to do that.

What they're essentially saying is as a test we're going to fund what obamacare took away it's that simple act you're gonna see.

Dollars going in that almost equal what was taken away and remember obamacare was supposed to be not tax costing.

But my back filling in this if you just -- it is this money coming from.

That's the interesting thing congress authorizes this as if you will on appropriated funds and that can be can be spent to run these -- this is supposed to be about a test of efficiency.

And that's what the amazing thing is obamacare said these programs are -- and now they're doing -- -- that essentially refunds up.

It's it's an unbelievable abuse of power and abuse of a law that congress put there.

In order for agencies to have freedom to do some test but they never envisioned hundreds of billions of dollars a year nationally.

In order -- -- test this test could have been done in one small part of the country if it was an authentic test it's not a test.

It's very clearly a way to -- Be able to say we took care of the seniors well in fact.

Spending money that was never appropriated.

Okay congress and I keep us posted by the way I waited as it -- detect with the department we've not heard.

That -- mentally and it.
