Right now the trial resuming for a twelve year old boy accused of murder prosecutors say he shot and killed his father.

As he slept in their home two years ago and after a lengthy delays the trial is now focusing.

And the boy's mental state team only has the latest from our breaking news stats -- -- -- good morning to you the delay in the trial was due to their meeting the time necessary for mental health expert to actually evaluate the boy.

Who would have videotaped interview with police admitted he killed his dad.

Paul was 32 and an unemployed plumber when his son who authorities -- still not identified allegedly shot his father while he was sleeping.

Defense attorneys representing the boy claimed he was raised in a violent environments and -- that killing people was okay.

Child welfare authorities in fact Jenna had made more than twenty visits to the home checking on the boy.

Prosecutors claim the boy always had a violent streak stabbing a teacher while it was in kindergarten with a pencil.

So that's where the case is today back in court.

And by the way -- it's heard by a judge not a jury.

And that judge will decide if there was premeditation.

It's still unclear if the boy will take the stand that could be very compelling.
