State regulators spent months waiting for word from the federal government about the insurance exchanges at the heart of obamacare.

Tonight chief national correspondent Jim Angle reports now there is a major bottle Mac.

They could send the health care law back to the Supreme Court.

So far more than half the State's 27 of them have been reluctant about how to comply with the new health care law seventeen of them have already flatly rejected the idea of a state run exchange.

It is a federal law also we're -- let -- experiment.

You do their thing do what they're gonna do in Oklahoma.

It is not politics it is the cost.

And the question of state control over an issue that's so important to citizens of our states given the skeptical even negative reception to obamacare and opinion polls governors have little hesitation to say no.

It's not a politically.

Difficult thing necessarily for a lot of these governors to say you know what this is an untested program.

It's perfectly legitimate option for me.

To -- the federal government run at some critics argue that in the chaos -- writing and passing obamacare.

The legislation did not clearly provide money for Washington to implement exchanges itself.

Or to give out federal taxpayer subsidies and them.

If the state doesn't have a state exchange.

And those employees actually go to the federal exchange.

There may not be any subsidy because -- wrong we'll law is -- clear as it is written.

If the federal government is going to go and run exchanges and lots and lots of states it's going to need a new appropriation.

-- money.

And that's gonna have to come from the House of Representatives.

And they're going to meet real resistance there.

Which is why one governor says Washington keeps moving the deadline back hoping states will say yes the Obama administration.

The very much wants.

That's governors to choose the option of setting up a state based exchange so we can run it because.

I don't think they're confident that they can or have the money they can do at the Treasury Department however which will handle obamacare finances and told Fox News quote.

We are confident that interpreting this provision to provide tax credits to individuals and every state he is supported by the statute and our authority to interpreted.

It is going to be litigated and then ultimately this will be one of those things that's.

Probably decided -- the Supreme Court level I hope sooner rather than later.

Critics argue it's anything but clear and even some federal officials have acknowledged they weren't sure where the -- would come from.

So one more question mark long before the exchanges even start -- when he fourteen.

-- Jim thank you.
