-- -- back in session on the docket today a local TV news anchor here in New York becomes the story.

After he is accused of choking and threatening his wife.

Rob Morrison resigning from his job -- -- CBS in New York.

His decision to step down coming just the day after he was charged with triangulation.

Threatening and disorderly conduct all of which he denies.

A judge ordering him to stay at least 100 yards away from his wife also a television personality named Ashley -- she works at CBS money watch.

Now we want to show you a clip from a cooking segment that featured both of this WCBS personalities.

On camera along with some co host who you should know have nothing to do with the couple's current situation just few weeks ago.

Rob and -- are making a dish that they like to make at home and you know loving NRA.

Well the story behind this is the best part of it so tell -- -- yeah.

Mean this is Ashley's only cookbook kgo right pointing that out to get the all the rescue their southern you know lots of -- have -- whatever.

It's -- here it is how it highlighted yum -- ironic and the sooners certainly so it makes Paula dean look like she's got -- huge diocese.

And now -- -- dollar criminal defense attorney and former prosecutor and archive collection defense attorney former prosecutor well.

So mark lay out the prosecution's case against him.

Those who respond to the home after the mother in law calls and when they get there they find her to be credible and believable.

In that she says that he strangled her they do in an alcoholic rage they see on her neck red marks consistent with what she described.

As hand marks to the neck.

And with -- -- placed under arrest and an earshot of law enforcement officers he allegedly explains not I love you honey bunny what I got out we'll get together and and -- he says.

I will kill her when I get out.

-- on top of that Arthur they claim that there is a history of domestic abuse here they claim that.

Did the police -- -- couple Darien Connecticut home before that he was arrested October 17 when he eleven for disorderly conduct in in an incident involving actually.

On January 19 a police officer went their response to another domestic disturbance that he was arrested for allegedly assaulting her 2009 in New York.

I -- is a pattern here according to cops.

Obviously obviously that is something that is a criminal defense attorney when you find out about your client.

It could lead you to question.

The credibility of England -- -- client that.

I will say -- -- usually when I get involved and occasionally like points mug shot.

He's not the one bleeding usually it's the other person who -- bleeding.

He's denying as he has to explain how we got that bloody and he's coming -- what what he's saying is.

He got whacked in the face with the remote control after they watch the movie mystic pizza there I believe.

And then he grabbed her around the -- in self defense.

As she's saying just the opposite that they had to fight after the movie and he grabbed her and she whacked him in the face and her self defense.

It's it's a clear he's he's that she said to be as as candid as -- -- what troubles me more.

In today's cover of the New York Post shows him we have having to -- -- drink.

In a very public play well yes and -- -- apparently he had multiple drinks and he had drinks on Sunday after this Monday -- Mark and I will both tell you that -- this is our client.

You know we're but the earnings -- -- -- personally bringing him to some sort of a rehabilitated.

Presented because you said to be extremely intoxicated the night of the incident taunting the cops coughing that -- calling them officer.

Blank bag.

To sync make -- -- the -- tighter and then saying to the cops according to the police I can't go home tonight because I will asking kill her.

So there's clearly -- an alcohol issue here but his defense.

Is it is a unique one.

And we'll talk about it right after this break stay with us.

-- so -- but he is apparently getting ready to claim that she has been abusing him for years.

And saying it.

Yes the reporter have you ever heard of a syndrome involving men being beaten by women now the seven incidents at the New York apartment for -- -- -- Connecticut.

He was the one who called the police in one she called and six others but.

How does the state prove that he instigated this.

-- -- Honest with you I say yeah that's possible a woman can -- a man I've used it myself in defending certain people.

It is rare it's usually not the case.

And what he would still have to be able to show because the evidence is consistent with him putting its hands on her throat because the cops saw evidence consistent with that.

Is that he reasonably feared death -- great bodily harm.

Wall she was doing some physical activity reports -- -- apparently saw only come on and I -- he's put his arms around her neck because of that reason.

I don't disagree that it did that -- -- around someone's neck you can put your arms around somebody's neck and squeeze because they -- the remote that you are that doesn't -- I had there.

She didn't just throw the remote control and he's clearly bleeding from the nose he's clearly really leading from the lip he allowed to put his hand around and that is -- which we've got to push -- -- The -- she would be allowed to do the same.

Think he's a 180 pounds she's 115 pounds.

I will say this I will save -- the police say she refused to -- -- -- statement against him would not eleven to photograph the red marks on her neck they say it's because she was so distressed and visibly shaken.

We see this all the time in abused women cases I'm not jumping to a conclusion that she necessarily is one despite the evidence.

But that they they are too afraid to actually follow.

-- with the criminal complaint mark.

That is correct.

Or her and I'll make the argument for Arthur may be she realizes she did something wrong and doesn't want to do I think.

I don't see it I see it more consistent with someone that there's little I -- over and over.

Our third the police have been to the house seven times next time she has been forced to call a match -- the other times they didn't call and here's the other thing about prosecutor.

I moved to revoke his bail immediately what are the promises he made to the court as a condition of release was nobody really not right to have it -- -- -- -- there.

But that would that -- vision was over at some point look read you the truth is is this is a couple.

That is that this is not typical thank god that that link of the history one way the other somebody needed to have interceded somewhere along the way.

So either of these on how we integrate the alcohol but are great on both sides now yes definitely did that -- example --
