You know what -- was coming.
With certain community that's where you have to look -- you can't be worried about political correctness.
With respect to whether we are doing enough in the Muslim community I think we should take a look at that but.
I don't think we need to go and develop some real disdain -- hatred on television about it.
That was a bit of that back and forth between Peter King he's a Republican congressman formally only the homeland security committee.
From of Long Island New York.
And that was Dianne Feinstein she's a Democrat she's a senator she's ahead of the intelligence committee in the senate they were both on FOX News Sunday with Chris Wallace and this.
His power play and I am Chris tire walls.
Welcome and happy Monday it's a beautiful day here in Washington.
As blame recriminations and finger pointing and everything else that you expect to drive from an incident.
-- national tragedy and then victory.
Making their way just as you would expect.
Through Washington DC.
We will talk about the aftermath of what happened in Boston we will do that we will talk about it specifically as it relates to a deal on immigration.
Sure sure it -- to -- And we will also talk about.
What's these lines Internet between protecting you.
From foreign attackers and also letting you look at kept pictures or whatever else whatever else -- -- you like to do.
I would that the government snooping -- -- -- have an expert on the subject or at least a lobbyist on the subject.
We will do all of that today.
But we are very lucky because.
Is good and our personnel is better Steve -- he is it senior writer at the weekly standard he has -- Fox News contributor.
One of the smartest pieces.
On the subject he -- these called don't.
Rule out any thing.
In which brother -- talk that what president had to say.
Once the arrests were made in Boston for the arrest was made in Boston.
About not let's don't jump to any conclusions.
Don't rule anything in or out right now welcome brother it's safe because -- -- so.
You -- uninteresting it parallel that I had not.
Constructed until I've stolen from him which is.
You have the attacks and Ben -- In which.
The president said well this is not terrorism this was a spontaneous demonstration.
This is not a planned terrorist acts the Fort Hood shootings which we know is the only.
Large successful large scale terrorist attack in the United States killed a dozen.
Servicemen and women ready to deploy for Afghanistan and one civilian back in Texas that is still judged to be workplace shooting is you're leisure guests that.
That this will not be classified as a terrorist act.
Well I would be surprised -- that I mean there aren't even small indications that the administration seems to be.
Learning its lessons however -- -- incrementally and however belatedly.
For instance they have not yet read them Miranda warnings to.
The remaining suspect that the suspect who survived that fight that it's too hard -- -- -- Which is not what they did back in December of 2009 when we had the year attempted airplane bombing and we got arrested Umar Farouk -- -- -- He was interrogated for about fifteen minutes and then read his Miranda rights and then basically stop talking.
We didn't make that mistake this time and apparently word went out to local and law enforcement officials and the FBI in advance do not read him his -- he -- not be read his rights that's an improvement.
Tom and I think you know the president said the -- in his statement late Friday night that we will.
Look at any in all associations.
That these Brothers may have had.
It doesn't sound like -- big deal but it's important that he said that I think because too often in the past as you mentioned whether it's Christmas Day whether it's Fort Hood.
Whether it's been Gaza you can go back and look at the Times Square bombing Janet -- time of the day after the attacks that it was a one off attack.
And the administration who -- any idea that that Faisal Shahzad who who tried to blow this SUV.
Links to a -- -- -- -- the Times Square bomber and he links to overseas terrorist groups despite the fact that the Pakistani talent have already claimed.
Credit for that attack at the time and -- -- a week later Eric Holder had to say yes in fact -- one.
Financed plan and directed this attack so.
Baby steps but I think there's been some improvement it remains to be seen how much.
Okay big baby steps now there's an interesting discussion having -- on the right side of things which is.
Basically it's this and what's the threshold point.
We're used box where you -- -- -- -- rights is an American citizen.
And become an enemy combatant so right now we're operating in that great -- And as this suspect is in the house it's not like he's going anywhere correct so he hasn't been booked he hasn't been processed in any way he's been talked to right.
But he did he hasn't the prop -- the the -- prudential process.
Military or civilian or or any kind is not a current.
So the discussion -- happening on the right has to do with what's your threshold point when you ceased to.
Be afforded the rights of an American citizen right and start to be treated as an enemy combatant.
You've heard from people like Lindsey Graham and others that say meets the threshold.
This -- and he was in Russia he talk to an offshoot group of al-Qaeda.
He's -- this guy should be in a military tribunal then you hear from other people.
And more libertarian wing of the party that say hey wait a minute.
If we make this the threshold point for surrender your name your constitutional rights as a citizen.
It think this could bring down to do to the disadvantage of of people for generations whereas -- -- play out.
I don't think that we know enough frankly to know whether it is very specific definition of who qualifies and it as an enemy combatant under the original a human half.
The authors of the military authorization back -- in 2001.
He ended it we don't know whether he was actually whether we can say that he was fighting for al-Qaeda had these connections to al-Qaeda there are suggestive.
Reports that he may well have but we don't know enough yet I would say we should do everything as -- government.
To preserve the the opportunity to interrogate him at length without a lawyer present now you can do that it to a certain extent under this.
Public safety exception under the Miranda warnings which the Obama administration as we discussed is now doing they're saying we are going to talk him without a lawyer present.
So that we can establish whether there are additional devices that made -- -- and follow on attacks connections to other terrorists.
But that's a limit you can't do that forever.
So the people who are arguing that we should classify him as an enemy combatants are not doing so those so that we can one day -- and a military commission I don't know anybody who's making that argument basically wanna preserve the right to question him.
For an extended period of time as we learn more if we learn difference is -- -- on concern I have was in Chechnya and but had some military training.
Does Joseph Marcel and I know about that and if so what does he know who was -- Who -- brother meeting with.
We want to we want answers to those questions.
Because it helps fill in the intelligence picture around these attacks and could prevent future attacks -- limbo is okay for.
I think limbo is the best thing for now until we know more and -- that's that I think is the goal of people who are making the enemy combatant -- you're hearing a lot of people pushing back on the enemy combatant argument saying.
Our courts have successfully prosecuted terrorists over all of these years that is beside -- -- it's true to a certain extent.
But it's but it's also very much decided when nobody's arguing for him for military commissions.
I've except crowd of just take the position sites and the the on the left though there's not much discussion.
There were many who -- many some.
We know of that hope that it would be.
Somebody who's demographic profile was a lot more like mind.
As many as accurate yet there was a -- urgency of hope.
That the that the that the suspects would match the demographic profile.
The hillbilly firewall from whence I derived and not.
Be from -- -- Caucasian.
But not that kind of Caucasian.
Does this does this have a material effect do you think eventually on the way Americans think about terrorism and think about this war.
You know it may I think I think it adds to the case that that you know -- we can't hide from the fact that.
Radical Islamic terrorists want to kill us period.
And and it appears certainly that general concern I have was one of those by all of the Internet postings that he had the exchange that he had the things that he said the fights that he got and it is mosque and we need to be very clear about that I think that's one of the concerns that people have about the Obama administration at this point.
Is that they're not willing to say that derivatives is hearing this is back and I think may of 2010 where Eric Holder had an exchange with the Republican.
On the Judiciary Committee who was -- it was basically just trying to get him to use the phrase radical Islamic -- if for two minutes holder refused to say it.
We can't refuse to say that if that's what it is.
We're both we and nor can we refused to say that you know stuff and you've written an excellent piece and really recommend I really recommended to human.
I recommended -- almost as much as the next congress to take anything but it is about.
Four news stories you might of -- why you were either celebrating cowering in fear whatever you were doing.
During the manhunt and everything in Boston so if you follow me at -- -- -- You can have all of that it will be it will it will lighten your -- -- them.
Will make you long term pessimistic but it will lighten your -- for today so do that.
-- -- points as this my question from Friday sir we weren't on the air because it was the thing.
And have my questions from Friday's close threes the other had to go back to Russia no one asked that question nor -- that we submit this brother -- the point.
If you've seen any interviews with with the believe the mother of these suspects he may have had recent beyond cultural affinity or wishing to die in Russia afford going back.
I'll just leave it -- that OK we're gonna take a quick break and when we come back.
We will have a good discussion here about what's going on with immigration with -- -- he is a Democrat who has been telling the Republicans that if they miss.
The ball on this when they could find themselves in big trouble so what's gonna happen happen now so we'll talk to him stick around.
It was New York senator Chuck Schumer he's a Democrat of course and he was on CNN's state of the union and this is power -- And what senator Schumer was arguing there was that those people who say that -- -- These suspects in the Boston bombing.
More impact immigrants legally he.
To the United States.
That the immigrant -- -- -- broad spectrum changes to immigration laws enforcement everything else.
Should be called into question that those people on because this law actually tough and -- out.
But perception is a bunker for.
Senator Schumer and the other seven members of so called gang today.
How would this really play out how will this really affect the discussions you know who knows -- don't -- he knows not only because.
He's a democratic pollster who has worked for many including.
Not only because he is a contributor to the juggernaut that is the Fox News Channel but also because he is.
One of the hosts of political insiders which what's right here welcome -- -- good to see your current.
It all right.
You were -- were to double shift today we create we appreciate we appreciate your forbearance.
But I want to ask you how the politics of this really gonna play -- while there was a go ahead.
No way am I mean good sir no -- -- -- I I and I think it's worded moment of game changing here.
You know I think that.
One of the problems we have is they're two -- are too political problems at all.
And and let me just put it in contextual bit.
I think the president in the administration mainstream media and the basically the hard left -- -- my party.
He's got a problem because it is stuck its head in the sand forever.
The president won't use the words Muslim or Islamic extremists they've done everything they can -- downplay.
Including firing FBI agents to.
You know we're not care doesn't care of the arm of the Muslim -- -- -- things are sufficiently sensitive taking out to stop in the training manuals all this problem.
We have a situation where the immigration bill now runs up to -- problems.
Couple weeks ago the the Republican members were leaking -- to make this bill sound top.
It is clear now that the Democrats or more to god.
Their fair share apparently out of this bill she would in fact allow trains -- people you know that.
They -- the anchor system have people come into the country.
Who are relatives of people who were put on a legal path.
It is this is -- that is a political problem -- -- This game changing in Boston.
Is about an immigration policy.
-- yes you were -- senator Schumer right.
These people are legal the questions what are we doing here we are allowing people.
A group of people we've never purposely allowed immigration.
Of people who come to America -- aspired to be.
The American citizens not just fire in the land of opportunity but come here.
But with a basic ideological religious ideology of hatred and warning to kill the United States or development here.
We have all of this community stuff.
We have -- that a leak that does not when Peter King had his hearings on Homeland Security whether infant terrorism it was under great attack.
Three and a half to one people said they should -- want they were not a threat.
But our immigration system seems to be we can't keep track of anyone.
I think this is a game changer because we need to look at all of the aspects in boosting the borders.
The notion of people believe that we shouldn't have borders that we really should lead and everybody and we should be nice.
I think that that will be pad is the idea of pollution and sell pollution may have crumbled.
We'll see how this plays out there will be an effort that you pointed out your conversation with Steve -- Look they didn't mean to me they're going to try to suppress -- to make this no big deal.
But I'm afraid everything that's coming out is only adding to -- to the point as long as it comes out.
That this is more serious and we better rethink everything and that's not -- Now if -- do was.
Moving slightly off immigration that if this if the discussion becomes about and and this is a sort of an alarming realization that is spreading across the country.
About the new normal that the new normal -- That if you have that that this may be what life is like that there are bombings.
That there are much like people experienced in Britain much like people and the IRA days but I -- continue to experience in Israel that this could be it a horror.
Of American life how does that social psychology work itself out.
Well I think in America it becomes look the American people -- had common sense and vast majorities.
We're doing system for doing you know what I call the common sense -- We want to do something about the immigration thing they want secure borders they want security.
They have always been -- since the days -- the ground zero mosque and since 2001.
There is a huge super super majority.
About Islamic terrorist wanna hurt us in -- In fact a majority of Muslim Americans in the pew poll said they worry about.
Muslim extremists in this country doing -- match.
This is not but we have this -- didn't say -- we just say it isn't true.
And I think the tiny steps the administration has done look they have let me be brutal about -- -- have covered up being gauzy.
It's the same the -- -- last September 11 when didn't -- when the young man to marry got his citizenship.
You know they've been covering that up successfully so far with the aid of the mainstream media I don't know that I believe that this administration.
Will actually get to the bottom of this or wants -- or will not do.
-- -- -- -- Make a deal and try to make this go away as they did with the underwear bomber what what some.
Problem is is that there are being at people who care about national security and Homeland Security.
Who have been.
Who have had no boys who've been round operas every year.
This is their moment to -- to national agenda probably the Republican Party which is a natural opponents in the in the and supposedly for a strong national bank.
Is -- that the stupid party is unable to mount a narrative on anything.
So this is the question Lindsey Graham -- tell you this immigration bill and what's coming out.
And all of this in his defense of the FBI today about the trip from Russia because of the -- like how about his passport.
You don't this guy is down 44% in South Carolina you can lose -- seat -- sure -- But that we will never lose our affinity for -- these insights that you provide us so we thank you thank great.
Thank you I had a great -- -- Internet but let's talk about you shall wait.
Let's talk about.
Regulations have you let's talk about keeping you safe but also looking at what people may be looking at -- you.
Will do all that when we come back so stick around.
So many civil libertarians have probably pretty much everything.
So they've got a they've got a problem that they can.
That was my -- congressman Mike Rodgers talking to Brett -- Back on Wednesday he was there are talking -- civil libertarians -- I expect cameras.
Being all over the place so that the government could know who was blowing stuff tough.
And this is power play and welcome back now that argument certainly applies to discussion that we've been having in the wake of Boston -- V8.
Surveillance and all of this stuff and you're -- insurance and what have you but the same argument is taking place on -- Internet.
As we talk about what's necessary to keep the Internet safe vs what is necessary.
To -- the -- and -- -- those two things -- so we thought we might give you little insight on that so we offer you Internet Michael -- -- he is the president and CEO of the Internet association which is an industry group on behalf of the Internet -- -- Internet with mostly providers.
Word describe your group yeah we represented interest of Americans America's leading Internet company's global companies.
On the provide services to businesses and individuals OK so this would be Google FaceBook eBay Amazon Yahoo! that kind of stuff.
That kind of stuff usually didn't you know that you've you've heard of them you've heard of those people those.
The Lincoln I don't know right to the question is this.
Republicans to pass out of the house but what they say is is it legislation that will not interfere with -- privacy of individuals as they live their cyber lives.
But will protect the United States from hostile attacks.
Against our Internet infrastructure.
It's bound for the senate but civil libertarians do have some concerns -- and they say that this does open some doors.
Two things like.
Internet kill switches and other things what's the reality from your point -- The reality is that -- securities very serious issue will continue be serious issue.
And our company's take a backseat known when it comes to protecting networks and could protecting users from.
Cyber attacks will continue to do so it's important to offer companies there until we also take the prime series is very seriously and don't make sure that.
Whatever legislation goes to complete -- process protects our users.
What has often been pointed out in this discussion is that.
You guys don't only not take a backseat to anyone you are the only -- that when it comes to the security of the Internet we are basically reliant on.
Private the private sector for for making sure that our financial system for example doesn't crater tomorrow because of -- cyber attack right yeah.
You guys do the work.
Yeah our company's -- some of the dressed in Destin and brightest minds some of engineers at these companies and their.
Work and this 24 hours a day to make sure the networks are safe and -- you know new information is protected.
Okay right now what about.
He has don't have an official position on the Republican -- you know Rumsfeld wee we wanna make sure to watch him watching crossings out there watching us now what are you watching the process.
As relates to taxes.
Taxes on Internet that is that is coming up in the senate this week.
And with apologies to everybody who -- emailed me on this subject.
This basically and let me see if I can summon an explanation -- You're supposed to already pay taxes on purchases that you make on the Internet but you're not doing it because nobody's forcing -- is that about the size of what this business that's -- that's -- -- -- -- recitation probably have you all taken a position on this that we have not -- we have companies on both sides of the issues that we didn't election.
Does it look does it look does this look like something that's that's going to pass it seems like an in house Republicans passed anything with the word tax and it is a longshot right now.
That makes it difficult probably this probably makes it difficult.
Well we appreciate.
You're cautious but first vacation -- point -- -- -- today we thank you we thank you for making time for us.
No power points today because I wanted to do this to you and for you Internet -- tell you.
Followed not into everything just on Twitter I'm not asking you to go very far and asking for you just go over and follow me at -- -- wanna put it is I need at 101000 followers.
Because otherwise I don't know what's gonna happen like I'm definitely.
Not gonna do hunger strike because that would take too long if you were made but I will tell you I'm gonna be really sad if you don't commute and that's so please do that that's act cease tire wall.
These engaged in that activity right now no Charles because it's Monday.
And by the way.
I'm going to be away from new Internet for the rest of this week it's not because I don't love you -- it's because the little power plays -- some attending to.
So I'll be doing that that you'll have a great hosts filling in for me next month lovely colleagues -- charities in.
Filling in for Jonathan on -- -- to stick around for that and -- -- on the upside.
