And -- -- Hannity and tonight at this very hour president Barack Obama is considering taking executive action aimed at limiting your Second Amendment right -- -- mom shell revelation came from the vice president.
Earlier today during a meeting with his gun control task force let's start and take a look at this.
We're here today.
-- immediate action -- They and their the president iron in terms of tape cache it's not an exercise you know we're hopeful opportunities -- People.
We are reportedly used to know what you're saying we're really reaching out all fall part.
On whatever side industry.
-- Executive action can be taken we haven't decided what yet.
We're compiling all the -- with the attorney general.
All the -- -- numbers.
Action we we would require.
I G here that let me repeat with the vice president has said quote the president is going to act through executive orders but what exactly does that mean.
It means that our imperial president is weighing possible changes to gun laws and regulations without seeking the approval of the congress in other words.
It means that he intends to unilaterally.
The constitutional rights of U law abiding citizens without consulting.
The legislative branch now I don't know any better I would think I'd be reporting on a story from Cuba Venezuela Iran North Korea Russia.
Unfortunately this is taking place right here in Obama's America for example.
Nancy Pelosi now the Democrats have been urging the president to bypass the constitution.
Article one section seven.
They're urging the president to use the fourteenth amendment to raise the debt ceiling.
And only today to the White House spokesman Jay Carney seem to back off that unconstitutional idea -- this group who else.
Obama is increasingly relying on executive orders to bypass congressional authority now this is what he refers to as the we can't wait initiative.
-- I call it get the Republicans the hell out of the way initiative.
Now he's been using this for infrastructure projects and economic policies now he's made several recess appointments while the senate was officially still session.
No president has attempted that power grab.
He is also halted deportation of illegal immigrants in other words to our executive Fiat he adopted provisions of the DREAM Act but we failed to pass it through congress.
He also unilaterally change state welfare work requirements without submitting them to congress for review.
Even the nonpartisan Government Accountability Office said that he should have consulted congress in that case.
So what you're witnessing here is an out of control and arrogant and unconstitutional.
Executive power grab.
And here to talk about the legality of all of this and discuss what options the president may be weighing especially when it comes to the Second Amendment and gun control.
From the American Center for Law and Justice.
Good evening -- -- this Hannity chief Justice Kennedy the user.
I let you know that you're lower much that -- Supreme Court justice that congratulations I appreciate them cradle and you -- think the good -- to be a Supreme Court justice was -- I think he making oral arguments any day now on some topic that final ruling j.'s favor on.
I missed a purple nation Lanny Davis this this is no joking matter when we have a president of the United States.
Using executive order bypassing congress.
To get done what he cannot get them through the legislative process that that is a problem Lanny that's a big problem.
Well it could be.
Illegal and if so it should be challenged and taken to the courts the Republicans have not been bashful about doing that.
You remember that the Affordable Care Act otherwise known.
By some Republicans as Obama -- was taken to the Supreme Court rarely -- I don't know I don't know if there is anything illegal sometimes executive orders or within the overall authority -- -- -- some are not.
So it should be challenge I don't favor president acting illegally but that's with a question for mr.
You know but it's also -- -- I think the president -- sworn to uphold the constitution.
-- for example -- the fourteenth amendment to raise the debt ceiling is very clear article one section seven.
The Second Amendment couldn't be could not be any more clear and we laid out.
What our founders and framers set about a last night so the president has responsibility himself but he wants to push the -- -- Your reaction.
Well look I mean we should be surprised the president said as much job before when he was running for reelection he said -- congress isn't gonna move he's gonna move now it's.
Take a look at each issue with regard to the Second Amendment that there's no executive order the president of the United States can.
Issue that's -- override in the Second Amendment to the United States constitution so.
Vice president biting could be making it you know platitudes statements or -- saying whatever he wants about executive orders and executive action.
But the fact of the matter is the Second Amendment is not going to be overridden by the president of the United States and they try that.
That should be challenged it would be challenged successfully but -- it there's a connection Sean.
Between that issue.
In the dead issue this idea that Nancy Pelosi been advocating and others that the president could just on his own ignore the debt ceiling limitations.
And incurred debt the constitution says exactly the opposite but again the fact that you've got Nancy Pelosi.
And other Democrats saying.
This is the way we could go -- we have duke shows you that this is a lot of threats and ignoring the constitutional reality things of separation of our friend -- in ranch a legislative branch and -- judicial branch.
Reverend Mark Levin the great ones that this is a post constitutional America this is now.
Now taking executive power to -- agree that nobody has taken it before without respect to precedent.
-- it let's go to the videotape in the words of Warner wolf a great New York sports captain Lanny Davis.
Let's listen to your friend President Obama on the issue of executive privilege and back and executive -- back in 2007.
I think that.
The issue of executive power and executive privilege.
Is one that.
Is subject to abuse.
And in an Obama presidency what you'll see will be.
A sufficient respect for law and the coequal branches of government but I hope we don't find ourselves in -- situation in which we would be having.
It's being subpoenaed for.
What I think everybody acknowledges this and troublesome information out there.
Lanny if the president can't get an appointment he wants and then the -- -- session he makes a recess appointment nobody's ever done that before.
That's -- -- advancing.
I guess that he audience knows that -- -- stated conclusion and I know -- sincerely believe but which others disagree with this and it was not in session.
There's and it was not in recess one it has -- trial there was a ploy used by one Republican trying to hold the floor latest actions or not.
Was at you know they learn not what they recess trying to answer on.
Hopefully to a loss here so let let me at least get to the point because his disagreement on your -- no disagreement that.
I let my let you know where Eric let let's.
Actually not -- and look the fact of the matter is there's a lawsuit that's been abroad on this very issue and these were.
-- controversial appointments the president will do that in fact the senate was not in recess and he did anyways and that's when he said remember.
If congress doesn't act he's gonna do it on results of the -- says that.
With a little -- -- -- court -- -- -- is right where it's being -- were involved in that case but the fact of the matter is I think it's it's pretty significant that this is a pattern that we've -- now throughout.
-- -- -- -- -- Second Amendment and the fourteenth amendment issues the Second Amendment this Supreme Court has held is the right to own firearms.
Every -- on the Supreme Court every one unanimously would say that doesn't mean you can't regulate.
The use of firearms just as we already have on the books background checks are required.
We literally was totally an average of government so you are left in I'm sure you'll agree that that that is not violating the Second Amendment -- to the fourteenth amendment.
I do not favor.
This stretch of the constitution or an imperial presidency waging war over that a declaration of war so there's a little -- -- Republicans.
Love waging war over that declarations of war as they did in Iraq and -- -- in Afghanistan planning -- and then and then with a.
-- -- -- Did the President George Bush went and he got the authorization of the use of force -- -- wouldn't quit and I -- declaration no excuse me nowhere in the constitution.
Does it say you must use certain words put an authorization -- -- Every wish everybody kind of sense -- -- -- should just -- on winning and that is.
We regard because that's not -- disputed that President Bush had authority for the engagements in Afghanistan and Iraq what is -- I had I didn't hear the idea he had his -- and.
-- you said it right.
Can you can -- states and can regulations being put in place involving had -- short but there's a Second Amendment you're right I think all justices agree.
That that's a right that exist for individuals but the president doesn't get to set the regulations -- the legislation without.
Outgoing through the legislative branch there's no regulation -- -- -- -- the legislation problem in other words is no legislation that he can -- -- -- regulation.
He gets fired don't because -- it digested Hannity doesn't get to the Supreme Court I think through courts won't uphold.
Thank you thank you both as an important thing we can't have a president imperial presidency.
Gaining power and legislative or executive Fiat bypassing congress we have separation of powers.
And coequal branches of government thank you both.
