Is using it as a key weapon in its fight against suspected terrorists.
The critics are saying there are virtually no checks and balances some go as far as to say it gives the president.
A license to -- Others complain the mere fact of the program is in place can be viewed as hypocrisy.
Because the president and his allies have been extremely tough on the enhanced interrogation techniques that -- used by the Bush Administration.

Past African aesthetic correctly -- a chance yet okay fit.
Great to have you here today was as Leonard -- -- has Leo's a busy news -- but we -- to have you in just talk about specifically.
What's at play here.
What would your first thoughts when you learned that this program was in place by the Obama administration and that it could actually target Americans.
Twofold one is it's a great idea anytime we can take a terrorist out doesn't matter to me how we take him out whether we -- up close and -- -- -- whether we.
Him with a -- from you know 20000 feet.
The problem is that we are now targeting Americans there can never be.
A anyone put in a position to have unilateral decision making as the president does now on killing Americans.
You know guys like me and and the men and women of the military and the intelligence agencies over the last 250 years did not do what they did.
To allow a king.
Any king.
In this case to Obama and his -- his guys.
Two again arbitrarily and unilaterally decide who goes on a kill list that can never be we need due process.
And this story.
If you -- -- kill -- terrorist around the world you have my blessing I would -- I would say that most people that know me over the last almost eleven years here on fox no.
That I am to the right of Attila the -- when it comes to protecting national security issues from non Americans when it involves Americans.
We need a whole different set of standards -- who's going to incorporate some standard that people can live with.
Well I think -- we already have the constitution the constitution tells us how we're supposed to two to take care of Americans.
I would tell you that as you and I discussed.
And there are judges like judge an apology on -- are our great friend.
And other fine judges who can be involved in the decision making process on whether or not there is enough evidence to.
To puts them on them on this incredibly serious list you don't wanna be on this list that that authorizes them to kill you.
Obviously.
But but then again when we you know we get back to the interrogation side I am all for waterboarding.
This is not the water -- that many of the critics mistake.
That the Japanese did -- us where they -- tubes down your throat.
Fill you with the water to stand -- and kill you that's not what we're talking about here so so I think the critics of waterboarding.
And other harsh interrogation technique techniques need to understand that we're talking -- get the information.
If it's an American we need to treat them better we need to bring them back.
-- diss them.
And and give them due process really quickly in a few seconds I have left.
What about the notion of hypocrisy here.
-- you do between the White House and the former Bush Administration absolutely it and it's evident if if ever there were a case of hypocrisy this is clearly yet.
Obama can do everything they George Bush today keep us safe and it's okay George Bush did it and of course he was so lampooned.
