First -- New York's new gun control law.

The reportedly does not exempt law enforcement from its prohibitions.

In our next guest says that although governor Andrew Cuomo's office is now saying the cops are exempt.

It still needs to be put in writing joining us is Fox News contributor and DC homicide detective Rod Wheeler rod nice to see this morning yes so what's at issue here that there's a loophole.

With this seven ammunition limit that basically.

Police are in violation of this current law that Governor Cuomo signed right will governor Cuomo's office is calling it an oversight.

And what talk about an oversight I mean what they're saying basically is that police officers security officers.

Individuals that protect other individuals.

They have to take three rounds out of the ten round clip so they can only carry seven rounds now they say that they're gonna make that change so that -- later on this week.

But one that happened in the first place and I can tell you what happened in the first place.

This was a law that was rushed through let's face it -- happened overnight.

All of a sudden you have this new law were cops and everybody supposedly has to reduce the amount of rounds in their -- The other thing the of the other major problem with this law is who is going to be affected by this law.

Not the good guys and not the bad guys but the good guys the bad guys are gonna continue to have 1520.

And thirty round clips.

The honest people the -- working people.

Both -- legitimately have weapons.

That's who this -- -- -- -- -- there about a 115.

Million high capacity magazines -- circulation in the United States here so it's not like you're gonna affect those.

It sounds to me like Governor Cuomo never consulted actual law enforcement officers before.

Citing this law well surprise surprise I mean how many laws today.

-- -- act as far as that that affects law enforcement or are criminals.

When they actually consult with police officers rarely do they do that believe it or not and that's startling.

We have now a larger debate about military style assault -- things.

And right right right after the NRA's press conference commissioner police commissioner of New York City Ray Kelly was.

Angry at the press conference because he thought that the NRA should have to -- military assault rifles.

But there should have been some concession here and he was specifically talking about New York City -- his jurisdiction.

Can we have a larger debate about this and it would does this law.

Maybe.

Presage a larger national law will happen in New York.

Some military assault style rifle ban these large capacities.

Ammunition clips -- that's something we'll see nationally will that pass congress is that somebody needs to happen.

Well you know what I think that's kind of what the president is trying to do is go down that path and I do applaud the president for wanting to do something.

The problem is that something is may -- not what we need to do.

Again who's going to be affected by all of these laws whether it's reducing the the amount of rounds and of weapon can that I can't handle.

Whether side view of the modification of the weapon it's only gonna be the honest innocent people that these new laws are going to affect just like you -- -- Tucker.

A lot of these weapons are already on the straight so you enact these new laws do you think the bad guys are gonna come in turn their weapons and turn in their thirty round clips that's not gonna how we keep -- what's so interesting to me as we keep hearing from politicians that nobody needs more than seven rounds to defend himself.

But it sounds like law enforcement officers think they do you -- -- then that to defend the law enforcement officers did and why do they needed because the bad guys have it already.

And -- let me tell -- if we get a car to go to a school -- say Newtown right and we know that that individual is not following any kind of law.

We're gonna have seven at ten rounds and our weapon when that individual they have a clip with thirty -- Do we stop that stuff -- how do we stop the bullet piercing.

-- the the bulletproof piercing bullets the body armor piercing bullets from getting on the street where the cops and have to elevate it one more degree higher than that -- mean if that seems to be the issue -- the politicians are talking around the problem.

Well you're exactly right and that's why I've been saying all along guys.

We need to address the causes of the new -- shootings that causes of the roar Colorado shootings what we're doing with these current -- we're addressing the symptoms.

You know you you take away the clips okay great is that got -- -- in town absolutely not.

Is that gonna stop Aurora Colorado absolutely not so we need to address the causes the mental health issues we need to be focus more on that.

Again I think our focus needs to be channel re channeled -- -- will.

To more of the causes instead of the symptoms -- mindless Rod -- thanks a lot through thank you.

Belong there.
