Through regular order.
And -- -- legislation reflects the will.
Of our majority and the will of the American people.
Speaker of the house John Boehner rejecting the notion that his chamber will feel pressure to rush through immigration reform just because the senate passed a sweeping bill -- Speaker Boehner has said whatever measure the house takes up must have the support of the Republican majority.
Which is commonly known as -- rule.
Joining us to discuss -- two key members of the House of Representatives congressman -- -- of South Carolina he's the chairman of the judiciary committee's immigration subcommittee.
We're also hoping to speak with congressman Mario -- a lark a Florida member of the bipartisan group that's been on immigration reform in the house.
We're having some technical difficulties with him -- -- power failure just before we went on the air and we hope to have him join us just as soon -- that respects meantime.
Let's go to South Carolina congressman got a congressman got a good to see you thanks for joining us.
Good morning thank you I assume that you heard senator Schumer talking about immigration he is fairly positive and it is a bit of a bold prediction.
That the house eventually will pass the senate bill what do you set.
Well John -- was moved almost to the point of tears -- senator Schumer is concerned for the future prospects of the Republican Party book but.
Well we're going to not take his advice the senate bill is not gonna pass in the house -- -- -- pass for myriad reasons.
I support immigration reform I think the -- system is broken.
What what our framers gave us two legislative bodies and I assume that they did -- for a reason.
And the house.
Runs every two years with the theory being that we will be closer to the will of the people so.
Under the assumption that the framers meant to give us -- legislative bodies at a house.
Well represented to us what 435 members we're going to work our will like we have been doing for the past -- we have.
We have passed four separate bills out of house judiciary and an additional bill -- a Homeland Security.
So we're making progress and we will continue to do so and -- and I'm more interested in getting it right than doing it.
On senator Schumer schedule that both senator Schumer and Senator McCain and I'm sure you heard the both say this that there is a lot of pressure being brought to bear on the house.
From a very coalition of groups some of whom have not traditionally sided with with Democrats on a much let -- immigration.
We've got the US chamber of commerce you've got the growers you have labor unions you have law enforcement and you have many churches who were saying.
To Republicans across the land.
It's time to pass immigration reform will you be able to resist the pressure that's coming from those groups.
No not I don't think it's a question of resisting I think it's a question of meeting with a group that I have met with every one of those groups multiple times.
The issue is not the broad principles of immigration reform and and humanity and respect for the rule of wall virtually everyone agrees -- the broad principles.
Where we get ourselves into a little bit of the difference of opinion are or are the details so everyone agrees on border security for instance.
But I cannot sell and South Carolina.
A border security plan where the security -- after the legalization I can't -- -- border security plan we're Janet Napolitano.
This to tell us the border is secure.
I can't sell a border security plan with the executive can turn.
On at all triggers.
For politically expedient reasons nor what I try to sell -- -- of those.
Play and so you can agree in theory on border security would disagree very strongly on how it's achieved.
You can agree on a path to legalization or citizenship.
But what what a border security is a condition precedent which it would be in my case is a very important distinction so.
I welcome the input of all of these constituencies and and particularly the faith community that that matters greatly to me as those -- -- -- But John take old -- but for just a second.
The house plan allows state and local law enforcement to assist if they want to if they want to to assist federal law enforcement.
In enforcing our immigration walls well that's -- -- -- in the senate.
The -- is fine with law enforcement of forcing every other category of crime.
From chopper -- -- -- to murder to narcotics trafficking to bank robbery but heaven forbid they get involved in immigration.
So that the reason we have two bodies the reason you go to conference the region you have debate.
This -- you could take these broad principles.
And actually right in the -- legislation and that's what we're trying to do right now.
When you look at the senate bill that just passed with it with a government -- 68 didn't quite get to the seventy that they wanted because they hope that that would put a little more pressure on the house.
It's a comprehensive -- -- and it's kind of a soup to nuts approach you're doing it much more bite sized chunks that shots that you -- so far judiciary.
Increase in visas for highly skilled workers give state local law enforcement greater authority to force me just mention that create a new program for agricultural guest workers expand the use of there's been nothing about citizenship and and what -- you when you look at the eleven million people who -- in this country.
Or -- the country at least illegally.
There is according to Senator McCain -- -- is just a moment ago it de facto amnesty in place if you do nothing.
Why do you feel the need to wait until all of these other issues have been addressed in the what's that we're Lucent's congressman county as well be your back.
Why do you feel the need to address all these other issues first.
Before you approach the issue of a path to citizenship for the very least some sort of legal steps.
Which -- I do agree that what we have -- the fact that Wednesday I have argued that from day one but also agree with this there is a diminution of trust.
-- on our fellow citizens.
And the notion that -- that I can tell the -- Or we're gonna provide legalization but trust us all the border security trust -- -- the internal security trust a soul would be verified.
That's -- -- -- South Carolina I doubt it's gonna fly to Arizona or New York.
There is a lack of trust in the institutions of government.
So what I think is important is to tell our fellow citizens we got the lesson from 1986.
We learned our lesson we're -- -- have the security mechanisms in place.
Which is the respect for the rule ball and then we're gonna show the humanity that defines us as a republic.
I -- and I'm fine -- showing the humanity.
But the order in which it's dawn is important but the other thing is important keep in mind John is the eleven million is there's not a whole would you -- group.
And all of the eleven million do doctors are citizenship.
So what would be curious indeed -- for citizenship or someone who does not want it.
All of the eleven million cannot pass a background check and all of the eleven million or not -- released situated.
You you would agree with me that you should have a different level of scrutiny for a child who's been here for ten years was brought.
Who no will or no action of his or her own.
As opposed to a thirty year old who's been here for three weeks you would not -- the same screwed near the same level of analysis for those two groups so.
I know it's tempting to to speak of them is eleven million as this is all one group with the same characteristics but the reality is there are a number of sub groups.
That frankly or or worthy of of different levels of scrutiny and I hope the house.
Play and we'll -- that I wanna switch gears and it looks like we're not going to have congressman Diaz a -- joining us for which we have apologize to our audience in and him.
The fortunate circumstance with power failure there and in Florida.
But let me switch gears to the IRS.
You want -- -- back before your committee let's go back to -- the 22.
When she appeared before that committee and let's listen to what she said.
I have not done anything wrong.
I have not broken any laws.
I have not violated any -- rules or regulations and I have not provided false information.
To this or any other congressional committee.
She made a statement there about her proclaiming her innocence and then promptly took the Fifth Amendment declining to testify which is -- right.
I think it's his maybe you say the congressman got in the way she did it.
She had waived her fifth amendment rights in the committee voted -- to do to say the same thing at the end of last week you're a former prosecutor.
What do you plan to do about it.
Will you say.
That's all right it is -- right to remain silent it is not -- right.
To all for a lot of exculpatory information to testify -- and say I'm not going to be subject to cross examination because keep in -- job of the right to confront witnesses a cross examine.
Witnesses is also -- the constitution is just in the sixth amendment -- not the fifth so.
What are we gonna do I would hope that -- was -- would feel motivated at some point become -- the information.
She has spoke with congress whether that's in the -- mobile proffer or -- limited immunity agreement.
I'd like whatever information but I've got to be guaranteed her information is accurate truthful and complete.
I am committed to getting to the bottom of what happened with the IRS speaking of lack of trust in the institutions of government.
But but I'll knock it all for I'm not gonna buy you score over the telephone -- and give immunity to lowest order before I hear what she what will.
What she has to say and before I can corroborate or not corroborate her information.
Her attorney basically waved off what the committee decided last week saying it has no legal impact you said that you hope that she would come before the committee is do you have any.
Legal way to compel -- to come back and testify.
-- unless your name is Jack Bauer you cannot make people -- so we can bring her back but you can't make someone tall which you can do is and sent them to -- and we do that.
All the time in the criminal justice system Bob -- for -- prop person.
Limited immunity agreement send.
You know look her attorney was sitting right behind her when she.
My advice to him I don't know when but my advice to him is.
Notify your malpractice carrier first of all because you let your client testify a second a ball.
Bring your client in -- do what's in her best pitchers and it's in her best interest to work this out.
What will what congress with the oversight committee and that would be bye -- source Warner -- right now she doesn't look ruled.
You -- there is a slight resemblance we should point out a congressman data between you and and Kiefer Sutherland well we'll see if -- can.
Compel her to come back in the same way or at least it's similar fashion to that which he went.
Thanks very much for joining us congressman appreciate your time this morning.
Thank you John.
