And back.

Is Jessica Lynch you remember her there she is a getting on with her post.

War post military life act a great great institution it greatly grand institution -- West Virginia University.

And this is power play and I am Chris Farrell and I didn't just show you that footage.

Because I wanted to show WVU which I did it was just a bonus the real reason I showed you that it is.

Jessica Lynch is the face in many ways four opponents of allowing women into combat roles because of her captivity.

And some say sexual abuse at the hands of for Iraqi captors.

It makes for a frost discussion.

And Leon Panetta who is the outgoing and we thank.

Six.

-- of defense.

Dropped a -- yesterday while everybody else was talking about Hillary Clinton and what her eye glasses look like and whether she was angry in which senator she was angry that.

He said by the way women are gonna we're gonna open up all of the combat roles.

Two women over time and this has caused some shock and consternation we will talk about that today I promise.

Which we have a Smart person department -- we will talk about those hearings yesterday and what could be some interest thing.

Potential future -- we'll have a little fun could you see it rubio Clinton debate could you -- Rand Paul Clinton debate could be interest and so we'll talk about that you'll like it.

We'll talk -- the balance of powers.

And whether congress is doing we know congress doesn't work but is it even doing its job judge Napolitano is here which I knew you'd like.

I know you like I don't you like and and and he'll be here to help you out and understand that the constitution and stuff like -- -- Charles.

-- I'm guilty I'm I'm done -- -- giddy about it and James Joyner.

Is probably not -- -- -- I'd never seen any really -- giddiness out of -- doctor.

Doctor Joyner is the principal off third.

Of outside the beltway and influential blog and he is part of the Atlantic Council which is an important think tank.

On world affairs military activities NATO stuff like that -- but today.

Doctor and we call on -- special part of your expertise which was as a field commander in the united states military.

So ladies on the front line -- -- Its interest.

Him if you ask me twenty years ago or even ten years ago I've been outraged by it now one more skeptical.

I mean you use -- Jessica Lynch example and really that was sort of goes both ways right in one hand.

What happened to her was loose tragic and scary and murky and -- claims -- rally that got Jayson Blair fired.

But -- on the other hand.

It's sort of shows the silliness of our our district policy right because she visited and transportation horror just just sort of been -- -- progress -- -- combat and they -- to us.

Captured by the enemy which.

Yeah I did get captured by enemy as -- music field artillery officer another storm I've used him very close the front lines but not close enough weren't any Iraqis were captured you know -- not surrender to wave but not -- -- trying to.

They've got to get there through the -- so that you know I think this is partly a recognition of the fact that the old.

You know concept of front lines of combat and this is where the men are innocent were to women aren't -- infantry isn't this is where is -- is.

It's largely -- downloaded just the way we fight today.

So what you're saying -- with I think it's like 14% -- the united states military.

Is is of the distaff persuasion.

If that's true then we need to address it rational -- so that that corps commanders can make good rights issue is so we did.

We have out there about eighteen years ago we took most superior -- person -- is done all this through -- and you know it is -- going to knew when I can't do.

And it in my -- -- -- -- most of the authority over this up to the sector as fast as they looked.

You know make rational decisions and we basically did scope of the policy this is okay.

You know below the brigade level certain kinds of units women can't serve.

But it brigade headquarters and hire women can serve it became murky than he had -- we've got women now flying fighter jets we have women and submarines we have women flying attack helicopters.

So we have women in direct combat roles and -- for number years.

Yeah but on the other hand.

You know what women are getting taller -- federal data they are.

Not get anything they're still not able to -- I I.

It is yeah I think getting taller and better looking or just -- you that's the question well usually -- saw.

You know I'm making but.

You know that you know if you're if you're carrying 120 pound ruck -- that's hard for a tutor coming out there it's really hard for a 145 I mean I had Ed in the -- at 240 I had -- -- -- Clinton and the truth but.

You know -- if you have a -- you know very fit 120 pound woman.

Barack -- -- -- -- she did is still more than she can cure.

So your point is basically this.

That.

In a perfect world the military would be.

Military commanders would get to make these decisions on -- rational basis.

But what you have is that conservatives say.

No we don't want to gals up on the front lines right and then the liberals say you -- women must be everywhere.

This is that.

It is simply a fact of the matter any and all the armed services that.

The combat role as the news or the ones that are the most advantageous for promotion to the very highest -- to president to make much difference -- -- -- But you know if you wanted to do we're starting -- shoulder just hopeful that -- -- -- force are women in the military now but at both command in the army and air force materiel command.

You know most of the four stars are you know former artillery and armor in -- estrogen drives and an underground services are former fighter bomber pilots.

-- any airports although there again that's nowadays it doesn't much matter air force.

And I guess we'll have women commanding.

There aircraft carriers pretty soon we're not right is that maybe there that this isn't a -- -- -- yeah it's democratic.

But the problem as -- -- citizens do do do Marine Corps to -- weeks ago that they were going to start selectively allow women into combat infantry training.

At the officers -- do the infantry officers theoretically.

Now it hasn't happened yet answers are phasing it -- -- But the question is is how did you do -- -- their refusal women that are like on the US Olympic team you know that have the physical makeup to do -- But there are a few of them right.

And the -- who do not have the physical makeup.

As has been pointed out -- some indignant women.

Here in the game in the in my conversation yeah.

Is that there's funny dudes who can't do to get easily to remember those because we -- world feed a family now all right so we we can you qualified -- lesson in the -- for a little moment with the temperature -- but.

Here yet.

You can just -- -- are you that you and usage general distribution of of of those qualities that are useful for -- Men tend to be you're more likely to receive those -- right.

And that the question is is -- very diplomatically is.

You know how do we make it fair you know for the women who want to do it to -- you compete for it.

But do we keep the standards or do we lower the standards because -- Now you have a quota system you know you've got women -- -- -- all the women but it shouldn't matter should -- shouldn't because the job of the military is to kill people and break -- -- that's the all right so there are a bit and and you know than -- other argument that the other than that though the women make -- hits of this is that a lot of our.

Our existing standards are -- -- right so.

Yeah the army PT tips -- -- is systematic changes since I got -- -- video when I was -- it was a two mile run it was pushups and sit ups.

And you had a hit some threshold ended ended ended personal graduated not based on what you did for a living now based what you're infantry you weren't black or.

But based simply on how -- you -- well yeah but now it doesn't really matter if you can do fifty pushups for example.

Maybe it does maybe it doesn't and I -- as it -- what -- -- -- -- as Hillary Clinton said what difference does it.

Indeed that.

You know they're okay we thank you very church for shedding some light and we also appreciate your mountaineer color Pallet today as we kid we go -- all WVU -- show.

Here's what you say metal -- if woman can carry a dead weight object fifty yards within the timeline then so be it.

Putting them in it merely for the sake that -- -- women is a deadly action safety.

Answer to Marcus says women might be better at -- -- Some some of them there are certainly some ladies I'm not going to that's where if and Billy.

I -- -- testicles with it merely look.

-- Oh really are carpenter you are -- -- okay.

We've got to take a quick break but when we come back we'll get your tweets we'll get your chance -- engage with you and remember the judges coming up later in the show so brace yourself for some -- constitutional.

Excellence.

And stick around.

I'm glad that you're accepting responsibility.

I think that ultimately with your leaving you accept the culpability for the worst tragedy since 9/11.

And I really mean that had -- been president at that time.

And I found that she did not read the cables from Benghazi you did not read the cables from -- Stephens -- relieved you of your post.

I think it's inexcusable.

And that.

Was these junior senator from Kentucky Rand Paul.

Uttering a phrase that sent chills down the spines of Democrats across the nation.

If I -- president.

So get your head around that if you're a Democrat in this is power play.

And so yesterday we saw some interesting exchanges with Hillary Clinton.

We didn't get much substance but I told you we weren't going to get much substance we know that that's how these things -- its -- dance.

Where the members of congress are trying to record sound -- for their hometown television stations to play so that they can say I got really upset -- Hillary Clinton about that thing.

And the people who -- testifying have had months to prepare.

And they have pat answers and Hillary's case the ability to produce high dungeon and outrage.

At any moment that she wants she's really -- that.

So but the question that is actually interest -- as we saw some matchups.

That you might actually get to see again Marco Rubio.

And Hillary Clinton he took a smooth home approach.

But with -- series arch to the eyebrow.

Rainfall with the other way executive partner if he had the chance.

So what did we learn about 2016 from those -- if anything.

-- -- -- just like to come up with silly stuff.

Any -- she's a senior advisor and strategies she's a former senior advisor senator Harry -- she's one of your very favorite guests so welcome back and do you answer plenty who is becoming one of your very favorite guess we're seeing more and more of Sarah these days we like that if -- -- eight GOP strategist.

Everybody that he -- that could mean almost anything -- in your case it means that you.

You don't get Republicans elected and also you work with Mitt Romney and his so those are things that it's not she's just not a big Republican -- the real deal.

-- question.

Hillary Clinton is she gonna run for president please just go ahead and yes just say yeah.

I wish I could AES.

Yeah I would love to have another chance -- to have Hillary become the nominee actually become president and she is an amazing woman and have a great admiration for.

I do think that she is exhausted and you can see in her face you can see it in -- demeanor she is it she has -- as we -- years she's -- she's gonna take some time and she's she needs help.

It tasted it and ask you to take the evaluations -- onstage action must get back into the -- -- has been fighting for twenty years.

Early -- thirty years back we want results but really on the on the front stage here on the national stage last twenty years and it has not been easy to every little you know.

Whether or not it's her -- -- pulled back her hair is an honor and a head -- whether or not it's your past white waters or whatever every -- -- floodwaters.

-- ever.

A -- there's a lot of -- -- that bridge yeah.

Don't she's gonna make that decision I think she's gonna start focusing on more -- -- foundational work and that is the empowerment of women in -- in countries overseas cities -- she's gonna eyes.

There -- clear if you were if you were to deconstruct that -- diagram that sentence we just think that she's going to -- it would be it would.

Well how about this -- Democrats would be totally bummed out if Hillary Clinton.

Who they love and like 82%.

Of them want her to run for president.

She'd be a field clearer in many ways and be like Joseph Biden who right now says he's intoxicated that he is running.

I -- running right now is running but it if HRC got and he'd probably.

Cross support her favorability ratings -- 67% a recent poll that showed I mean she's got an -- I I think if she if she wants it.

And why wouldn't she want that she's been preparing for this for as you said top -- if he did -- bring in 20082000.

You know she ran for senator was successful.

I think this is hers for the taking.

I -- way way way Johnny saves kept on exit trillions seditious.

Says there's a libertarian won't ever be president of this USA.

Don't worry Democrats -- Rand Paul is an interest in human now Sarah -- you don't make that face the Internet will get upset with you.

Rand Paul is an interesting figure because what he's done now take Israel policy apple hears -- he could -- strip Israel now the libertarians are non interventionist.

But he says look it's in Israel's best interest for us to be non interventionist is that they can do whatever they want as it relates to their neighbors -- -- -- etc.

Could you see Rand Paul making a real run for the.

He's really and we probably missing in his father's sisters and his father had a great following -- -- or -- and they are still out there looking searching for that candidates have.

It's in Louisiana is a lot -- were a lot of on some respects them.

And respect -- that I think it'd be interesting to see if he does get into the race in 2016 this crazy pull away from.

That could be if Hillary decides to run.

That could be a great benefit to someone like Hillary Clinton again -- little bit of -- Ross Perot kind of pulling away so low taxes and reefer that's popular even in California.

Yes that is even popular in California right and -- but I.

He -- he's the -- -- the party needs to moderate we saw and did.

Tony twelve cycle he's not a moderate and he only there's Marco Rubio and you're you're correct but I.

The senator says irresponsible things often yesterday.

Just didn't peeping out the attacks -- the worst thing since there were worse than not loving god.

You Lebanon and he did not say that he said we have a right here he says the worst tragedy -- not this time but.

Stimulus elementary.

-- car Virginia attack.

I -- we can go on and I I think that's really your response we can so we can.

We can assume -- to give we'd like to give the benefit of the doubt in this -- -- -- I would say about all the tragedies in Iraq and Afghanistan so yeah tough crowd.

It may be a disaster she's not feeling she's not saying you know you got.

Yeah remote remarks aired on not on team -- But what about -- He he is trying very much right now he's giving speeches he's -- immigration plan.

Cute and you can see very much many in trying to -- he's young he's young and relatively speaking.

He's got a new haircut and he is trying to look a lot more presidential me.

Absolutely and -- deceiving the worst thing that he has going for me is that he is a sitting senator there is still a lot and so he's part of Washington can't really escape that he's not.

He's gonna try to play that outsider he's gonna try to play the bridge builder immigration -- that perfect issue for him.

Obviously not only his own personal story but it's a direction at a moderate direction that I think the Republicans need to be moved -- so.

You know a consensus -- those are good things but.

He's also -- -- four more years of boat getting don't vote counting.

You know I eat moments that he can do the I was with you before I was against you kinda scenario you luckily he's in the minority so he can vote against the process it's a lot easier but he's still gonna happen.

For more -- speed and.

-- Barack Obama did.

Barack Obama did you get it.

-- here you should be happy that here's what the the Internet thanks in this.

This is you're sassy pants -- talking about us.

Rand Paul saying he's not -- is no personality.

And those Ron Paul supporters need to go away.

And it isolationist philosophy with Israel really you can see that -- you are not the by the Internet disagrees with you in large part some of the Internet favorite should we thank you both -- -- everybody you because you're here we thank you for being with us.

And judgment volatile I was up next so stick around.

And that's.

Is what it looked like when house Republicans.

Voted most of them voted to extend the current limit on borrowing.

Not in a dollar amounts but to kick the can down the road until the middle of may.

And this is power play and guess what.

Congress gets a ton of power of the constitution the constitution is crazy for congress the founding fathers.

Didn't visualize the government that was centered on the legislative branch with the executive playing a much smaller role.

But over time the judiciary and the executive branch of gobbled up.

A lot of the authority that congress used to have -- or at least was conceived of having because guess what congressman have to run for office every two years they don't like to do stuff they like to make speeches -- they don't like to do stuff because if you do stuff people get upset with you.

So as a result we have an imbalance of -- go and say it.

We have an imbalanced balance of power in the United States.

You know who knows that to be true who is written on it.

And decried it from the highest -- is the Fox News Channel senior judicial correspondent and your favorite judge Andrew Napolitano what America Chris it was a pleasure thank you okay so how did we get here.

Well it's a long torturous road it begins with the constitution which says.

There's very few times that this word appears in the constitution.

All legislative power here -- granted it's -- it to the congress not some bubble right.

Basically telling the federal government and posterity.

The congress writes the laws the president enforces the laws not just the laws he or she agrees -- -- all the laws.

The courts interpret them.

Over time beginning about a hundred years ago with Woodrow Wilson and theater Roosevelt with the rise of the regulatory state.

The progressive movement correct the federal government begins to regulate aspects.

Of human behavior mainly economic behavior.

And it decides it's easier to do the regulation.

By eight.

Hiring regulators in giving them discretion.

So as you said so eloquently a few months ago the members of congress can give speeches and take credit for but the actual writing and drafting and crafting -- -- regulations will be done by others who are not in the executive branch not on the legislative branch and -- and the judicial branch what are they.

Well -- regulators like the Federal Communications Commission or the food and drug and humiliation.

Heat today the environmental protection administration.

An end because there were appointed by the president confirmed by the senate.

They have some independence.

From the president and the senate.

But they generally -- the president's values about these things so -- the president of the United States for example.

Can't get gun control through the congress he might be able to say to his appointees on the EPA I want you guys to.

Raise the cost of ammunition.

On the theory that bullets are made of lead and -- eventually end up in the earth and it costs us money to clean the earth.

Therefore you're gonna charge money to the manufacturers.

Which will be paid by the ultimate purchaser that would be attacks.

Not enacted by the congress -- lawful under the statutes that created the EPA look at what that EPA could do.

-- mileage of automobiles.

They could if they wanted to.

The -- -- General Motors out of business because they -- a lot of General Motors but they think they could put automobile manufacturers out of business by imposing impossible to meet.

Mileage per gallon standards they could ban fracking.

They could be in drilling offshore drilling there are many many things that over the years the congress has allowed regulators.

To do which really means the president.

That they the congress can take credit for it but not probably.

Judge Andrew -- You quite a phrase and I love it was great and I use it which is legal but not constitutional.

Legal but I thought I can't take credit.

-- -- and I think you give I give and that's that issue you know and tonight's special report look forward to it yeah yeah women in the military in for Charles or is he his team with you were -- here Charles -- and harassment of women as a military home.

And what are the challenges confronting John Kerry is he up to them.

You're going to a Charles judgment I don't think I've ever seen you -- Charles we have great times yeah you're going to leave this IE I got ticket I held him cannot.

Apparently that's I don't really -- seeing what I try yeah.

You know he's he was born candidates it is difficult you know -- -- this is it's it's very difficult to judge will be watching and we thank you -- my pleasure Chris thanks.

Okay now.

Before you get dumped on with Jonathan Hunt which -- know you're looking forward to is what you should how about some power points.

Our points today girl you know it's true.

Yes that of course was the name of Milli Vanilli is greatest hit.

They did that and then rob and fab were found out to be frauds just dancers who lip -- to a song recorded by some German dudes.

No you know what ever who cares that's your first star -- show days.

Did beyoncé lip -- at the national at the the National Anthem at the inauguration.

Maybe she did maybe she didn't in terms of her performance it doesn't really matter she was the once anything so good for her and it was cold and whatever.

But here's the thing.

Government isn't -- now there's always been on there's always been pageantry and there's always been -- but as the founding fathers knew.

You gotta be careful you have to be careful with that stuff because otherwise.

-- -- mental attitude will replace veracity.

You get to a point where the appearances become more important and that's what marks do that's what.

Totalitarian governments do is do a lot of pageantry and a lot of -- And worry about the show so here's your second point.

At least we noticed.

If that was -- if that National Anthem was fake at least it was bakery that America largely notice because it ended up in the entertainment press and those things and people who generally -- out of government.

At least noticed that something phony was going on in the swearing in and it whatever you think about beyoncé and we hope her harmless and that's not cool.

OK so here's your third point.

Nice and need full.

Being honest with Americans whether it's about spending cuts whether it's about.

Real bipartisanship or think bipartisanship.

Whether it's about.

Whether or not programs really are funded or not funded and all of the bakery that goes on.

Is bad.

It's not just nice.

It's not just a nice thing to do to keep it real with the American electorate but it's meaningful because if you keep it up for too long -- people lose faith in these institutions those institutions will lose the power -- -- That's the fact -- Now as we like to do every day we want to leave you with the word.

-- -- -- -- -- And here we are four months after the attack in Libya and we can't speak to the witnesses.

I'm just shocked and nobody asked -- -- pursue that.

And there are a lot of questions of life at that was easy to ask.

And I'm afraid the members of accomplished -- who prefer to ramble on.

And simply didn't ask a very short and direct question like that.
