Now a number of small business owners are joining back to fight back against a federal regulation they say could destroy their bottom line that means.
There's a brand new legal challenge to obamacare it's been filed.
The business owners say it's all 'cause of an IRS regulation tied to the new health care law.
Well the Competitive Enterprise Institute is coordinating the lawsuit against the IRS their General Counsel -- Katzman joins us along.

I see about what you give us a little bit of understand this new IRS regulation they have the power as an agency to write regulations haven't lost -- with this one about.
Art under the Obama care statute that congress passed states have the option of setting up their own health insurance exchanges.
33 states have decided not to do that and they decided that because they -- to avoid -- incredibly costly.
Employer mandate and also the expanded version of the individual mandate.
The Obama administration did not like the fact that opting out was so popular.
And so they had America's the most popular agency namely the IRS -- regulation.
That really undercuts this choice by 33 states.
That regulation our view is flatly illegal and that's -- were -- in court.
So it basically says.
-- -- said we don't like with these states -- we don't like to be employers have different options because those states opted out so we use -- regulation to get to them.
Where they are opting out.
Got them out of our reach at least Timberlake.
Jacqueline what would it mean for businesses if they are scooped up into the -- regulation are we talking about fines are we talking about you know -- they can hire they can't hire.
And it -- -- all of that.
Really an -- but the first thing if -- -- gonna have this enormous individual mandate.
Health insurance mandate that's going to be put on us on an individual consultancy.
But for me it's so costly and burdensome that it's really gonna hurt me financially I can't time.
I already have health insurance I don't -- buy their costly health insurance I don't understand why would half.
And my state -- kind enough not to set up an exchange and I liked it live under the laws of the state of Virginia.
So for one thing we're gonna have huge health care.
And if we find that we cannot pay for them they will be fine.
A huge fine say either way you're looking at a huge financial punitive damage.
Situation and at a time when the economy it's really not doing so well as -- now.

-- people understand how much power these federal agencies had you know the law was written a certain way I passed the Supreme Court.
And but when it comes to writing the regulations and spelling out exactly how the law's going to be implemented it seems like the IRS's using -- -- essentially under the law didn't -- Exactly you have to remember -- -- -- he said we have to pass -- -- -- to find out what's in it and unfortunately we are now in the process of finding out what's in it and it is.
Not put in terms of the economy the application of the employer mandate to these 33 states we call these refused -- states they've refused to participate.
The application of the mandate to -- this one -- is probably the primary reason why many employees are having their hours cut back to below thirty hours a week in order to keep them under the category -- full time employees.
This is an incredible disincentive to keeping people employed.
And tackling of the you do a lot of work in the health arena with companies that are touched by this.
It do you think as the lawn now rolls out even the people who voted are sometimes surprised at the -- it's having ads.

I find that one more incredible story about how it's impacting them they're having to not expand their business they're having to pull back they're having to fire people -- one.
