-- back to this story now from moment we've got some new video that has just come in from Philadelphia.

A member of the new Black Panther Party standing guard outside a polling place.

Opening doors as the voters come through there to place their votes now a Fox News did tried to ask him a question about what his role is there.

Got only -- no comment from this gentlemen you never call.

A big story that unfolded this is the tape back from 2008.

The new Black Panther Party members were accused of voter intimidation in Philadelphia back -- one of them was seen.

Sitting sitting right there -- holding -- Billy club.

Outside of that polling place so what does this mean this morning joined now by Bill Kristol editor of the weekly standard.

-- -- Murdoch a nationally syndicated columnist with Scripps Howard news service both -- Fox News contributors good morning gentlemen good to have you both here today.

It toilet mr.

with you you know what what's your take on this are reported -- try to speak to this gentleman but you know is what he's doing allowed into the lock.

Well it's not allowed under the law because the Department of Justice under Eric Holder and Barack Obama dropped the charges against one of the people who was very much involved in.

Voter intimidation in 2008 in Philadelphia.

These guys were dressed -- like this gentleman you see here one of them was holding -- Billy club.

And he said to Barbara bull who's a legendary white civil rights a lawyer who worked for -- rfk and I was very much involved in.

The whole -- rights battles you say cracker here but -- ruled by a black man.

He referred to white voters as white doubles and then said to black -- Republicans who were poll watchers.

That there be hell to pay and -- call them race traitors.

The two charges were dropped against one of these people despite it a a judgment against the before that at the end of the Bush Administration.

And then beyond that there one of them was told he could not engage in this kind of behavior within a hundred feet from the polls in Philadelphia.

Through the in November 2012 so presumably if you went to Pittsburgh could do the same thing with the Billy club.

Or he stood -- -- five feet away from the polls you can have as Billy club and scare people away so this is all legal because Eric Holder and -- Obama allowed it.

And she's seen that hideous and this morning where he's just opening the door for voters -- -- the quotes that -- I was just talking about her from 2008.

Bill what do you think -- -- this.

Politics can be rough and Philadelphia.

I hope that voters aren't intimidated honestly we're having you know it's a fantastic thing to have this election here in the United States have -- thirty million people voting.

You want the -- to be as clean as fair as possible and I think it will be in 98% of the country.

But people really aren't supposed to stand without a -- I think it is as hard yards I can remember polling places -- -- that's just intimidate voters.

And one would hope that authorities local authorities -- -- the federal Justice Department.

We'll prevent that from happening there is a city there's a police force in Philadelphia the mayor of Philadelphia and they really should -- guaranteeing their own citizens the right to cast a free and and I'm intimidated vote.

We examine -- -- today and see what our reporters can bring back to us from that location and really across the country in terms of watching what's going on with the vote.

Today -- do not ask did you -- very interesting column about hurricane sandy at about president Obama's reaction to it.

And I'm struck by an island an area where people are completely displaced in terms of -- supposed to go to vote a lot of the plan places -- open.

People are voting by email.

I filled out an email valley yesterday because I was gonna you know be in the city -- -- the data just raise a lot of questions about how all of this is gonna be tallied.

I think -- a lot of technical questions.

You know god forbid people so mean might be able -- and a server -- and vote multiple times by email.

I think if pres Obama stayed in Washington directed the response to the hurricane he tried be on his way to reelection -- look presidential he looked focused.

He got back on the campaign trail started talking about encouraging his people who -- to vote.

For revenge.

And I think he just rate -- -- a lot more questions that.

The people haven't the halo that he was able put -- had last week with Governor Christie I think just shattered.

And so I think he's really hurt himself by it by not doing focusing on this and trying to bring relief to people are still suffering.

He got credit for how to handle that -- of these pictures a lot of people still suffering out there now.

Yeah and I Democrats -- -- -- on Thursday when -- -- went back to the campaign trail to spending -- this day.

Very New Jersey Governor Christie it is that what we thought -- mistake could cost President Obama the election such a close election.

It looks so -- for presidential when he was trying to manage the relief efforts they have turned a little sour made that would have happened anyway it's a very tough thing to -- -- this magnitude.

But I don't think he gets the credit -- people thought he might get 45 days ago I don't think.

Huge number of voters are going to be -- how that anyway but obviously a tiny a number could make a difference to and I thank you to -- -- crystal could see ball.
