-- -- It's -- -- in the familiar scene America moving vans police someone with a foreclosure notice.
But at a bank that's it happened this past Friday the Bank of America in Florida to David and Goliath story really after a warrant -- Maureen Niger it.
-- -- -- just excuse me were wrongly foreclosed upon by the bank in 2009 they fought back hiring a lawyer and demanding that the bank pay their legal fees.
When the -- stalled in the refused to pay the couple turned the tables for closing on the bank.
And taking -- of the banks belongings joining us now is Warren -- just to talk about Warren nice to see this morning.
Nice seeing you we get a little excited because.
You know it's it's very it's it's very empowering gets very rare it's appropriate -- it's very rare that a David gets to beat a Goliath found.
How did you manage to turn the tables on the bank.
Well we bought our house from Bank of America -- and we we -- -- actually never had a mortgage.
And one day we got served with a foreclosure notice and I attempted to hire a law firm and nobody could help us because we actually word in foreclosure this was a paperwork here.
So -- write my wife and I represented ourselves we fought him in court and we won and beat him finally.
The -- at that point they asked for some fees to be compensated for my time the many hours of time I put into this matter.
We were awarded the fees and they simply refused to pay I I called everybody I could at the bank -- the law firm nobody would pay.
So we were at local Naples Florida law office preparing a a trust because I have some other medical issues and just.
By chance I happen to mention this problem and one of the attorneys there Todd Allen.
Said -- he would represent us and collect the the funds and that's how it all came about he he did just that.
So they would you 2500.
Dollars you basically foreclosed on them how did you get the police.
Behind you.
Well odd Todd contacted the bank and in the law firm and they refused to respond to his requests for the money.
So he went back to court and got a what's known as a Levy and leave -- And enough we ended up for closing on the bank.
It's unbelievable -- -- so the -- the bank has these individual show up -- basically sees their property that must've been a quite a site at a bank.
The yacht was the I -- to read about wanna read a statement from Bank of America and get you to respond with they say we apologize to mr.
-- -- just that there was a delay in receiving the funds the original request went to an outside attorney who is no longer in this business basically saying.
They had no idea this was going on what do you say that -- Warren.
Well I say that that's -- -- they were well aware of what was going on I sent a certified letter to Bryan Moore in -- hand this CEO of Bank of America which was acknowledged they did get it.
They were well aware this problem they were well aware the judgment they took no action.
I called everybody at Bank of America who would listen to me and they just did not respond so -- letter.
And their response is untrue.
And to blame it on the law -- the law firm had nothing to do it this Bank of America was aware of the problem.
-- and the last thing about the apology they could even spell my name right.
And there's a 2800 dollar check I assume -- here but you still and received it right.
I have not from my understanding from my lawyers sheriff's office has it will be turned over very soon hopefully hopefully -- -- so hopefully still come to an end for you assume Warren thanks for joining us a -- I hope so you're an inspiration.
