What if anything we think we would make you turn over the last.

You gonna have to bring into court assume the and we'll just go the whole nine yards on this situation and I'm not -- -- And that as you know perfectly well was Megyn Kelly the host of America live with Megyn Kelly appropriately enough -- interviewing Denis saint.

And he is the clerk of Putnam county New York.

And the nine yards that he was talking about going.

Was to resist a request from a local newspaper there in suburban New York to.

Hand over the addresses the names and addresses of individuals.

With gun permits there in that county and this is power play and I am Chris star -- -- Internet happy Friday as you can say we're all Adam's apple all the time here no tie Friday here on our clients we are going to talk about.

We're gonna talk about the fact that has just passed out -- the first launch of a -- -- -- the relief package that has been passed and is on its way to the senate.

We will talk about increasing threats from Republicans to precipitate a government shutdown when we get to the end of February and we run out of borrowing capacity for the federal government.

We will talk to the Republican congressman about why John Boehner is OK with him maybe not great but okay.

And Fred Barnes will be here and you like that they'll probably -- -- -- but it's it's cool we we love him anyway I would have power points -- have Charles it will be fine.

But none of it will be any more fun I promise you than the discussion we are about to have with your friend Ford O'Connell.

He is a Republican is also wearing a necktie he is the chairman of -- -- act.

In the co-founder of project Virginia.

He advised the McCain campaign he has certainly -- Republican in good standing.

It's a you know -- you also know Richard Fowler he's the host of the Richard Fowler show and we act radio.

If you live in DC you can listen to at 1480.

AM.

Here in DC you're welcome back he -- and we should -- man of the left.

-- Democrat in good standing -- -- -- -- the red tie is just a little doubt just so people know OK so what what Meghann and clerk saying we're talking about there there's been a huge story the the in Putnam county New York.

Which is home to the journal news which is -- -- -- newspaper that published.

We've created and it -- -- -- online mapping which you can see the homes of people who are licensed gun owners.

In the county and the clerk says -- me take -- to court I am not going to comply with these First Amendment.

Requests that I give the press this information.

The sort of cuts across ideological lines let's start with -- Ford.

Conservatives are upset about the newspaper publishing this.

But is it right -- gun enthusiasts are upset about the newspaper publishing list.

Is it right for him to withhold this information.

Right now I think Afghanistan is a slight dog as the former journalist and recovering attorney I have to say the law is not -- his side to.

There -- endangering the public but the reason why he actually has a very good point right now at least in the short term.

Is because the journal news really was not interested in reporting on -- guns or even anything else they're interested in shock value and this -- -- -- don't look for analysis.

And right now until he -- if he's so that burden they could shift back to them but I think over the long on what he really needs to do was just holdout until New York.

-- change that this information be more.

Right now and so did that.

Public.

Republicans and conservatives and Democrats and liberals generally like to say the transparency is a good thing.

-- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- On the rules of four by the city New York.

Of either way I think this is dichotomy for anybody to have that would I think would it doesn't lead to the national.

The broader cognizant of that nationally about guns in this country and I think we'll see that come up in this congress bull -- a dual -- -- In terms of clerk Sam what he also he also besides endangering the public in a very -- an argument.

That was based on technology.

And what he was saying essentially was is that the technology's changed because in 1981 when a similar case was filed the Wall Street Journal -- part of this.

You know networks at a news -- the deal was is that they actually want a very similar case.

In 2006.

They asked the clerk again for the same information he gave it -- -- but they didn't publish it.

What he's also -- -- that that technology is change I think he should open it to a -- -- aren't aware.

I'm glad you brought that -- because understandable technological argument saying that the Internet democratize is that he has.

Look what he's that's what we cannot every.

That at least -- making it more accessible to people but that but the why does it why is it different -- I have to physically go Richard to the clerk's office to find it because this information is all available and by the way you can go to your clerk's office and find out how much a neighbor paid for his -- you can find out almost everything.

You can find a lot of stuff about people's very personal details.

Just by going down and you can in most places get a list of concealed carry permit you can get a list of things that relate to firearms.

What's the difference if that's searchable online.

Well as he -- thing I think businesses of.

-- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- We don't really putting slurs and highlighting people who own guns they have it out for the Second Amendment.

Thought what they're also doing is -- trampling over privacy in the courts don't like it when you use data -- To expose anybody they want -- actually physically shows something other than just trying to endanger the public this is very close to it in some -- -- -- or -- -- aggressive with more and what's -- -- -- public -- you know a -- would go to a couple of assault rifles or.

Don't know where that person particularly OK I've got burglars I've got these I've got stalkers I didn't know where the guns are -- will -- remember this is only a handgun request OK so let's start to that point.

Secondly I didn't know what -- guns and who doesn't it makes my job much easier when all I want to do is.

-- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- An intruder this many 323 says this I figure as soon as I walk out the door I have no privacy anymore but in my house.

Transparency.

Is none of your business I -- said bees -- that is because it would have been more pointed.

But -- the truth is that this is this issue technology is gonna make all of this a lot more complicated exact gonna make all over the lot more complicated in you can imagine that let's say in a state like Kansas that has reporting requirements as it relates to abortions and things like that that if the shoe were on the other -- you could see things it would be it would fire up a different direction.

But we think you guys from being insightful and fair minded and patriotic about the whole thing that's what we count on you for happy new year.

And here OK while we wait for Al-Jazeera to make us an offer we're gonna take a quick break but when we come back we're gonna talk to congressman Scott did you -- from Tennessee he voted for John Boehner but is one of those who says that what ever happened in the fiscal cliff -- the Republicans are now going to be able to get the leverage on President Obama that they need.

In order to get cuts in entitlement programs and in government spending we'll see if he's right when we come back.

So stick around.

And that.

Is a lot of money more than sixteen trillion dollars that's how much money.

The federal government owes some videos to itself some of it goes to Russia and China and people and banks -- the world.

And this is power play and as you see that number screaming for word to the sixteen point four trillion dollar debt ceiling.

Republicans say that the time is now that as we approach this breaching the debt limit.

That they're going to force the president to make some spending cuts.

Is it possible.

Maybe he's got to surely knows he's a congressman from the great state -- -- congressmen welcome them like Europe's.

All right so I noted today.

That John Cornyn.

Who is not exactly the chairman of the Tea Party caucus among the Republicans in the senate was out there with an op Ed today in his hometown newspaper saying.

Government shutdown might be just what's needed to get fiscal sanity restored in Washington DC this took a lot of people by surprise here that somebody.

In the more moderate Senate Leadership.

It do you think that that's where we're headed.

It's possible you know we don't wanna see about that would be the unfortunate way to go about it but I think people are realizing.

That after four years -- president promised to reduce the deficit by half in his first term will be a one term president clearly we had a four trillion dollar increase in rising we've got to do some in the wake people up.

OK right now.

When we talk about cuts are we talking about a scenario like we saw 2011.

Where you have a dollar for dollar than what people call -- -- rules.

For every dollar of new borrowing power for the executive branch that there's a dollar in cuts.

I think we need something a little more aggressive and out.

Now that that keeps is that an even killed but congress has always overspend what it projects.

As you know we've been operating without a budget for three years so clearly we need to get a budget we need to cap spending and we need to -- meaningful cuts that has means to an end.

So far there were yet to see anything from the president or the senate we've offered plans in the house there would eventually balance the budget but.

As -- so -- deficit continues to increase at a faster and faster pace.

The president has now fulfilled a campaign promise to raise taxes and also promise to -- approach so we always need that from him.

But I think people are seeing.

That you know we are.

In a situation that's gonna be insurmountable -- we don't address it soon.

Now.

You were among those who voted for John -- you're among read over what all the nine you were colleagues in the front side.

Who voted to give John Boehner another.

Whack at the speaker's gavel it's.

There were many conservative groups -- you are.

Undeniably one of them about more conservative members of congress and there -- many conservative groups it's entertainer should be tossed out.

Why did you vote for the speaker.

Ultimately.

He was -- was nominated.

-- I think that.

He's gonna have to be really firm moving forward I think we all had -- for a different outcome in this past election and we would have better situation from which to work from.

Now we're we're literally have to -- again we're -- expect a lot from our speaker.

And there we're gonna have to be willing to -- much harder than we did in the past two years.

We now we saw we saw we just saw -- moments guys and that's where you were.

Was that the house -- overwhelmingly voted 24 out of no aid package for this new York and New Jersey victims of super -- C Indy.

-- -- -- -- -- Thousand made we've got to start -- -- the spending and you know certainly my heart goes out to the victims.

And we just have to start looking at this legislation and more meaningful fashion the big package the sixty billion had earmarks as we -- know -- was not offset.

And even a small package.

You know that it only in Washington legislative thirteen billion a small we've got to find the offsets for -- spending we always have emergencies but we we can't seem to find an emergency offsets -- -- -- -- government.

I think we travel -- we could do.

So we've -- your forecast what -- now what you think ought to happen to just -- -- forecasted before we let you go.

Are we headed should at least get the government shutdown -- warmed up is that where we're headed do you think -- -- you think that's more likely or less likely.

Well I've never been through government shutdown and I think I hear that it's not good I do remember.

The last time it happened there -- don't wanna see that.

But if that's what it takes to.

Get everybody's attention and realize this generational theft has got to stop them there we'll -- but I hope that's not the outcome.

All right.

Congressman Scott -- -- -- we thank you very much if you were from.

Oklahoma you don't already but if you're not there -- is congressman Scott did you let me thank -- By Chris.

Okay Internet we're gonna take a quick break.

We're gonna let you pause the pause that refreshes.

-- when we come back Fred Barnes will be here to -- refresh you even further Fred's point.

-- vary widely discussed column in the Wall Street Journal this week.

Is that President Obama wants all or nothing at all he wants everything his way.

I will talk about how Fred sees that affecting the discussions over things like shutting down the government.

And stuff like that when we come back.

-- -- -- And that is President Obama in his native Hawaii enjoying it shave ice which is the Hawaiian version of -- snow -- And he seems to be having a rather good time on the second leg of his vacation.

Return to Hawaii after -- trouncing the Republicans.

On fight over tax rates this is powered by welcome back.

So the president it is one of the very few people who seem actually happy about what happened in this tax plan and he's happy because he won.

As we've talked about here before not only a big tax increase which is something that liberals have wanted to see for top -- for a -- but he won -- -- and narrow ideological point which was.

That rates would go up not just that loopholes would be close that rich people would pay more in taxes but how they would pay more so -- did something and nobody's done since August of 1993.

And that's actually raise tax rates so what does this tell us about the future.

Fred Barnes who is the executive editor of the weekly standard.

Who was moonlighting at the -- with the Wall Street Journal this week who was he really occasionally colonizers there.

They just don't tell Bill Kristol.

But you wrote this week.

Column that's been discussed foreign wide about.

The way that Obama governs and -- -- you -- for those who have not yet read it we get lost it for us.

Well what I guess -- that piece was.

Obama makes it very hard to reach a big deal with Republicans -- he had the help -- the fiscal cliff at this time -- tax rates we're gonna go up regardless of what.

Republicans did so well.

But it was a pretty easy victory for didn't seem like it at the time but compared to what he faces through 2013.

To look back on that finally.

Well let me ask what he hasn't done in the past enjoyed liberty had negotiations in 2011 and then did it than this past year he did to.

Alone or working out.

A grand bargain so called on taxes and spending -- -- even entitlements and with the tax reform and all these things but.

You know he just doesn't.

They're really two things he does wrong what is he doesn't take personal responsibility that other presidents have.

-- for getting a deal and -- in you know it's always somebody else's fault and so on and and -- and he sometimes he's negotiating sometimes he's not.

But -- choice not to trashing Republicans that I think that's a problem you don't wanna be conciliatory wanted to get some Republican allies he has not.

And I think he's gonna need to develop some and the second thing he always does is when you went right.

Chris -- you getting near.

Making a deal.

He raises the -- yeah comes in with -- demands and Republicans.

You know that may be at the John -- Harbaugh didn't it 2011 and made all the hope all the Republicans blocked a couple months ago when they were trying to work had to deal so.

The president.

He can bask in his in the glory of god you got this tax increase but he's gonna have to do better to getting bigger deal that he really needs in 2013.

Now -- engaged in some reckless speculation today in my.

Our -- which you as soon as soon as the Internet and allows it to exist you soon you'll get.

You follow me -- cease fire walking in my currently every day which are right for you because I am so -- to view Internet.

Even those of you who did not like fact that I made fun of the real housewives franchise yes I know who you are.

But.

-- provided to you every day have you enjoyed and for what I argued was that.

The new normal.

Union which help President Obama get elected -- the -- normal by the -- -- fourteen point 41% unemployment and underemployment of people that's more than twenty million Americans.

And it's been true.

Forever.

Now it's been true for.

Three years essentially it's been fairly static Mitt Romney used to trying to get people exercised about this we can do better and people said that's the new normal business we have we're in a slow growth high unemployment country now and people -- -- with the new normal.

I hole.

That in fact this will make it harder for the president to apply pressure to the Republicans on the debt ceiling because and he says you're gonna hurt the -- Economy people already have such low expectations for the economy how do you scare.

Yeah well and I agree with that I don't think that was as reckless as you.

Next week more -- as -- did today I don't know what it's true he's gonna happen and bill -- the -- here's where the president has.

The upper hand and it -- and there's only one way that he has the upper hand it in twenties thirteen.

The issue of cutting spending and reforming entitlements and so on and getting us out of this fiscal mess and so -- those are things that.

But not working -- his benefit in his benefit but he's the president he has this big megaphone and he can go around and say things that get attention -- a way that Republicans can't.

I think Republicans need to designate a a spokesman.

Maybe a couple of minutes shouldn't be John Boehner and it shouldn't be Mitch McConnell -- it may -- need you know perhaps Paul Ryan or perhaps not but I'm.

I don't know who it should be Marco Rubio I -- and it's available.

All right probably is still -- but the people who can discuss these issues and -- A way that.

And ended the -- and time you know somebody.

You need somebody that's what -- will be would.

Them from Marco Rubio would be good because the media always wants to put him off right end and Ed Paul Ryan to a lesser extent they get people like that.

Who also have a big megaphone to combat the president which they.

Haven't done so far.

OK so -- it.

Do you think in this is just this is calls for rank speculation on your part and that's -- -- -- -- -- that's what that's that's what that's what I -- -- didn't -- -- was a hero of mine when I was starting in the business the record to speculate that they're better exactly and we only have to be right perhaps the news cycle now on the Internet and it is so -- put the question is.

Did the president -- wanna deal as he went through this process did he because it look he acted in every -- like a man who did not want.

The -- I think he wanted to deal but he was predicted that it was bluffing and he was bluffing very successfully meeting convinced.

An awful lot of Republicans that he didn't want to deal.

But at the end of the day I think he recognized that he needed one that while Republicans might get blamed for.

When we fell off the fiscal cliff that as president it was gonna harm him to remember though.

The whole debt limit squabble back in 2011 in the White House thought well this is gonna hurt Republicans because they weren't automatically going along with the debt limit increase.

McMillan the pulse came out after that the Republicans.

Went down but President Obama went down to correct I think he would suffer if he'd gone off the fiscal cliff and I think he knew that but there.

Boy what a great -- offer.

Yes a very -- very successful -- offer.

In -- when he's sitting in two -- -- and don't call my bluff.

Yeah obviously you're not supposed to say -- just bluffing it that doesn't that doesn't work so.

What your forecast government shutdown we're not a government shutdown I don't think that we government shutdown but I think you think -- cave and give some cuts.

I think you'll have to achieve and get some cuts public wants cuts the public knows about the trillion dollar.

-- deficits we have if it was the president's mistake.

In the fiscal -- deal he should've given.

Republicans suspending.

Because now people remember what they remember about that remember that -- can get a tax hike went up but also there -- -- spending cuts right it doesn't matter.

He should put some in the early and then there would be less pressure in 2013.

Looked -- -- for spending cuts.

And then there's no good well now what we know is that -- say there's zero goodwill than did the atmosphere is even worse in the doesn't Fred did some have argued I think that there's.

There's some basis in this.

What the president is looking for here and and Charles Krauthammer Mara on the same page here that the president is looking for total victory he gonna take each one of these things -- Up to the edge in an effort to really break the back of the -- But yet but he's not gonna have the benefit of -- of the fiscal -- that where there would be an automatic tax increase.

It -- there wasn't a deal.

And Republicans would get blamed at least that's what all the polls that he doesn't have that he doesn't have.

His for the Republican -- it is a little stronger and his is a little weaker than it was.

Couldn't get it going into that deal but you're -- about his ambition his ambition is didn't.

When the whole thing you know when you.

-- when you have a a deal -- a compromise a bipartisan compromise is supposed to -- something to each side that they don't have to be thrilled.

Exactly but they need to have something to need to be at least minimally satisfied and I don't know the president doesn't -- that equation.

Minimally satisfied -- the new watchword of Washington Fred Barnes and happy new year and thank you for being here -- okay mock tank -- Smart -- in my tank who follows me -- -- as you should Internet to have the full fully -- power -- experience.

Says this about the Putnam county clerk and the newspaper in the gun owners out there I got -- It showed that I didn't have a -- I would shoot the paper they put me and my family in danger.

You got it this is a place where conservatives say that they want that they're that they don't like.

Plaintiffs' lawyers and lawsuits this is a place where lawsuits actually this is what they're designed for if somebody were -- and I could take it one step further -- a matter of fact even if all you had to do was put a security system in your home even if you had to expend some money because you were concerned and fearful a jury might and -- keys to that newspaper.

So that's something that when -- -- in the newspaper business we are always very cautious about -- we knew that juries don't like you that's -- truth.

Sure confessed that like the newspaper it's so good point -- tank as usual.

Now.

On the hunt with Jonathan Hunt is coming up next for you you'd like that that's true I'll see -- -- I'm Laura who sent.

-- angles and I was mistaken and I appreciate the correction.

-- -- is in not that you wouldn't tune in for either of them I you can see me again at 1 o'clock eastern time -- -- with Megyn Kelly.

On the Fox News Channel.

But first some power points.

Have it your way.

Those -- the power points for today it's not just the slogan.

-- but fast food restaurant it's John trainers new approach to life and the Obama era of Washington.

Point number one.

Continue consistently underestimated I know of no politician of such stature in Washington who's been so consistently underestimated over time as house speaker John Boehner he was he has been left for dead politically several times several times in the last two weeks is a matter of fact in here he is reelected to his speakership with fewer defections -- him in his caucus.

-- Nancy Pelosi had her when she was reelected for speaker so that's that's a real thing so here's your second PowerPoint John Boehner.

Was willing to suffer personal discomfort at both ends of Pennsylvania Avenue that he was willing to risk his speakership in the effort to try to get a big deal done that would address entitlements and do the things that Republicans say that they are so concerned about he was willing to lay it on the line for that with the president and in order to get it done in the end.

In a way that.

Republicans could stomach.

That could most closely stomach he was willing to suffer some real some real upset inside the conservative base so there is a guy who is willing to do that.

And number three.

No -- John Boehner is no -- And he knows now that president as brother -- pointed out earlier is not a guy who's interested in negotiating and not a guy who's interested in making a big deal because Boehner tried three times now and couldn't get there and the president kept moving goalposts but he's no dummy and he knows.

And now if the members of his caucus would like to shut down the government or anything else they'd like to do remove the capital to become one Iowa and he'll let them vote for whatever they want to vote for is he's no dummy he knows.

How things stand now so those -- your -- -- -- -- -- -- Friday.

And now as we like to do every day we want to leave you with the word from our French are.

It's.

Clearly feel the president you have to protect your country you you you do what you have to do.

It vindicates what the Bush Administration has done and now we have a national consensus on that which I think is.

Terrific advantage over.

Where we were when Republicans -- -- empowers the only reason.

To -- group the grateful that Obama won in 2008.
