Also the special studio audience edition of Hannity and tonight we're joined by a group of great Americans most of whom have been unfairly targeted by the IRS because of -- association with various conservative organizations now.
Coming up you're gonna hear their stories about what they have gone through also -- here from the attorneys that are representing their respective groups spoke first.
One of the most fascinating things to watch over the past few weeks has been the ever changing timeline of who knew what when.
And where about the -- of scandal at first nobody seemed to know anything about it but as the days go by while that seems to be evolving quite a bit watch this.
Can you give us assurances that the IRS is not targeting.
Particular groups based on political leanings yes I can give you assurances there's absolutely no targeting.
They added the names and party and patriots for the -- Please visit should be centralize -- group.
I first learned about it from the same news reports that I think most people.
Learn about this I think it was on Friday I've reviewed the Treasury Department watchdog report and -- misconduct.
That -- cover.
Upstarts are not going to be able into -- don't know the details -- I frankly was unaware of I don't know I don't know the -- -- I don't remember it's not my area.
I don't I don't know I personally.
I will not answer any questions or testify about the subject matter of this committee's meeting we had to -- appropriately until.
The report was publicized the published.
Or the president to be able to review it and respond as he did very quickly someone was sixteen -- thought it was a White House counsel -- -- -- was and I notified on April 24 who else besides.
The fact that that.
-- -- about us some other members of senior staff.
I don't have a list when you're asked by this briefing last week about White House officials being -- you just mentioned counsel's office.
You never mentioned that chief of staff and others were.
Well if I think I think it said that White House counsel knew I think that's a good I didn't until Friday but I didn't you know I'm I'm getting this information to you now as quick as possible -- I don't plan.
That made it decision that this is not the kind of thing you know defy the president.
An investigation is not complete.
Well the president doesn't know that everything is going on in every agency of government should mr.
Boehner have known diseases neighboring district -- since.
Cincinnati where the IRS office is I don't think you.
Can hold him accountable I can't account for every conversation that might have been had outside the White House -- I don't I can't tell you how many.
And while we have been told time and again that the taxpayer funded witch hunts and and more than a year ago tonight there are people in the studio audience.
At a gonna say they have been targeted as recently as two weeks ago joining me now the attorneys representing some of the American sitting in -- studio tonight.
Clean -- Mitchell and from the American Center for Law and Justice.
-- on you for having cast -- Jane let me let me start with the timeline here -- -- -- correct me if I'm wrong first -- about this in June 2011.
Is that right.
That's correct that's when she was first notified of the actual targeting that was taking place -- but after consulting.
The treasury consulting with the White House.
We didn't hear about it through -- in the set up question for the ABA until May tenth of 2013.
Right and also intervening in that period of time she came up with another criteria.
To have the determinations unit that I used for tax exemption which actually complicated and made it worse and in fact I think some of that.
Groups sitting in the audience with you today.
Got put in this dragnet because of -- -- But basically broadening out to other conservative organization not just Tea Party groups to be in this dragnet -- -- -- special reveal.
And -- so she basically is responsible for doing that.
And and clean in march of 2013.
Doug Schulman then the head of the higher rest assured the American people in congress that this was not happening correct.
Yes in fact he did that -- -- And response to questions from congressman friend you're putting and others marched forty -- wow that's correct my twelfth -- are right now right.
One of the things I want to ask both of -- the same question that is puzzling to me is she showman met.
It went to the White House 157.
Times now as answer was that while I was there once for Easter egg roll on to a husband -- -- whatever it is.
Nobody as I checked the records the top cabinet members of Obama.
What do you think.
-- an awful lot of conversations.
Yeah I think well number one I it's inexplicable I mean I don't know how you explain a 159 visits by the head of the IRS to the White House.
They they can't possibly talking about that much tax policy.
Because -- there were not made that many changes to the internal revenue code so you wonder what was going on here.
And you've asked the right questions from beginning of this -- -- that is it is who knew what when and I I don't think until -- and I do our discovery in this litigation that were both involved and that we're gonna really get an answer to that.
-- -- what is it specifically.
That matters in my mind this is about intimidating people who -- of their freedom of association and freedom of speech.
What do you think what what are the issues at stake here in your mind.
Well I think the most important thing for all of us to remember is that we always talk about America being a nation of laws not of man.
And what the IRS has done here.
Is essentially -- -- and an abdicated the rule of law where there's a certain set procedure.
For -- and apply for tax exempt status there's an application it has sixty or seventy questions.
Before they began this targeting in 2010.
They would ask questions about the application itself.
And when you have a group of people and an agency -- are allowed to just start making it up as they go along.
They abandon any legal objective legal standard at all becomes subjective and that's what we have here is this morass and the explanation.
That the IRS has been coming out with his preposterous number one that it's some low level employees in Cincinnati I have cases.
That never went to Cincinnati and they still have their taxes and -- after four years and.
That exactly that's exactly what they want.
Well -- -- right I mean I've got you know we had this whole situation where.
The -- was you know basically saying it's all Cincinnati well and what's so bizarre about that -- -- I've got letters.
I'm cases two offices -- California and one -- -- Washington DC.
And it's signed by a tax law specialists of this whole you know low level rogue agents nonsense narrative that the White House came out what was just factually incorrect.
And let me but reinforce something that cleavage -- which is critical here.
They're acting as it up.
And the inspector general kind of alluded to this that the agents themselves in the in those in the -- unit had no real concept of what the law actually is and how it's applied.
But you know what no one of these none of these groups have been denied.
What they've done is granted some have put some in what I call terminal limbo here.
Where they're just not doing anything we have months I mean six and nine months where there was no response from the IRS and that's inexcusable we -- now we now have a much better idea why -- because.
Washington was dictating the terms of this.
But the Cincinnati office is the largest office for tax exempt processing when I was which treasury along time ago in the opposite chief counsel for the IRS.
We represented tax exempt that is not a small division that's significant.
I get to what extent as I went through that timeline they knew and -- -- 2011.
They had finished in in may have 2012 they finish their own internal investigation.
The IG report was supposed to get an interim report in September before the election.
Do you connect this in any way to the election.
Preventing these groups from being able to raise money and be active.
Politically in terms of getting out information about issues they care about you think it's connected in any likely.
I -- -- -- do because fatal but letters remember.
When all of these groups hundreds of groups received these incredibly.
-- -- -- expansive.
Questions from the IRS.
-- -- -- -- -- -- intimidating.
Frightening them making them think they might be doing something wrong if they invited candidates to candidate forum.
Which is completely legitimate for a 501 C four organizations out.
Absolutely it had the effect of intimidating them.
And I will actually I remind everybody these -- still don't have their tax exempt status and what some of my clients.
Received additional letters a month before the election with even more.
Questions unbelievable all right thank you know -- Now still ahead tonight you're gonna hear from the.
