We're here today to announce that.

New criminal charges -- have been filed against three former top administrators at Penn state university.

As a result of the ongoing investigation.

Into sexual assaults committed by Jerry sandusky.

On the campus of Penn State.

You would call that Gary Shultz the former senior vice president for finance and business at Penn State.

And Timothy Curley to former director of athletics there.

-- each previously charged.

By this office back in October of 2011.

With one count of perjury.

For -- false statements to a grand jury.

Along with one count each of failure to report suspected child abuse.

Since then the investigation is continued and in addition.

To the existing charges Schultz and Curley are now also charged.

With criminal conspiracy.

Obstruction of justice and endangering the welfare of children.

Former Penn state university president Graham Spaniard.

To whom -- Schultz and Curley who reported back then.

Is also charged with five counts in connection with his role in the -- -- investigation.

And those counts are criminal conspiracy.

Obstruction of justice.

Endangering the welfare of children.

Failure to report suspected child abuse and perjury for making false statements to -- injury.

As a result of the filing of these new charges.

All three men will face the same five charges.

Didn't.

This case.

Is about.

Three powerful and influential men who held positions.

At the very top of one of the most prestigious universities.

In the nation.

Three men who used their positions Penn State to conceal.

And cover up for years the activities of -- known child predator who allowed him to freely used university facilities.

And then repeatedly.

Obstructed attempts by law enforcement.

And investigators to gather evidence about the -- -- assaults.

Which occurred on camps.

This was not a mistake by these men it was not an oversight.

It was not misjudgment on their part.

This was a conspiracy of silence by top officials.

Working to actively conceal the truth.

With total disregard for the children -- -- that's sandusky victims in this case.

Last year when called before the investigating.

The grand jury investigating.

The series of assaults by Santa -- on young -- All three of these men knowingly testified falsely and failed to provide important information and evidence.

Some of which have been request of pursuant to -- -- subpoenas and which was extremely relevant to the ongoing sandusky investigation.

Two of the sexual salts for which send -- was convicted last June are particularly relevant.

To the charges filed against these Penn State administrators.

The first incidence.

Occurred on May third 1998.

And was reported by the victim's mother to the University Park police the very next morning after she learned that -- desk he had taken her eleven year old son.

To the east area locker room on the Penn State campus.

Where they worked out followed by -- -- keep taking the point into the shower and assaulting him.

This boy became known as victim number six during the sandusky trial.

The other incident occurred on February ninth 2001.

When graduate assistant football coach.

Mike McQueary went to his locker in lash building around 9 o'clock on a Friday evening.

And walked in on Jerry sandusky in India and a young boy.

As he assaulted the young boy in the coaches.

Locker room shower.

-- The investigation has established that.

All three of these defendants.

Stand your Schultz and Curley.

Were informed of both of these incidents shortly after they occurred and that they had knowledge.

A -- and Huskies assaults on young boys in the Penn State locker room showers as early as the 1998 and -- The grand jury present which I think you all have.

Sets -- series of emails between and among these men.

Contradict confidential handwritten notes prepared by Gary Schultz.

Law firm billing records which indicate.

That the McQuay Glasgow law firm built two point nine hours for a conference with G Schultz regarding the reporting.

A suspected child abuse once on -- Sunday evening February 11 2001.

Which was the very day that -- found out about what mcqueary had observed in the shower.

As well as other evidence which establishes that all three of these men were well aware of both the 1998 incident.

Involving -- six and the 2001 incident witnessed by Mike McQueary.

And that they deliberately engaged in a pattern of behavior that showed an absolute disregard.

For the safety.

And well being of minor children on the Penn State campus.

They essentially turned a blind -- to the serial predatory acts -- Jerry sandusky.

Committed on the campus when they all knew that children were the victims of these assaults.

And they gave him unfettered access to Penn State.

Facilities both before his retirement.

As well as afterwards.

And even though they were aware of the strikingly similar.

1998 shower incident.

They -- -- report to law enforcement -- -- any other agency.

When they learned about the Mike McQueary.

That Mike McQueary.

Had witnessed.

A shower incident in the -- building in 2000 and want.

In fact they deny even meet with mcqueary until over a week after the 2001.

Shower incident occurred.

And although they engaged in a series of emails among themselves.

Which began immediately after they learned the incident on February 11 2001.

And when they eventually did sit down with mcqueary they I didn't ask him a single question.

But they just -- all the while knowing about the 1998 incident and what send -- had done to that -- in -- -- One of the emails -- mention of resentment.

One of many -- -- resentment.

Was sent on February 27.

2001.

From Curley to Schulz and it included Spaniard as well.

Seemingly using words to try and mask the true meaning.

He refers to sandusky as the individual.

He refers to the second mile as the organization.

-- refers to the 1998 investigation.

As the first situation.

And most tellingly he reversed refers to the victims as sandusky is guests.

-- seems to be seeking and then -- the approval of his boss stand here when at the end of the email.

He says.

I need some help on this one.

And a couple of hours later expand your response to that email and essentially says that that approach was acceptable to him.

And he says that they could become vulnerable however for not having reported.

The investigation shown that.

The brain -- attempts to acquire documents and evidence from Penn State.

We're significantly significantly thwarted and frustrated from 2010.

Until 2012.

Subpoenas which were authorized by the supervisory judge of the grand jury were not complied with.

And very little of significance.

Was provided to the grand -- until.

The November ninth 2011.

Termination programs can't Spaniard.

By the university board of trustees.

And at that point university personnel were directed not to cooperate with the investigation Jerry -- -- And -- Penn State officials.

These emails.

And the actions of these three men showed -- callous lack of concern.

For the victim -- the 2001 incident.

Who they did not attempt to identify as you know and a definite interest in shielding.

The man who committed these next -- send -- -- both from publicity as well as from criminal process.

By their actions all three of them together and in concert clearly endangered the welfare of children.

And their behavior demonstrates the stark contrast if you will.

Between that the courageous behavior of the young victims who came forward to testify in the sandusky case.

And the cowardly acts committed by these three defendants to cover up crimes pictures sent -- We must not lose sight of the consequences of their acts.

If these men had done what they were supposed to do.

What and what they were legally required to do.

Several young -- may not been attacked by serial predator and the predator.

Very likely may have been neutralized.

It as I've stated previously in this case and I think it did it.

Is equally pertinent now.

That the law applies to everyone.

From the ordinary man on the street.

As well as to those who occupy positions of power.

And great influence on ourselves and our society men like the three defendants.

In this case and if -- to enforce the law.

And protect our citizens and particularly our youngest citizens our children.

We cannot condone under the law.

The actions of those who obstruct justice.

Endanger children up by covering up the actions of criminals.

And in this case the actions of a dangerous serial predator.

All three defendants.

Spaniard curly.

And Schultz are currently scheduled to appear for preliminary arraignment on Friday November 2 which is tomorrow.

Here in Harrisburg before Harrisburg -- district judge William C winner.

And I believe that commissioner Noonan also has -- statement that you'd like to make to you before we attempt to answer some your questions.

Thank -- general -- First of -- like to thank all of the -- prosecutors.

Bruised -- frank Fina the agents and troopers -- -- worked so hard and so long on this case.

Because as you read in this resentment.

There were lies told there was obstruction of justice.

There was subpoenas -- -- -- to be complied with.

And this led to a lengthy investigation made very difficult to find the truth in this particular case.

Now I know you're all going to read to present it as I have been for the last several days.

And one of the things I was struck by when I was reading it you'll see a lot of concerns expressed by these three men they have concerns for the university.

Their concerns for each other and they had concerns.

Even for Jerry sandusky that he would be treated humanely.

But the one -- evil fine.

Lacking is any concern or even discussion.

About the children that -- victimized or any other children that could've been victimized.

It's -- shocking document as far as I'm concerned.

Now one thing that I do open I'm glad to see so many of you here with this and other cases have had an awful lot of media attention and I hope that we can change the way that individuals and institutions.

Won't deal in the future with child sexual abuse.

It's not just one instance where this has been swept under the rug and the reputation.

Our organization.

Has been put before the -- -- of these children.

I hope that that changes I hope this is the last time we ever hear about a case like that thank you very much.
