Just sixteen hours ago the White House and senate.

Democrats and I actually senate Republicans were on their way to easily passing legislation.

That would have averted the pain of the self imposed fiscal cliff and all of its trappings for the time being at least tonight.

A different picture entirely.

Well good evening -- there watching and waiting like the rest of us I'm -- there's no plans at least not yet for the president to come out tonight and sing anything they know the ball is in the house's court.

And they believe inside the White House -- trump card is that with senate Republican leader Mitch McConnell.

I'm worried about a deal struck by President Obama didn't.

The senate -- Democrats insist that would be an exercise in futility that could rattle world market.

An unraveling it now is likely to hand the blame to Republicans.

In exchange for an equal amount of tax increases during talks with speaker John Boehner -- the Republican walks away and got most of the tax hikes with virtually no spending cuts -- In what may be the first shot of the 2016 Republican presidential primaries -- Marco Rubio became one of only eight senators to oppose the deal and -- quote.

How can at Barack Obama -- his proposal a deficit reduction package -- that uses tax increase to fund more spending and it increases the debt.

Boehner is banking on getting more cuts during the fight over the debt ceiling which expires in about two months.

While White House aides think that could backfire on Boehner -- advisor to the president did admit it will be ugly.

Telling fox were about to enter quote sixty days of nastiness.

Now I'm told the president has not spoken to speaker Boehner since last Friday when they had that big summit of leaders here at the White House the significance of that.

Is that Boehner has made absolutely no promise to the president that he's gonna pass this legislation legislation.

Let alone even bring it up Brett.

And you know we talked a little bit about the timeline here and the new congress comes in Thursday at noon so essentially.

This senate bill has an expiration date of Thursday at noon and then at that point.

They have to scrap this effort and start all over that's right -- it's essentially the new fiscal cliff that deadline because -- every piece of legislation is -- that's been passed by the house or senate over the last two years completely expires with this current congress to you've got to start from scratch that gives opponents not just on the right but on the left as well who were not happy with this bill to to build opposite position whether it's organized labor others as well as conservatives so that is a huge problem and that's why the president is silent right now.

You can guarantee.

That if we move closer and closer to that expiration date president's gonna go out here and really engage the public to try to force the house to consider this bill before it expires -- and -- in the north lawn Ed thank you had that for breaking news.
