I've been waiting all morning for this one because there's growing outrage right now after a newspaper and upstate New York.
Publishes the names and addresses of every handgun handgun rather permit holds our.
Not necessarily owners of guns in their area it's the journal news in the first publish a map.
On its website on Saturday in the names were all obtained legally -- the paper under the Freedom of Information Act.
The -- doesn't indicate whether that residents actually own handguns as I mention only that they're legally able to do so.
Any information doesn't pertain to rifles or shotguns which we've heard so much about in the tragic stories over the last couple weeks.
And those of course can be bought without a permit illegally so we wanted to know did the newspaper go too far and I have to.
Say Joey Jackson is joining us for a prosecutor and criminal defense attorney.
And trial attorney Rebecca rose woodland I didn't see in that last video whether that was either U2 with a range but I died on grass.
I got more responses when I pose this question out to the Internet -- then I have on a lot of issues -- Joey to the people who may claim that there was a breach of their privacy even though the paper obtained the information legally.
Have a case they have no case whatsoever right now this is obviously a major public policy concern in the wake of these shootings which is devastated the country right.
People concerned people have a right to know what the paper due.
What they did as you mentioned -- is they acted through legal channels they filed a -- request what does that mean.
Freedom of information law.
This was information that the general public could've obtained on their own that paper obtained it finally Jamie listen -- -- this -- provision within foil right.
And it says if the government feels that the request is unduly intrusive or invasion of privacy it could be denied it was not denied it was given to the paper they published it.
Didn't publish all the information some information they actually government actually did feel what's inappropriate to release.
But let me pose this you Rebecca and this is more of a policy issue that a legal question.
I I made one of the people that wrote me back is a friend of mine in Texas.
Who is a former Blackhawk pilot -- -- a female friend of mine.
Who said oh please publish my address.
Let the robbers know that I am well armed and locked and loaded.
Well -- which.
He says and you know because she -- protect herself.
But what not all that citizens who have the -- legal right to bear arms.
Who are now basically pounded for criminals to come -- to attempt to get their firearms because -- on the black market firearms are extremely profitable.
I just think it was it irresponsible.
Of the newspaper what the good looking you're looking to balance the fair and equitable.
Benefit for the newspaper I have written and how did these people why I what is the purpose -- -- I -- -- I would -- when you look at data without Joey and you see how many people got permits.
I assume their point is that there's too many permits out there.
Oh absolutely that's their precise point but I don't know that these people should be feeling all were unsafe to gotta come get my guns if you publish something in the paper and it shows me with a guns are going to avoid that address I don't know that that's that's.
Fahrenheit that's problematic.
That's what my friend probably was saying come and everyone has the right.
To protect themselves is this it wrongful.
Usage of the constitutional right to bear arms wrap now I feel I feel it's of wrongful constitutionally.
Right to bear arms and also freedom of information goes for the First Amendment and you're you're right if you register -- arm.
It can be released we'll all know this we're not saying it was illegal for the paper to obtain information what -- saying it.
It is an irresponsible.
Really focusing on people what's the difference if they have they have the right here to have those guns but what is the problem and then just permit must look man this is -- Yeah what their point is and you know what's interesting when you look at New York City on the left maybe there's like ten people that -- life ahead our police commissioner Ray Kelly you know takes that very seriously not everybody gets easier -- -- But I think I want to ask you Joey show you because you do a lot of criminal defense work -- -- a if a bad guy.
And I'm sure all your people are bigger innocent Annika it's a bad guy or girl wants to get a gun they invited illegal -- these are not the people were talking about necessarily all below are some glances mobs are.
The shooter in the -- -- Connecticut tragedy that's had a number of firearms that she legally.
Absolutely and you know what and that was the problem and that we can get into mental health issues it's a long story but ultimately Jamie there are constitutional liberties I understand that I get that.
But if you don't have a gun or a permit for when you have to accept the responsibility to not keep it a secret other people have the right to know in the community in any constitutional right there's a balance -- a limitation and I believe the public has a legitimate right now.
So this doesn't chip away we're back at the right to bear arms to have the privacy -- your home you can't necessarily carry.
A firearm to permit to own it isn't necessarily concealed weapon permit to harmony.
Exactly I just think that paper went too far I don't think I don't understand the value the true value of helping their constituency.
By just naming and pointing out people who have done it almost.
Pointed to them to say well they said after the new town tragedy you know we wanted people to know -- what their neighbors were doing why.
I'm that -- nothing anyway why do you want -- I -- know I know many I think in my community wants it now I think as a parent I wanna know where might you know where a child is where my children are where they're going I'll get out that way I'll -- -- and I think.
Isn't responsible Ericsson we would have the right to know when want to know who's bearing on -- who's carrying and so I can make responsible -- Don't you think lawyers are lining up right now.
It it in this area of the -- New York.
To actually bring lawsuits or at least challenge -- to see what the courts would decide Rebecca I expect case where I would tell you because I -- at some point maybe it was more responsible to discuss.
What safe gun.
Action is in your home to have safe to have -- that only you can access to understand how to protect your weaponry.
Is that more appropriate of an article that hey those are the people with some gun -- TLC -- -- -- and -- I'm keeping it locked we're -- key -- why not.
-- debate will -- For a long time I don't I -- surfaced on the high and I can honestly I gotta go but it's today's water cooler topic no doubt per share on whether or not you have a right to know who legally hasn't -- when the real issue probably is.
Who has been illegally and those of the people that we need to keep an eye on thanks to both -- -- Joey Jackson Rebecca rose woodland Monday holidays sings and sing to you by the way you look very dapper today thank you oh yeah you did that's good yeah.
