Good morning hi -- -- Chris -- all and these are your buzz cuts from Fox News first let's go out.
-- growing list of death was called for delay.
Mark Pryor Joseph mansion Mary land grew Kay Hagan and Jeanne Shaheen.
These people are Democrats from either red states or swing states or swing states or vulnerable or moderate or something.
That makes them not exactly Obama Democrats.
And they all think that the health law the requirement that you must buy insurance or pay a fine.
Ought to be delayed some are we just nudging the White House -- six weeks others like mansion say why not a year go for it so that's.
Getting to -- kind of interest thing.
And why they're getting in here saying well that's number two obamacare crash land is in hill hearing today.
House Republicans and Democrats this is what things are actually watch that Republicans.
And Democrats talk about the as we have stated here it's been clinically established who.
It's tough and it's going on today.
There and it's a bit Dicey.
And what's happening today is the contractors are blaming the Department of Health and Human Services in the next week Department of Health and Human Services will blame the contractors and you know you'll get out of it.
Yeah you know which -- gonna get out of it.
Speaking of which.
Civilians at -- not testifying that is a cigar -- why are -- act this Kathleen Sebelius will be seeing those.
As she visits Arizona today instead of coming to the hearing to testify.
She will be -- touring and obamacare call senator.
People are helping people who want to.
Yell at them over the telephone but she's definitely not testify.
Frau Merkel is not.
On the -- Merkel the chancellor of Germany.
Got a apology phone call from President Obama yesterday.
The administration says.
They are not currently monitoring her phone calls.
Which is not the same as saying they didn't monitor her phone calls those are.
Two different things.
And the -- clintonian constructions.
Offered by the Obama administration on this point I have the Germans very upset we don't investor -- love it summoned to.
The US ambassador to Germany.
The French now are joining the -- already the Brazilians in the Mexicans.
Are complaining about US eavesdropping there Edwards Snowden has made life very complicated for this administration it seems.
Very important to us celebrating the sage of Studio One things that matter -- -- new book out this week and he matters to us.
-- the special word about Charles today.
Tomorrow night 10 PM eastern tomorrow night at 10 PM eastern.
A special hosted by Brett -- looking at the life and accomplishments.
A doctor -- our own beloved doctor -- with his book things that matter that all matters and you know why it matters.
If you were subscribed to Fox News first go to Fox News politics dot com up.
And sign up will give -- -- you will give you the world -- about when he 200 words of an every day for nothing.
So we'll do it all right now because this is power -- Affordable health care was never meant to be.
If you've -- shores now you're gonna have to buy insurance is more costly and not as good that.
A president Obama's signature legislative achievement came from West Virginia Democrat Joseph mansion and the he.
And this is power play -- Internet welcome happy Thursday I think it kind of runs together.
But it is Thursday and Democrats are looking to occupy a new space.
As relates president's health -- mansion leading the charge.
Appearing with probably bear big bill O -- eight.
As he lays out a plan for a one year delay.
In the individual mandate.
How is this all shaping up -- where does that and somebody who knows already and if we can convince her to tell us you will be better offices and -- here she is the chief congressional correspondent for.
Not the Washington examiner for Washington examiner hi Susan I'm way over there -- wherever -- Susan good to see you this part of court ordered separation period.
OK so there are two.
This is important for the Internet understand there's two streams of thought here.
So there's the Jeanne Shaheen stream of thought that basically seeks to memorialize what the White House is trying to do through semantics.
You're gonna get find previously everybody thought you're gonna get find if you did not have coverage by the fifteenth of February.
And then the investors that are not in you misunderstood.
-- that silly people.
We -- the whole time that that's when you needed to be registered.
But you didn't have to complete the process until March 31 so -- -- so they're giving themselves like a -- six week delay.
Jeanne Shaheen would like to memorialize that in law and as a law that would do that or maybe even extended -- may.
What made -- -- those very different.
That's right and I think your read on Twitter this morning -- described it is taking a Mulligan.
On the health care a lot timeline.
And you're right it's really two very different things and it's all kind of getting -- together the bottom line being there are a lot of vulnerable Democrats have been 2014 in the South Carolina it's going to be a real hindrance for their reelection -- so.
Jeanne Shaheen mansion he's not ready again but he Sony's always perpetually vulnerable we've -- Mark Prior and others who are really considered in competitive races who want to look -- so they're trying to do something.
To help lessen the burden of this very burdensome new health care law so -- he is saying well let's talk about what the what the tax consequences are going to be and then you have prior and others say let's -- this seeing it.
A lot longer let's push us further in advance in May be here which would be better for any administration this point -- yeah.
Wait a minute now wait it out -- six weeks -- Think they should not is -- Nothing but -- six more weeks to get people signed up if you ask congress start moving legislation that talks about delaying the individual mandate for a year that means that.
We can assume that the people who have already signed up for this law are the and they are not individuals who are undesirable to me.
But they are undesirable customers for the insurance company where the president's partners and that's if you don't get the desirable customers the people that were supposed to be forced him by the mandate.
This ain't gonna work.
Well that did this singing and the plane being missed here not by you -- just overall the discussion is out yes.
If you start the health care -- are rolling people discover.
That their premiums are gonna go out that their health care deductibles are gonna go out that their coverage is going to lessen.
And overall unpopularity of the law is gonna grow exponentially.
If this all happens within the next year -- -- -- operate here past the elections.
You don't have people understanding is in dealing with this before -- Tony fourteen races which I think is going to be ultimately the most devastating thing for the Democrats.
A lot of this is put off past the election year for them.
The more likely it is that senate Democrats are gonna maintain control the senate just picture this Chris what if this law.
It was the web sites all cleared out the next few weeks we get everybody signing up.
What -- would what are people going to discover.
Mean they're going to see that they're the rates are going up.
They're they're doctors or -- are no longer in their health care plan they're losing their health insurance plan.
All these things -- gonna -- a lot faster and are gonna come to a head in 2014.
And that's gonna make it much harder for the Democrats in just a glitzy web site.
You know that Susan -- -- mocking me in real time and I and I I don't know I'm I'm just saying one point oh yeah.
Underlying question I don't care about that -- that's policy.
I -- I got made fun -- my pocket square on the Internet on Twitter Sheehan David -- her colleague and your friends from the examiner are making fun.
My pocket square and it's these are points of celebrity may get a lot of drop her I think man I just watched from the live -- -- In his breast pocket as he goes around -- he's had to beat Ed Henry said to continue to okay.
He's got a Mormon living in his pocket and he is pretending like he's not like through this like through every point is such an exotic thing -- -- -- Right at the right thing this -- it's -- nice to stand and it it actually file stories for him when he wins out of -- -- what's gonna -- Susan what's the what's what's where what's the end game here.
It's really interesting I wouldn't be terribly surprised well first of all those Democrats are trying very hard to point out that this six week extension is really not a six week extension.
It's just a clarification -- you say -- that's right they're saying this is no extension of an individual mandate deadlines and making it very clear that suggests to me that there's going to be a real resistance on the part of Democrats.
Other then of course and people from red states were running in 2014.
The rest of the the group does not want the latest because they note to delay is perhaps to defeat and they have to keep pushing this thing.
They can't bring it to them -- they can't bring some of the biggest problem whenever.
We can have the discussion about which is better or worse for the president and his law politically.
But they don't want to legislative vehicle on the floor of the United States and it's like defense that has anything to do with this because of the very reason that you'll create pressure point to Democrats.
So the president -- Even if he wanted to a year delight in demand arched forward -- it's -- then they've got ramming speed with this thing since Scott Brown got elected in Massachusetts and when I did the procedural and around on that sucker.
Using budget reconciliation I would -- -- -- what -- and they're gonna keep doing that they can't turn off the full speed ahead because they're afraid that if they do that at any point before there -- ten million or so Americans who are receiving that's.
That it will go away and -- just instead of spending a trillion dollars to -- health insurance to fifteen million people they may just give fifteen million people health insurer.
See -- the party is potentially in very much in a no win situation because.
If they stopped a -- now delay your right could be could spell the end it could really do the whole thing.
But if they just let it march -- -- which are trying to do right now.
People -- -- discover really what the laws all about and less -- turns out to be what the president said it will lead ultimately which is -- you like your insurance you get -- if it turns out better than it's looking right now that's great but it looks like it looks right now what we're hearing anecdotally.
I don't see how can be anything but a disaster -- OK here's how you want to close every segment Susan when you come on here's what -- case says Suzanne is awesome and she's right on the button.
And -- -- -- what what you want to what more do you want -- yeah okay that's all I've made that that's what we're all looking for in this life.
Other than to have two can Drucker ripping on your pocket square -- here in the -- studio.
Susan we thank you for making -- for us today have a ground you know Thursday thank you I'm coming for you Drucker.
And we're gonna take a quick break when we come back we're gonna have a stellar panel here including somebody -- I'd like you to -- eight I think you'll like him.
-- -- -- -- more than a website -- And frankly the web site should have been the easy part I'm also concerned about what happens next will enrollment glitches become provider payment which is.
We'll pay to show up -- their doctor's office or hospital to be told that maybe there they are covered or even in the system.
And that's how Fred Upton and secretary the chairman.
The house energy and something committee and got people to pay attention to him instead of his famous niece Kate.
And this is power play welcome back -- up in the air talking about problems with the president's website for this health insurance entitlement.
It stinks and everybody agreed on that point today but Democrats said that Republicans were being cynical.
Because they didn't really want to fix the law they just wanted to use the problems with the web site.
To undo the law and they would seem Frank Stallone seemed particularly shocked.
That that would.
That that would be taking place in this city.
Of all places people who are not shocked by the cynicism of some in Washington.
And how things work -- your friend in -- -- his principal quite so.
-- story partners he's -- former Press Secretary Roy Blunt -- -- a pretty big deal congress.
And I want you to meet.
Arlene Johnson who is a co-founder.
And you should adopt the term principle that I think sounds -- -- principal at armada international advisors.
A democratic strategist welcome to the big show.
Welcome glad to be here while welcome are not take welcome -- -- -- the -- now here's the question now Arlene I know that you are.
From West Virginia.
And I've known you for a long time.
And you know that when you have a hearing like this and you've got you have to blow the whistle on your own team.
It is up on fun day that is a not a fun day when it's a go to your governor or you're president or somebody from your own party.
That you have to go out and finding nuanced way to say.
You screwed up.
Now what Democrats were trying today they had -- phrase in these hearings which was fix it don't mix it.
-- specifics -- don't mix it but the question is this.
Is there significant damage does that do the problems with this launch -- significant damage to the -- -- brand with the general population knows.
Also this is this is the beginning a -- says the you know.
Engagement face there and take 36 months whatever it takes to get people signed up properly.
And they'll have another -- -- have another opportunity.
-- gets more professionals and it's obvious someone dropped the ball in the period in terms of that company.
The companies that were involved or in the news show and yes for the falcons are involved of course -- the administration but I think you do the after action report you find out where the bodies buried I don't know what who did what to -- And you fix.
Spoken like -- West Virginia politician unified over the bodies are buried now the question is.
-- you -- Republicans don't wanna fix it they don't want amend it made you want to end it right.
Yes I think even if you look at the title of today's energy and commerce hearing its implementation failure.
Didn't know or didn't disclose and I think that's really the question here because.
We heard this is going to be a great roll out everyone's excited about it so they didn't know that's incompetence and if they didn't disclose your misleading the American people so I think.
Today's hearing and we talked a few staffers on energy and commerce committee.
That is really the area that's energy and commerce I was -- the energy park is Arlene I was like that's.
I don't know I think they're gearing up for us secretary -- to -- -- next week she'll have some tough questions to answer wins the series comes in next week.
Carly what's she gonna say it's their fault so this week they say it's her fault is -- they also -- it we're not naming any names are not -- -- the Department of Health and Human Services but it's obvious that the.
Department has some culpability here we just see how much and it's also obvious that there's been some contractual agreements with the department and these companies and someone has fallen down on -- But -- tell you can ascertain exactly where the problems are.
I mean Sebelius is there she's doing the job and I think cutting measures -- stick with their until we find out what's going.
She's actually not that she's an Arizona today -- in Boston last night she's in Arizona today and she's going to be everywhere but here.
Until I assume -- now you've you've had to.
Because you've had this.
Do leg work on hearings that were not flattering for Republicans -- and you've had to be through that Democrats talking a lot today about Medicare part -- That came out that -- your former boss is a big part of getting through and getting into law a big difference with Medicare part -- of course.
Don't believe don't don't believe the hype.
Of course the Democrats wanted to keep Medicare part.
Because what they're pollsters told them was that if they didn't give free prescription drugs to old people that they would get voted out of office so of course Democrats wanted to keep at it.
-- is the question is.
Harley's point as we're gonna have a really IP re re launch.
And whether it's now February or march or may.
That after the enrollment period is over and they say here we go that's stuff we had some problems before but now they're gonna have time.
Presuming that they are now aware of how quickly things go that they're gonna have time to roll -- Democrats are gonna say here all the wonder.
Success stories I think what we're seeing chairman Upton during the energy and commerce committee Republicans in the house.
This is a bunch of congress they're conducting some oversight if you look in the senate get editing senate democratic oversight hearings on this and I think we can all see you're -- agree.
This rollout has been pretty be felt here so someone on Capitol Hill hostile about it that's insane.
What went wrong who's responsible how -- we fix it -- go from here.
I think we've set -- perspective this is they roll out.
A bit of a program is extremely important.
But this is just beginning -- just -- going on sign up.
Look at the coverages and deciding what they need fewer they had not been coverage if it's not full augmentation and they are not on this -- yet but this is the time to work through these kind of -- -- you check ups and hides in legislative here so don't act like you have been through you like you have not been there I've seen I've seen it done.
How give me a grade do you think in terms of how the questioning has been today are they taking them the right line are they getting results or they just -- and their -- The problem of course is this is to polarize I mean it's obvious that.
It's obvious that the many Republicans on the committee do not support obamacare will never support Obama care.
You almost they tried as you shut down the government because obamacare and I can't really now they really noticing the roll out wonderfully.
That's what I think and the Democrats and we've got there's some there's some egg on faces there's a little bit of -- hurt feelings and we would have -- -- to go smoothly but now.
That's due to -- is gone let's find out what's going on and let's face it let's take a reasonable path.
The Internet disagrees with you on your assessment about its its effect on the obamacare brand.
Clear -- mind says yes healthcare gov -- up -- do hurt the Obama care rant.
Who -- their right minds would want to provide deeply personal information to a system that is probably full of holes and hackers to access the data.
And as part of the concern and consideration here is.
That when you were asking people so when you say to somebody who is as we've talked met you before if you are pregnant and diabetic woman who has no health insurance and cannot get it under any circumstance.
You're going to do whatever it takes to get health insurance.
And even if that is risky or even if you are told that there are problems and even if you have to wait 28 hours on hold to get it.
You will do whatever it takes to get that subsidized health insurance.
But to that end for younger people or for people who might I -- didn't at that they'd want to spend money to buy health insurance.
This doesn't exactly encourage them.
Absolutely not if you look at least in what 300 million dollars and we don't know that that's a floating met that target is floating some hundreds of millions of -- hundreds of millions of dollars for web -- that doesn't work ends you're asking people to -- personal information.
I think that what they're doing analyses the right thing they should be doing and it will be interesting to see -- secretary Sebelius and actually if anyone along the line claims any accountability.
Public juxtapose that against the fact that when the government -- speech when he lost point four million dollars.
Yes the money should be accountable yes just found out what -- conference in didn't do and maybe need to renew those contracts are either don't pay some bills that are standing out there.
May change orders or whatever it is and that's what you -- but but you need to take a look at what the problem is.
Just -- Willy -- about it won't work in and I'm glad to see congress is doing his job -- to continue his job like from their job also my days from now when the sounds.
Decide where they -- shut the government down again so.
Cal vote -- gal so -- Bo -- gallon follows me -- star one on Twitter agrees with our early right.
At -- star all around -- -- my addiction have you read BA CA.
If making -- descent wage I think she means decent wage you are exempt from Obama -- exclamation point read the law.
No that's not.
That's not actually true what's actually true as.
Is that if you were making a decent wage the higher -- -- comments so it's 95 dollar fine or 1% of your taxable income.
What the law says is either you have insurance.
-- you will pay a 95 dollar fine or 1% of your taxable income.
Which ever is great her.
So it's not just -- 95 dollar fine it's potentially much much more so that's what the individual mandate is and that's why Joseph Manchin has a winning issue.
Four Democrats on their hands if the president was willing to change the law and risk being embarrassed by Republicans.
He could have a win thanks to Joseph Manchin and delay it for a year -- it's going to be -- -- -- the popular I believe is the technical term.
Charlie do you think you'll come back.
I would love to -- in between like if we if we don't have payments -- yeah I mean this is -- these.
I'm well you better not only must make Kelly next time.
Well I remember.
And I understand that.
-- we thank you for coming back thank you OK Internet we're gonna take a quick break but.
We have glad -- -- you judge Andrew -- on -- the Fox News senior judicial analyst quite so.
Will be here to talk about what you O Edward -- yeah he's got to tell you so stick around.
-- president of sure.
The chancellor that the United States is not monitoring and will not monitor the communications.
And there is the recipient of the power play greatest use an engineer and in current politics Jay Carney.
This is power -- -- we're not we're not -- -- terrain.
We're not -- terrain there.
Chancellor Angela Merkel phone calls to Jay Carney that for the president told her this is -- -- welcome back.
Judge Andrew Pollack Tom now knows a thing or two about -- full -- But -- -- -- -- not now but sometime about germs and help people sometimes testify insurance yes so that testifies that something is happening in the courtroom not.
Happened two years ago.
Right exactly exactly well Jay Carney was making sure that you knew that it at this moment we are not currently eavesdropping on Angela Merkel.
Angela Merkel is angry.
Angry rightly saying -- And so -- the leaders of France Brazil Mexico as more and more comes out from -- -- now who couldn't one say.
And I read your column and it was thought provoking but couldn't one say.
That in reality.
He has Edward Stone has harmed our diplomatic relations and made America less safe in the world.
Yes that's the government's argument because the government believe that this massive spying.
And even have to go into how massive it is but we know it's everybody in the united -- -- billions of phone calls every -- correct correct texts emails credit card bills bank statements.
That they -- have to keep that under wraps.
But this was never done by majority vote this was done by secret Fiat right -- -- the constitution was written to prevent anything -- was written to prevent this.
Constitution doesn't say you have spies and you can't have an NSA and he can't look for the bad guys just as you have to do -- lawfully pursuant to the constitution.
If they want -- conversation between you and me on our cell phones they don't get a general warrant.
That's as any conversation in Washington DC on and -- and on the day.
They have to develop a reason and state the reason it's called probable cause why they think you and I -- having a conversation.
Why the conversation is gonna tip them off to something they need to know.
If they don't have that if they can get whatever they want from whomever they want it.
Then we're gonna destroy our relations with other countries and destroy the Fourth Amendment and destroy freedom here without firing a shot.
Contract now the when it comes to what the law there is nothing unconstitutional about eavesdropping on an -- -- phone calls right.
That's cool there is nothing unconstitutional about eavesdropping and in some circles and americans' phone -- yes it will destroy our relationship.
Journal ultimately provide them to do the same thing to -- I mean.
Would be when the NSA.
Stuff that listens to her conversations do they stop when they recognize the voice on the phone like Barack Obama -- the NSA spying and the president of the United States like he's trying to repair the damage that the NSA is done to the chancellor of Germany and I thought about that -- Spying on ourselves.
-- -- that we're sort of through the looking glass that that you think the NF.
Say stops spying when they come to Langley.
Or 16100 Pennsylvania Avenue -- the Supreme Court across the street.
-- -- -- -- -- Creeping me out judge you're creeping me out I don't know -- -- Chris I'm I'm just the messenger I'm just the postman delivering these voters prefer to live and happy days of political ignorance and you can't come down here and answer at all he's a political ignorance you and I -- out of a job.
With the we'd like amidst -- like just happy Mets to settle over this thing out.
I cannot say enough good of course about the judges weekly column.
It is one of the true highlights of foxnews.com and if you go to the opinion section.
You will find it there you will be at a five you will be a little bit outraged you won't even be a little bit entertaining you'll definitely be smarter when you walk away as we are at this very moment.
Let me just thank you -- think you.
All right now you Internet speaking of Smart people.
About Charles -- -- How about our friend our dear colleague Charles Krauthammer.
As we like call him the sage of Studio One.
His new book things that matter is it out this week and we are taking the opportunity to celebrate.
Sir Charles and one way that you can't celebrate that is of course to go by the book it's from crown its excellent.
It's a collection was columns and a very personal look at himself this new piece in the examiner by your friend Tim Carney is great it's a very revealing look.
At the good doctor's life and career but you can also tune in at 10 PM eastern time.
Tomorrow night Friday -- to remind you again tomorrow but 10 PM eastern time on Friday.
