Earlier last month joining me now Alan Dershowitz.

-- it's great to see you again so now we're being told that week we should expect obstruction of justice and lying to investigators charges we'll know for sure momentarily.
But your thoughts on what we've seen so far.
Well I think we learned several things from these charges number one it again confirms that this was not plan.
Where there was an escape thought through.
The bombers and particularly the young bomber who survived.
Needed to make calls to friends in his dorm to get rid of evidence that shows the lack of careful planning.
It also seems to show that the government doesn't have any proof that these three new guys.
Had any knowledge or information prior to the bombing or during the bombing.
And so what we're talking about is a cover up basically.
And what the government will have proven I think they'll have no problem doing it.
Is that these three knew or should have known when they -- -- get rid of computers.
That they or obstructing justice.
Also they've been charged apparently was lying to federal -- that's the easiest case to make because there's no trance graft.
There is no warning.
There's -- no -- If you just say anything to government agent that's a -- you're guilty of a crime.
Now what we don't know is whether the government's really it isn't going after the history.
Or really squeezing them in order to get as much information as possible about.
Two bombers and whether or not.
They can give them any leads to weather the bombers knew when he thing.
Or whether the bombers -- contact with anybody in Russia about the bombing itself that's -- we don't know.
-- you know it's it's hard to understand.
As a as a law abiding citizen why you would you know allegedly take a phone call from from your sweet meet.
Saying get rid of my computer which is you know where we expect the feds are going with this on the night that they have plastered his picture all over at the national airwaves.
It as a suspect in the Boston Marathon bombing and and for you to say all right I'll do that.
And -- could there be more charges coming against these two guys if they knowingly assisted some when they believed was -- was a suspect in the in the bombings.
Yeah they could be charged where it.
Accessory after the fact.
And that way hooked in a little bit more to the conspiracy itself but I don't think on the basis of what we now know.
There's enough to make them co conspirators.
In the bombing that that would be very seriousness of your co conspirator in the bombing.
You are responsible.
For the deaths and you can be.
I essentially found guilty of murder but -- accessory after the fact.
You're not responsible for any of the -- that proceeded it.
But both your moral and criminal guilt is very considerable if you help people knowing.
That they were trying to avoid justice for having killed and injured so many people.

And whether we're gonna see federal public defender step in one of them at least has a private attorney we believe two of them have private attorneys we don't know about the third ballot that up with you.

Obstruction of justice possibly lying to investigators as well Alan Dershowitz continues -- As our guest the lawyer for one of these suspects and I believe it's the man who was ejected from the university who is no longer I should say a student at the university.
I had spoken out on this matter before before today saying.
That that these guys are shocked or horrified they can't -- something like this.
And said that they did not see -- Joseph -- -- may have in the days before or after.
The bombing I mean does that tell us anything about what the likely defense here is going to be.
Well I think that.
The lawyers have to have a chance to confer with their clients and find out the truth I mean one -- allegations is that they may have -- Two federal authorities about whether they did or didn't see them very likely they may have lied to their lawyers well so.
We have to get to the truth to this now.
One of them -- -- has a private lawyer.
None of the three can have the federal public defender because their conflict that out they have a conflict -- ready representing.
The alleged bomber and there might be one testifying against the other.
We don't know whether these other two have enough money to hire their own lawyers or whether -- have to be.
I think their basic defense is gonna have to be if it's true.
That they didn't know these with the bombers at the time they dispose of the material that's going to be very very hard for jury to swallow.
And as far as the false statements are concerned they're gonna have to basically claim.
They didn't realize there -- false or they were not really falls.
I doubt this case will eventually go to trial.
I suspect that they will use these indictments to squeeze these defendants into providing as much information as possible.
Deport the two who are not citizens and probably make a plea bargain with the one it was a citizen.
