And is this going representing the First Amendment.

Free speech.

Representing the Second Amendment.

Blow right up there are.

It appears that we are headed toward a constitutional battle.

Between the first and the second amendments can -- co exist in our society today.

With -- is Elliot Fineman president of the national gun victims action council from Chicago and Steven Albert here in studio with me outside counsel to the NRA.

Gentlemen thanks for being with me this evening -- I'm gonna start with you.

You just handed me the book that you wrote on the founders' Second Amendment origin of the right to bear arms.

-- now we are seeing an effort on the part of many people in the aftermath of -- to cut back on Second Amendment Rights.

Now -- -- understand the Second Amendment it is a god given that right.

That the the writers of the constitution.

Felt that it shouldn't be infringed why all of a sudden is there an effort because crazy people take someone else's guns to eliminate guns.

Whether the framers of our constitution -- a -- free society and they felt that recognition of the right to keep and bear -- was necessary for it.

And when bad things happen in society.

-- you can attribute it to -- factors but it's not the case that.

Law abiding people should be blamed for these things these incidents that take place either about criminals are mad man.

And in fact.

When it says that the -- not be infringed it means that the people have a right to have ordinary rifles pistols and shotguns to keep them in their home.

-- to bear arms and that makes for free society to protect yourself from criminals.

Well let me ask you -- I mean do you disagree with what Steve is saying regarding the Second Amendment.

And the right of the individual to bear arms.

Well this that this is not up for discussion anymore the Supreme Court instead the individual can have a gun at home.

Or guns at home for self defense in the home.

The Supreme Court is also said that we can have reasonable regulations.

I disagree with you -- judge when you say this is a good idea.

Right right right I have -- let him go that's yes I I have another and another kind yeah they know did it look let's just agree that it is.

The Second Amendment to the constitution OK and that we can decide later you know that OK we'll leave it at that.

What but it is they are right that people have been yet in the city of Chicago -- -- have been taken from people.

Pot it's one of the most violent cities in the country how how do we make the connection between violent crime and taking away people's -- Well first of all it's a -- that guns were taken away and Chicago.

It just -- admit that they were taken away in DC the gun trafficking means and just as a myth by the way that there was an assault weapons ban.

The guns and the Chicago get you through trafficking there -- many guns here.

Whether we have a lot -- you know on the street whether we have a -- against them or not.

But but but -- I'm even Elliot what's been taken away are the legal.

Gun owners' right to have a god the illegals always have them.

So that haven't we balances so people -- Defend themselves.

Well first of all the concept of the lower abiding gun owner to me is very strange.

We don't talk about the -- -- driver we talk -- that the legal driver.

Every -- criminal bear in mind was once so -- abiding citizens this is not a constant.

It's not a constant that's -- because somebody's for obeying the lord today that you know they have tomorrow.

Yes -- we might not have regulation that because someone.

I has got a gun legally that you're gonna assume that they are going to act illegally win that way at this.

I'm -- -- -- -- have the potential to act illegally.

I'm more so than a question whether they got it legally in in a very.

Appropriate manner not always well it was I didn't site I know I signed permits this is judicial yes initially approved Steve what do you agree with that.

Well not at all I mean that there's 50% of fan councils in this country have farms in them most Americans are law abiding and we're talking about a very.

Distinct group of criminals who -- mostly were set of this.

They could make.

One act of violence after another and this thing to to think that have over a normal person who.

Clears some of the background -- to buy guns in this country that everybody has to take -- -- a gun from a dealer.

To think there's suddenly gonna become.

While glad to criminal and kill people mean it is that's mind -- you know -- -- the normal people and then there's the criminal class -- right -- David thanks so much for being with us this evening.
