Authorities there accuse her of trying to smuggle twelve and a half pounds of marijuana across the -- think about it six kilos.
Her family is pleading for her release insisting that somebody has framed her.
The woman and her husband say they were returning to Arizona from a funeral last week when soldiers search their -- At a military checkpoint about ninety miles from the border.
A spokeswoman for the Mexican army says the soldiers reported finding the marijuana underneath the woman seat take to the top of the seat.
Family members say they believe somebody else was trying to smuggle the drugs listen.
Leaving her daughter not be -- -- my mom.
It's a night where you can't wake up front -- come home.
When -- heard from groups even if.
The woman was born in Mexico but became a US citizen seventeen years ago she and her husband have seven children.
And the husband says authorities originally demanded 5000 dollars for his wife's release.
And that we should know by Friday whether or not she will stand trial.
Andrew has been as a reporter -- fox station in Phoenix he is live now at the border in Nogales Arizona -- what are the details of the accusations exact.
-- Trace the formal accusation is drug smuggling into Mexico that carries a penalty of ten years in prison.
Today in court just across the border here -- -- Dallas we're expected to hear from a couple members of the Mexican military is at the people who made the stop.
In Hermosillo Mexico they ordered everybody off the bus and then they claim that they found twelve pounds of marijuana.
Under this 42 year old mother seat that was strapped to the bottom of her seat.
With bungee cords her attorney her US attorney who's helping out with -- Mexican attorney -- -- -- some of the pictures of this.
And he called all of the accusations preposterous he said in America if something like this happened if lawyers presented.
This kind of evidence an American and American courtroom.
They'd be laughed out take a listen what he told us.
We've gone through all of the pleadings that they provided -- us.
And they have allegations that she actually -- to use the word colluded with that with the driver of the bus is just seems preposterous because.
They're the last ones to -- -- last was to some of us.
And it's a question is empty -- something we've realizes if you get arrested -- detained.
And I share some -- -- outside -- not your your really at the women the system.
And keep in mind you're talking about a 42 year old mother who's raising seven children she's been married for about a year -- her husband who's fighting on the other side of the border.
As we speak.
And those Mexican military officials who stopped -- they were ordered to appear in court today the Trace a big question is whether or not they're actually gonna show up.
Despite being ordered to be here.
And another big question -- as a what are the mothers options exactly down there.
Yeah unfortunately you know if if things don't go her way it could turn out to be very bad as I mentioned she's facing ten years in prison.
So the judge has the option to either throw this whole case out.
Or say it should go to trial if it goes to trial that she could sit in a Mexican jail for a couple of months before she.
Actually gets to be in front of a judge and let the process go forward that is a nightmare scenario for this family.
And traced just to give you an idea what it's like inside the woman's prison.
On the Mexican side of the border here -- -- members minutes ago came by here they had -- cops forks knives they bought at a local store.
Apparently in the jail in Mexico they don't provide those kinds of things for the prisoners the family members are supposed to do that and so they're bringing those basic necessities to her.
Across the border.
-- the conditions are less than great Andrew has been from our fox affiliate KS -- live for is in no gallons Arizona Andrew thank you.
Let's get more now on the case in the mother's legal options right what does she do Heather Hanson is a criminal.
Defense attorney look other I've been in Mexico many times have gotten pulled over at one time -- did not thing and if you don't got a hundred bucks you're going to jail luckily I had a hundred bucks but.
You know she didn't carry six kilos of pot onto the bus and taken to the underside of the seem -- get no evidence and yet she could be in jail for months and months.
Well that's that's it right -- what you said is correct to Mexico has the highest rates of -- of Americans other than America in the world -- they have more American prisoners -- then.
Anyone else in the world other than America.
And the interesting thing is in Mexico you're actually guilty until proven innocent.
So she's really climbing up -- topped wall here it's going to be it's going to be a tough fight for her.
And I don't think people understand -- that in Mexico what happens in the court is that they give all the testimony and then you have the prosecutors and defense attorneys kind of looking over the court reporter shoulder she types of -- up handed to the judge the judge reads it and then makes is.
Decision and that could take several more days.
Well that's exactly right what -- I think the smartest thing that the family has done here is brought the media into the case.
You know you guys have covered back in December.
A marine who was arrested in Mexico for possession of a firearm and until the media gotten involved.
That -- he languished in prison for five months -- she's been imprisoned a week she's got senators on her side -- the State Department walking watching out for her and I think that's gonna make a big difference because as you just stated -- the system is definitely so different from the American system.
And very difficult for us to traverse so it's very helpful to have the State Department involved.
Very quickly Heather I mean -- is it helpful for her to have attorneys on this side of the border helping or is it just no use at all.
I think it's definitely helpful the more the more eyes looking at this the more people involved with this the better.
You know again the good thing as with all of this media attention the judge is going to have to be very careful to do everything by the book and that's -- there's -- question of whether it's been done by the book.
So it's it's definitely going to be helpful to have more people involved hopefully -- get some good news on Friday.
Yet good -- vice Heather -- criminal defense attorney Heather good -- thank you appreciate it thank you.
Would you should know by the way they said that Jeff flake that the senator from Arizona was involved in this he really is trying to work this side of the border but right now.
Without the Mexican embassies help there's not a whole lot they can do.
