-- and now the guns.

Some states are moving to protect the Second Amendment while others are looking to chip away at at.

Texas State representative -- bleached joins us from Dallas -- New York State assemblyman Felix Ortiz from New York joins me here in studio.

Representative Leach now you mentioned just a bill to give Texans a tax break the purchase of firearms why.

Well good evening judge it's great to be with you -- filed Texas house bill 1533.

The Texas gun ownership reinforcement act in response to the federal government's overreach and intrusion on our second amendment rights and what.

This act will do -- make Texas Independence Day which we celebrate every march 2 actually.

A tax free holiday for the purchase of guns and ammunition in the state of Texas and this is in response to this overreach from the federal government.

We believe the Texans should be supporting.

Lawful and responsible gun ownership and taking the lead on these issues nationwide.

All right an assemblyman Ortiz I mean you know you've taken it to a different kind taxing the people who own guns should have to buy liability insurance why.

Well it's very important also that that as the provision that if they have I would -- them -- moderation I think it's important to protect them they'd they'd gone owners.

-- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- They -- view of the victims dust banks suffer from someone who neglected that they can they gonna -- from the owners and and kill somebody.

And let me keep my understand is so -- legal gun owner and somebody steals my gun and kill somebody else if -- -- insurance then what that means is that.

The person who got shot by somebody stole my gotten -- then to recover from many.

Well that day Indy below will have to look through a process that's you know you Josh -- and -- throughout the repulsive sort of the same token we will have to investigate whether or not they -- they going -- and what was responsible -- neglected.

Depending a weird angle and force.

But -- a utility.

How many people do you think are actually injured by guns that are stolen from legal gun owners.

Well we have we have phone -- side they -- from the federal government in Kabul are 175 billion dollars got to spend it suspended after -- although fog on violence.

And I think it's very act are critical to what is happening in our country to move -- that is going on so what do.

Helping illegal gun owner who kills someone you know is that the legal guys have to -- -- -- -- many guns as I'm sure you know.

All but at the same time you know big guys and the Southside of Chicago or -- people left and right they don't have insurance those victims don't have the ability to recover.

Well they're still you know gosh yes there will to have to pay the price but the question here is how they how he got that with that gone and he got Dag gone after -- -- -- -- one -- wasn't responsible.

Out to secure gbagbo and be in that.

Robert -- isolated event in the -- all right let me go to represented at least what do you think of what assemblyman Ortiz is saying that gun -- -- have to have -- million dollar -- insurance policy.

Well with all -- respect to my friend from New York I don't see anywhere in the United States constitution where this is required.

The Second Amendment of the constitution requires us to freedom the right to bear arms it's black and white the constitution is not a guidebook or suggestion book it's the rule book.

And so we should as publicly elected officials.

In reverence to the constitution stand up for our constitutional rights and push back when people try to infringe on those rights.

I just simply disagree I mean it's it's in the constitution the do you think -- -- that that these Second Amendment requires us to have this liability insurance well I would.

I would say that put it this way I think if this thing at public safety issues are quite a flight feature I think it's important.

That's something we can have legislator back and challenge just like an amendment and he just to protect our our people -- -- -- well.

Eight you know what ended the same time not represented of -- Sammy do you believe that.

There are these I'll -- these issues regarding -- guns aware there are problems.

For innocent victims who need to have the ability to recover.

Well look at -- mind my bill is solely intended to encourage and support lawful and responsible gun ownership.

Gun owners need to know nationwide and especially in Texas.

That we support lawful gun ownership in that we support constitutional rights and what we've seen judge nationwide.

-- states such as Wisconsin and Oklahoma and certainly Texas is legislators take more of a defense of sense to proud position to preserve and protect our constitutional rights.

The bill -- filed as more of an offensive bill -- that it actually goes a step further to encourage lawful gun ownership and that's what we need to be about is protecting and preserving the constitution.

All right and final question assemblyman Ortiz having you've admitted that he basically chipping away the Second Amendment do you have a problem with the Second Amendment do you think it needs to be cut back.

I don't have a problem with a Second Amendment what I have it probably means waiting to be able what is responsible and the and and that go on our own.

Bonds and they are not and they do -- they don't they don't put it into the -- in this safe deposit place.

Where are these -- -- getting them so.

But you know one assemblyman I'd be curious to know the percentage of injuries are caused by guns that are not a safe place.

As opposed to the number of injuries caused by legal gun owners anyway -- -- representative -- assemblyman Ortiz from New York thank you both for being with us this evening -- you thank artists coming.
